[en] Abstract
This chapter aims to build on the background offered by De Gregorio’s three constitutional stages of the European approach to digital technologies and to clarify the current phase. It provides a digital constitutionalist overview of European digital rules, namely the recent legal instruments on digital technologies. It measures the liberal, societal, and global constitutionalist perspectives of these legal instruments. Based on this analysis, the chapter concludes with two key arguments. First, the three perspectives of digital constitutionalism have been presented in European digital rules in different provisions. Secondly, the European approach to the notion of digital constitutionalism have given rise to a ‘constellation of legalities’ which provides an interactional ground where different normative actors can interact with one another. The most important aspect of the interaction between the three perspectives of the notion of digital constitutionalism and their reflections and implementation via European digital rules is its promising capacity to address the missing elements of these legalities.
