This chapter looks at the development of a set of interlocking legal principles to hold the delegation of discretionary powers to account: notably the duty of care and the principle of proportionality. The relation between the concepts of delegation, discretion, care and proportionality are are not always very clearly established in EU law. Therefore, this chapter seeks to undertake a ‘reconnaissance mission’ and trying to explain which principles of review are developing and why. This chapter then seeks to link the developments in an attempt to obtain a clearer view of the overall picture of ensuring effective yet accountable executive decision making in the EU. [less ▲]

This paper analyzes the effects of the inclusion of past experiences in measuring current material deprivation. The method followed generalizes the proposal of Bossert, Ceriani, Chakravarty and D'Ambrosio (2014) by adapting the class of indices on the measurement of poverty over time of Dutta, Roope and Zank (2013). An application to the analysis of material deprivation within EU countries is then provided. Following the path of material deprivation experienced by each individual over time yields a picture which differs from that in the annual results. Since the measurement of material deprivation is used by the EU member states and the European Commission to monitor national and EU progress in the fight against poverty and social exclusion, the results suggest that time cannot be neglected. Countries should not only be compared based on their year-by-year results, but additional information is gained by following individuals over time and producing an aggregate measure once dynamic considerations are taken into consideration. Conventional wisdom holds that building democracy takes time. Deliberative democracy will likely prove no exception. To that end, this chapter will explore one possible path towards more deliberative institutions and decision-making in the form of Gastil and Wright’s proposal for a Sortition Chamber. Our thesis is that deliberative innovations, notably a sortition chamber, require a gradualist approach to implementation. While other authors in this volume may take for granted that some form of sortition chamber will be institutionalized and focus instead on design questions, we probe the necessary conditions preceding institutionalization. To support this thesis, we shall make an argument comprising four main claims. 1.) Sortition is a promising deliberative innovation. 2.) A strong, unaccountable deliberative device like sortition may delegitimize citizen deliberation and future deliberative innovations, in particular a sortition chamber. 3.) A weaker deliberative device like citizens’ consultation is effective though often blocked by a lack of institutional footing. 4.) Citizens’ consultation, once proven to be effective and regular, opens one path towards enhanced deliberative innovations like the sortition chamber. Claim 1.) will not be developed here beyond the point that a sortition chamber’s “hybrid legitimacy” may allow it to overcome critiques addressed to one-shot, single-issue consultative or 1 empowered mini-publics which may lack institutional footing1. Such mini-publics face multiple challenges: significant social or political uptake, electoral accountability, capture by interests, political redundancy, representativeness, biases, frames2. If a sortition chamber prima facie meets or precludes these different critiques, it represents a striking contribution to democratic innovations beyond mini-publics. That said, we must work out claims 2.), 3.) and 4.) in individual sections below. While examples in 3.) and 4.) will mainly be drawn from the European Union, we maintain that this argument is broadly applicable at local, regional national and transnational levels. We argue that, if institutionalizing consultative mini-publics is desirable and feasible at the EU level, it will be all the more so at other levels throughout the decision-making process’ different stages. La présente contribution propose d’appliquer des concepts issus de l’écoféminisme et de l’écocritique matérielle (Iovino Oppermann, 2014), en particulier les notions de « trans-corporéalité » (Alaimo Hekman, 2008), de « mémoire matérielle » (Alaimo, 2010) et de « cyborg » (Haraway, 2008), à l’étude de l’écriture du corps malade. Le corpus est composé de deux blogs dans lesquels les auteurs abordent leur cancer : Georges Hausemer (qui décède de sa maladie durant l’été 2018) est un écrivain, traducteur et éditeur luxembourgeois, auteur de romans et de récits de voyages, qui pendant plus de deux ans relate ses séjours hospitaliers et les traitements médicaux dans « Ich und mein Tumor » (« Moi et ma tumeur »). Élodie Malanda, docteure en littérature comparée et danseuse, fait le récit de sa maladie dans « Les cellules créatives », blog qui mêle écriture intime, chorégraphies, témoignages de patients et présentations de projets artistiques. La lecture comparative de ce corpus original permet de mettre en lumière plusieurs caractéristiques de l’écriture de la maladie sous forme de blog. D’une part, elle relève les moyens poétiques et esthétiques qu’offre ce support scriptural : temporalité singulière, ordre antéchronologique, renvois intertextuels et écriture « extime » [Tisseron, 2001] à l’ère du numérique. D’autre part, elle permet de comparer deux « graphies » corporelles, à savoir l’écriture et la danse, les deux auteurs décrivant et/ou exposant leurs corps constamment en mouvement. Finalement, les observations de G. Hausemer engagent une réflexion sur la perméabilité entre corps et environnement, entre matière organique et substances plastiques ou chimiques, alors qu’É. Malanda interroge le corps et la maladie en tant qu’objets culturels et, par conséquent, possibles sources de création. [less ▲]

