Abstract :
[en] This contribution analyses the Opinion of AG Emiliou in Nicoventures Trading and Others (C-731/23 P). As is well known, the Plaumann case law has, for decades, been a bone of contention in EU law doctrine and practice. Is now, more than 60 years after the delivery of this landmark judgment, the time ripe for a consideration of the case law under Article 263(4) TFEU? According to AG Emiliou, the answer is yes: in his seminal Opinion in Nicoventures Trading and Others, he proposes to revisit the 'individual concern' requirement and to adopt a broader interpretation thereof, without abandoning the basic tenets of the Plaumann test.
