Such factors have always existed in bilateral borrowing from one country to another but the CEFR is a supra-national document accessible through globalised communication. In this process, the increasingly global and extraterritorial elites (the “tourists”) provide a stark contrast to the locally bound, disempowered people, who have to move out of necessity (the “nomads”). In this sense, the memory – or rather the trauma – of the Holocaust is paradigmatic for the entire research field. The Holocaust is furthermore increasingly understood as constitutive of a global memory community which transcends national memories and mediates universal values. The present volume diverges from this perspective by dealing also with everyday subjects of memory. [more ▼] Progress in European market integration over the past two decades has come at the expense of growing flexibility, or differentiation, in the laws that govern the Single Market (SM) as well as the way that these laws are implemented. This volume examines how the completion of the SM has been held back in the varied implementation of European Union competition policy, variation in national policies on services, corporate law, telecommunications, energy, taxation, and gambling, and the EU’s uneven transportation network. These sectors and issue-areas form the frontier at which the main political struggles over the future shape of the SM have taken place in the past decade. Broadly, progress in economic integration in the EU has been complicated by the need to reconcile perfections to the SM with the global competitiveness of European producers, and efficiency gains with ideational and normative concerns. In services, there is a clash between deregulation and social policy. Financial integration has had to reconcile different institutionalized views among the member states about the place of finance in the economy and society. The SM notion supposedly entails a concrete set of substantive policy commitments that form the basis of the ‘ever closer union’. However, increasing differentiation in the SM undermines the identification of the EU’s core constitutional commitments. The collection's three sections address broad issues related to genre, Harry Potter's development as the central heroic character and the question of who qualifies as a hero in the Harry Potter series. Among the topics are Harry Potter as both epic and postmodern hero, the series as a modern-day example of psychomachia, the series' indebtedness to the Gothic tradition, Harry's development in the first six film adaptations, Harry Potter and the idea of the English gentleman, Hermione Granger's explicitly female version of heroism, adult role models in Harry Potter, and the complex depictions of heroism exhibited by the series' minor characters. Dieser historische Vertrag muss im Rahmen der damaligen internationalen Zusammenhänge, der diplomatischen Beziehungen, des Prozesses der Staatenbildung und der Kriegsführung des 17. Jahrhunderts gesehen werden. Der Vertrag hat Auswirkungen sowohl auf europäischer wie auf regionaler Ebene, denn es werden Grenzen nachgezogen und Territorien getauscht. Städte wie Thionville, Montmédy, Damvillers, Marville oder Yvois werden französisch. Die neue Grenze zwischen den Spanischen Niederlanden und Frankreich wird erst nach zähen Verhandlungen festgelegt und gibt Ursache zu vielfältigen Beanstandungen. Der Verlauf wird erst unter österreichischer Herrschaft im Grenzvertrag von 1769 eindeutig geklärt. Doch was bedeuten Grenzlinien im 17. Jahrundert? Wie zeigt sich die Grenze physisch? Was trägt die Kartographie bei? Die französischen Eroberungen führen zur Teilung sehr alter territorialer Einheiten. Es soll untersucht werden, wie die Bevölkerung den Herrschaftswechsel erlebt und gesehen hat. Wurde er einfach hingenommen, oder gibt es im Gegenteil Zeugnisse einer feindlichen Einstellung zu Frankreich? Wie wurde eine Region befriedet, die seit Jahrzehnten in permanenter Unsicherheit lebte? Welche ökonomischen und demographischen Auswirkungen hatte der Vertrag in der luxemburgischen und der lothringischen Region? Leitete er einen wirtschaftlichen und demographischen Niedergang in den annektierten Städten ein? Führte der Vertrag zu einer Neuordnung des politischen und wirtschaftlichen Raumes? Luxemburg verliert seine fruchtbarsten und wirtschaftlich weitest entwickelten Territorien. Le chantier mis en route par la proposition de révision « portant modification et nouvel ordonnancement de la Constitution» en avril 2009 marque de ce fait un moment crucial dans la vie politique. D’autant plus que la réforme, qui favorise l’adoption d’une nouvelle Constitution, est susceptible de déboucher sur un référendum. Pour contribuer à ce débat passionnant et stimuler une discussion publique, la Faculté de Droit et la section luxembourgeoise de l’Institut International de Droit d’Expression et d’Inspiration Françaises (IDEF) ont alors décidé de s’associer pour organiser un colloque scientifique. Cette manifestation, qui a réuni d’éminents juristes et de hauts magistrats venant de la France, de la Belgique et du Luxembourg, s’est tenue les 17 et 18 mai 2010, sous les auspices du ministre de la Justice, Monsieur François Biltgen. Soutenu par le Fonds National de la Recherche, le présent ouvrage en reproduit les actes. Chacun des trois thèmes retenus: les droits fondamentaux, l’autorité de la Constitution et les questions institutionnelles, fait l’objet d’éclairages externes et internes. En complément aux analyses et commentaires des auteurs assemblés, l’ouvrage reproduit les principaux textes et documents disponibles sur le sujet. Le lecteur pourra ainsi consulter dans ce même volume: la Constitution de 1868, mise à jour; la proposition de refonte du 21 avril 2009; une table de concordance ainsi qu’une comparaison synoptique des deux textes; l’avis intérimaire de la « Commission de Venise» et des tableaux récapitulatifs de la jurisprudence de la Cour constitutionnelle.