Akkulturation ist ein breit gefasstes Konzept, das Veränderungen in Folge eines interkulturellen Kontaktes beschreibt. Im Beitrag werden Modelle sowie der Bezugsahmen der Akkulturation dargestellt. Dabei können verschiedene Facetten des individuellen Akkulturationsprozesses betrachtet werden. Hierzu zählen die Einstellung zur Akkulturation, kognitive Kompetenzen, die soziale Interaktion, die Identität, das Verhaltensrepertoire und die strukturelle Platzierung. Basierend auf dem bidimensionalen Modell war die Akkulturationsforschung im letzten Jahrzehnt stark auf Typologien zentriert, die die Beziehung zwischen der Herkunftskultur und der Aufnahmegeschalt auf Individualebene beschreibt. Dabei wurde vorwiegend von einer Defizitperspektive ausgegangen. In Anbetracht einer globalisierten Welt sollte Akkulturation jedoch aus einer Ressourcenperspektive verstanden werden, da das Wissen um und über verschiedene Kulturen das Verhaltensrepertoire von Individuen erweitert. Inclusive education has become a global norm, supported by the recognition of human rights, and now affects education policymaking and system development worldwide. While important contributions in sociological research on education, disability, and inequality exist, those in life course perspective and international comparative perspectives are rarer. Studies of educational opportunities of children and youth with disabilities and disadvantages over the past several decades underscore the lack of systematic approaches to facilitate educational and social inclusion. Within the educational research field, sociological approaches to disability, to special educational needs, and to inclusive education emphasize such dimensions as exclusion/inclusion, segregation/integration, learning opportunities, in/equality, institutionalization, stigma, risk, and certification or credentials. To recognize and understand the causes and consequences of disability-related inequality requires in-depth dialogue and benefits from results of studies on different levels and within diverse cultural contexts. This article provides insights into disability and inequality in educational opportunities across Europe and an overview of research topics, results, and gaps. The sociology of education would increase its contribution were it to be more inclusive in analyzing the processes that affect educational opportunities and life chances of those who experience disablement in schooling. Par sa variété, la documentation épigraphique offre à l’historien un matériau aussi riche qu’original pour l’appréhension des pratiques médiévales de l’écrit. Issue de la même culture que celle qui a donné naissance aux écrits manuscrits sur parchemin, elle faisait pleinement partie du paysage graphiques des gens du Moyen Âge. L’article, destiné aux étudiants préparant les concours de l’enseignement, vise à les familiariser avec les formes, les fonctions et les usages de cette documentation encore trop peu connue. Écrits publics par excellence, réalisés sur tout type de supports, les inscriptions permettaient la transmission efficace et durable des messages les plus divers. Pénétrant tous les espaces de la vie médiévale, elles constituaient souvent le premier et principal contact avec l’écriture des hommes et des femmes du Moyen Âge. Leur public, comme le nombre des émetteurs, s’élargit considérablement aux XIIe-XIVe s. par un accroissement général de la diffusion de l’alphabétisation, mais aussi par la capacité de l’inscription à répondre aux nouvelles exigences sociales de communication par l’écrit (révolution de l’écrit). Choisie pour son efficacité, sur la tombe ou sur les murs des bâtiments publics, l’écriture épigraphique devint à la fois le moyen d’expression très personnelles et la tribune de prétentions politiques de plus large portée, comme le montre la sélection de dossiers présentés, issus de l’espace français, italien et hispanique. National und international wird der Bildung für nachhaltige Entwicklung (BNE) vielfache Beachtung geschenkt. Während frühere Ansätze zur Nachhaltigkeitsentwicklung vor allem die Verknüpfung von Wirtschaftswachstum und Umweltpolitik fokussierten (WCED 1987, UN 1992), stehen in aktuellen Berichten die Begriffe Bildung und Erziehung im Zentrum (UNESCO 2012, 2016, 2018). Es wird gefordert, „Schule und Gemeinde in ein Netzwerk formaler und nicht-formaler Bildungsprozesse für nachhaltige Entwicklung“ (UNESCO 2012: 32) einzubinden. In den Kerncurricula für den Sachunterricht findet das Thema Nachhaltigkeitsentwicklung explizite Erwähnung (u.a. Hessisches Kultusministerium 2011), jedoch gelingt die Verankerung von BNE im Unterricht nur zögerlich (UNESCO 2017). Aktuelle Studien zeigen, dass Schulbücher häufig für das Lernen BNE-bezogener Inhalte Verwendung finden (Romàn & Busch 2016); in Luxemburg hat eine Arbeitsgruppe von Pädagogen Aufgabenstellungen zu BNE für Schulbücher konzipiert (Andersen 2017). In diesem Beitrag werden zunächst die zentralen Inhalte von BNE mit Bezug auf den Sachunterricht dargestellt, um anschließend das Forschungsdesign und die für die Schulpraxis wichtigen Ergebnisse der TAPSE-Studie vorzustellen. Daraus leiten sich Konsequenzen für die praktische Arbeit im Sachunterricht ab. [less ▲]

