[de] Am 10.9.2024 sind zwei bahnbrechende Entscheidungen (verbundene Rs. C-29/22 P, C-
44/22 P und Rs. C-351/22) ergangen, in denen sich der EuGH mit der Frage seiner
Zuständigkeit im Bereich der Gemeinsamen Außen- und Sicherheitspolitik (GASP) befasst hat und auch möglicherweise eine der letzten Hürden für den Beitritt der Union zur Europäischen Menschenrechtskonvention (EMRK) beseitigt hat. In diesem Artikel wird ganz zentral auf das Urteil KS und KD/Conseil u.a. (C-29/22 P, C-44/22 P) eingegangen.
On 10 September 2024, the Court of Justice delivered two landmark judgments (joined
cases C-29/22 P and C-44/22 P and case C-351/22), addressing the question of the scope
of its jurisdiction in the field of the Common Foreign and Security Policy (CFSP). Thereby,
the Court may have overcome one of the last hurdles to the Union's accession to the European Convention on Human Rights (ECHR). This article focuses on the judgment in KS and KD/Conseil e.a. (C-29/22 P, C-44/22 P).
