Abstract :
[en] This essay aims at contributing to debates on the Presumption of Innocence (hereinafter, ‘PoI’) focusing on its implications to emerging investigative techniques. Building upon Duff’s concept of ‘civic PoI’ , it explores the idea of anticipating the operativity of the principle to limit the interference of surveillance measures with individuals’ rights even before a suspect has been identified. Focusing on Forensic DNA Phenotyping (hereinafter, ‘FDP’) as a prototype, it examines whether and how the extension of the PoI can enhance protection of the ‘unknown’ and limit the possible harm stemming from state intervention