George Orwell wrote a review of Adolf Hitler’s Mein Kampf in which he made the following observation: “[H]uman beings don’t only want comfort, safety, short working hours, hygiene, birth control and, in general, common sense; they also, at least intermittently, want struggle and self-sacrifice, not to mention drums, flags and loyalty-parades.” Philip Stephens brought this observation of Orwell’s to my attention in a Financial Times article that sought to make sense of the rise of populist politics in Europe and the United States in our time; a development that came startlingly to a head with the British referendum that triggered Brexit and the election of Donald Trump as President of the United States in October 2016. My paper presented at the January Workshop in Luxembourg engaged with this passage from Orwell’s discussion of Hitler’s Mein Kampf and Stephens’ reading of it in the Financial Times. It described or explained the difference between liberal and populist/fascist responses to times of crisis in terms of the difference between the liberal economy of the gift and the illiberal economy of sacrifice, and scrutinised the possibility of a stable distinction between these two economies with reference to especially Marcel Mauss and Jacques Derrida. This chapter addresses the challenges and limits posed by two sets of supranational law for any reform of international tax systems aimed at capturing profits made in specific digital business models. By way of background, it first analyses the policy challenges arising from digitalization and lists a few policy responses that have been proposed or implemented recently (§3.02). Specifically, it will focus on specific withholding taxes (WHT) tailored to ‘digital transactions’, new source rules (‘digital nexus’, ‘virtual permanent establishment’ (VPE), ‘significant digital presence’ (SDP)) and specific new taxes directly targeting ‘digital business’ (‘equalization levies’ (EL) and ‘digital services tax’ (DST)). As these ideas are all subject to more detailed review in other chapters in this volume, they are described here only to the extent necessary to perform a generic analysis of potential incompatibilities with supra- and international law. The chapter then reviews well-known limits imposed by European Union (EU) law for tax policy- making with specific reference to such proposed policy responses, distinguishing between limits imposed on EU Member States (§3.03[A]) and on the EU as an independent actor (§3.03[B]). It then follows a less well-trodden path, discussing limitations on reforms arising from World Trade Organization (WTO) law (§3.04), before offering a brief concluding summary of the insights gained from the chapter (§3.05). Les archives de la cathédrale de Tournai conservent, sous la côte A 559 du chartrier, un acte scabinal relatif à l’arrentement de diverses parties d’une maison à Philippe Mousket, célèbre chroniqueur tournaisien du XIIIe siècle. Publié pour la premièrefois lors de sa redécouverte dans les archives de la ville de Tournai en 1845, il n’a jamais fait l’objet d’un examen critique poussé. C’est le propos de cet article. Après avoir retracé l’histoire de ce qui représente l’unique acte de juridiction gracieuse de l’échevinage tournaisien de Saint-Brice encoreconservé pour le XIIIe siècle, j’en ai établi la date de rédaction en mars ou mai 1237 et celle des différentes procédures d’arrentement partiel du bien à l’année s’écoulant entre le 13 décembre 1233 et le 12 décembre 1234. Je me suis ensuite attachée à mieux cerner les acteurs concernés et à déterminer la zone où était bâtie la maison arrentée à Philippe Mousket, que j’ai pu localiser dans un secteur de l’actuelle rue des Campeaux grâce aux indices fournis par le Rentier de la Table des Pauvres de Saint-Brice de 1288. L’examen de l’acte a également montré son intérêt pour la connaissance des débuts de la pratique scripturale échevinale à Tournai et des procédures judiciaires et administratives qui y sont associées. En effet, dans le même temps qu’il témoigne de la pratique du record dans sa version primitive (rediffusion verbale d’un accord d’un échevins ou groupe d’échevins à un autre), le document atteste du caractère de plus en plus incontournable du recours à l’écrit dans le second tiers du XIIIe s, même si par certaines particularités formelles –comme la présence d’un dessin vraisemblablement héraldique sur son verso, ainsi que l’absence d’une devise chirographaire, attendue dans ce type d’acte –il révèle le caractère encore non standardisé de la production d’actes privés à Tournai à cette hauteur chronologique. This