Abstract :
[en] Issued by Facebook on 17 September 2019, the Oversight Board Charter establishes the framework for creating the Oversight Board, an independent body entrusted with the power to overturn Facebook’s content moderation decisions. Although the Charter is not a constitutive instrument of an international organization, it does resemble one in substance. The Charter’s subject matter is social media platform governance through the balancing of freedom of expression and other human rights, a global challenge that the community of states could in theory address by establishing an international organization or by conferring new powers to existing ones. However, no such initiative is currently on the agenda. The adoption of the Charter could be read as Facebook’s attempt to take the lead, creating content moderation rules and procedures with a global outlook. With this objective in mind, the Board routinely refers to international human rights law in its decisions.