paper addresses the possibility to build on the success of digital development in order to design messages that will be seen by individuals as being the most relevant to the object being addressed. By studying the social representations status as well as ergonomic features of interfaces like the information elements’ location and the color of background, we tried to determine whether persuasive technology can be a particularly effective medium to achieve favorable attitudes and behaviors towards organ donation. We recorded participants’ ocular activity and administered them a self-reported measures questionnaire. Results show several significant effects, particularly on attitudes, intentions and behaviors. We demonstrate that to increase the persuasive impact of a message, it is better to mobilize central elements of the social representations of the object being treated and to place these elements in the middle of the screen. The blue background screen did not show the expected effects. However, regarding to the interaction between social representations’ status and background’s color, it seems that white is more appropriate than blue for technological persuasion. In the end, this research contributes to propose optimization tracks for public communication though technologies, for example in fields of health, commerce, education, environment, professional efficiency or social media marketing. Throwing a glance on the status quo in schools of different countries in Western and Northern Europe shows that the requirement of inclusive physical education (PE) is implemented different¬ly: Italy, for instance, leads the way with an almost complete inclusion of children into mainstream education including physical education (Magnanini & Espinosa, 2015), in Norway children have the right to follow mainstream education and one talks about “adjusted” education for pupils with special needs (Dalen 2006; Hyde, Ohna & Hjulstad, 2006), Germany is only slowly breaking up with its traditional system of segregating pupils with special needs (Hausotter & Pluhar, 2004). But what are those differences based on? How did inclusive physi¬¬cal education (PE) historically grow in England, Germany, Italy and Norway, and can trans¬national developments be identified? In all three chosen countries different school systems which are representative for other Northern and Western European countries exist. Aim of this study is to compare them, analyze their historical development and find out whether and in how far those differences in the school system and curricula development prejudged chances for inclusive PE and thereby led to diverse nowadays’ situations. As a result, it is confirmed that the educational policy towards inclusion in schools which was internationally determined to apply in different United Nation member states, finally met on the national level in Northern and Western Europe different conditions and social attitudes. This again led to the implementation of specific national inclusive and/or exclusive structures of PE in schools, which finally, despite the geographical proximity, deviate quite strongly, from each other, not only in terms of current content and policy but also in terms of historical development. Gene expression regulation is a fundamental cellular process that enables robust functioning of cells. How different genes interact among themselves to coordinate and maintain the overall gene expression profile observed in a cell is a key question in cellular biology. However, the immense complexity arising due to the scale and the nature of gene-gene interactions often hinders obtaining a global understanding of gene regulation. In this regard, network models of gene regulation based on gene-gene interactions, commonly referred to as gene regulatory networks (GRNs), serve important purpose of describing the overall interactions within a cell and provide a systematic approach to study their global behavior. In particular, in the context of cellular differentiation and reprogramming, where regulated changes in gene expression play a crucial role, precise knowledge of a cell type-specific GRN can enable control of the eventual cell fates with potential clinical applications. In this chapter, we describe our computational methodologies that we have tailor-made with purpose of applications to cell fate control. Briefly, we introduce the process of cellular differentiation and reprogramming, describe GRNs and common strategies to model them, and, finally, introduce the concept of determinants of cellular reprogramming and differentiation. In the Methods section, we elaborate on the different steps involved in the computational pipeline, including initial gene expression data processing, characterization of prior knowledge network, algorithm to remove non-cell type-specific edges, topological characterization of the inferred network, and Boolean network simulations to mimic cellular transitions. Finally, we provide a strategy to identify determinants of cellular reprogramming and differentiation based on the proposed computational methods. [less ▲]

Das belgische Interesse an der Region erwachte nach der Annexion von 1940 erst wieder 1944. This chapter presents a brief comparison of inclusive practice in physical activity and education from four European national/regional perspectives – the United Kingdom, Germany, Italy and Norway/Scandinavia. The contributions are unified in as much as they suggest a common sense of purpose and philosophy; that difference should be recognized and welcomed and accommodation through changes in policy and practice put in place to ensure a broad and balanced physical education and sport experience for all young people. The UK section wrestles with the issue that terminology around inclusion has inhibited a clear direction but also emphasizes the significant role played by education in driving change. The section on Germany further reinforces the crucial importance of embedding inclusive practice in the education context but also highlights the variations in policy that can be endemic in a federal system. The Italy and Norway/Scandinavia contributions show how declarations agreed at international level can influence policy and affect practice on the ground in markedly different ways; in both, a focus on the needs of the individual is key. Whatever the approach, in all cases inclusion is primarily viewed as a fundamental human right. [less ▲]

Health psychology and public health aspire to find ways for evaluating the suffering of patients. Quantitative assessment of pain-related suffering exists, but methodological frameworks implying qualitative approach based on a direct communication with participants are missing. Our aim was to analyse the procedure generating pain and suffering-related items and explore the validity of their content. Volunteers were all right-handed and of European origin. After received information concerning the aims of the study, they signed a consent to accept the experimental pain stimulation protocols and to receive financial compensation. Descriptors of pain-related suffering were gathered through 106 semi-structured interviews of 31 particpants (16 men ;15 women), age 18-33 years. A thematic categorical content analysis on the transcriptions was conducted. Verbatim were extracted and classified under categories. Cluster analysis on word of verbatim using the index of Sorensen was performed with N’Vivo12. The content of each category was validated through consensus by multidisciplinary experts (some have lived the experimental pain stimulation). Then they formulated 70 items to capture the overall pain-related suffering experience. In accordance to theories and with the help of the Sorensen’s similarity analysis, a conceptual framework with different dimensions (physical, mental, etc.) has been discussed and elaborated. The list obtained constitutes a first classification for laboratory use and a basis for the development of a routine clinical suffering assessment tool. This generation process should guarantee that the items are acceptable, comprehensive and relevant (reflecting the lived experience of the participants) ensuring a content validity of the future questionnaire [less ▲]

Binge drinking (BD), an alcohol-consumption pattern characterized by frequent alternations between intense intakes and withdrawal periods, is a widespread habit in youth. It has been shown that BD is linked to impairments in psychological, cognitive, and cerebral abilities. Previous studies notably underlined that impulsivity-related mechanisms might play a pivotal role in the emergence and maintenance of BD. This chapter underlines the importance of impulsivity in BD, by proposing a literature review organized around a theoretical framework distinguishing four impulsivity subcomponents (urgency, lack of premeditation, lack of perseverance, and sensation seeking) and by identifying the (neuro-)psychological and cerebral correlates of each subcomponent. Then, the main challenges for future research are discussed, particularly underlining the need for a multidisciplinary approach to explore the links between impulsivity and other cognitive factors, the causal relationships between BD and impulsive subcomponents, and the interindividual variations of impulsive tendencies in BD. This paper examines literature reviews in 12 master’s dissertations written in German, English and French. Specifically, we analysed the discourse structure of 155 paragraphs to assess the extent to which students manage to write a coherent review combining literature reports with their own ‘voice’. The study was motivated by the design of a multilingual academic writing course at the University of Luxembourg Language Centre. The analysis distinguished three main discourse elements, nl. report, discussion and text orientation. The data reveal considerable variation in the frequency with which these combine to form different paragraph types. However, in all three languages, report discourse uses the same quotation and reformulation strategies and tends to employ ‘list’ structures with few cohesive links. Discussion elements are generally not elaborated and the writer’s voice is weak. Text organization uses the same linguistic strategies and is mainly used to orientate readers rather than to summarize or signal transitions. Pedagogical implications for multilingual academic writing courses are discussed. [less ▲]
