« Plutôt mourir ! » : voilà ce qu’évoque pour le plus grand nombre l’éventualité d’aller vivre en maison de retraite. Il faut dire que, depuis près de cinquante ans, ces établissements sont volon-tiers décrits comme des mouroirs. Ils perdurent pourtant, en tant que lieux hautement compé-tents car spécialisés et « adaptés » à la vieillesse, sous la surveillance accrue des services de l’État, dans ce qui est devenu un marché des solutions pour les personnes âgées.Dans un tel cadre, les connaissances envisa-gées comme nécessaires pour bien agir en mai-son de retraite sont hantées par le spectre de la maltraitance et de plus en plus spécialisées, nombreuses, segmentées, normées et parfois contradictoires. Malgré les tentatives d’amé-liorations, les professionnels, débordés, s’y décrivent comme impuissants à produire le ser-vice de qualité qu’ils souhaiteraient, tandis que les résidents y vivent comme dans une impasse, avec la mort pour tout horizon. Mieux com-prendre les contradictions de fond auxquelles la fabrique de la maison de retraite fait face au quotidien permet d’ouvrir des perspectives vers d’autres possibles. [less ▲]

It is common knowledge that protest movements do not persist over long periods. Generally, movements either disappear into oblivion or transform into a NGO or a political party. The World Social Forum (WSF) is the relict of the global justice movements of the turn of the millennium. Even after more than a decade after the first WSF in 2001 in Porto Alegre (Brazil) the protest events still mobilize thousands of activists against a neoliberal world order. With an extensive ethnographic research, Christian Schröder keeps track of the WSF from its origin to the WSF 2013 in Tunisia. The central research question is how the movement – unlike many other movements – manages to reproduce itself as movement since 2001. The research process based on Grounded Theory Methodology let to the development of theoretical concept called transpoiesis that serves to describe the mechanism of permanent reinvention of (transnational) movements. Anhand von 18 Videos wird herausgearbeitet, wie Kinder Tag für Tag die räumlichen, zeitlichen und sozialen Übergänge ihrer Bildungs- und Betreuungsarrangements mitgestalten. Welche Anforderungen stellen sich den Kindern und welche Praktiken entwickeln sie, um ihre zum Teil recht komplexen Betreuungsalltage zu meistern? Gefragt wird: Welche Grenzen passieren und bauen die Kinder dabei und wie unterscheiden sie zwischen den verschiedenen Betreuungsorganisationen, in denen sie sich aufhalten? Wie strukturieren Kinder ihre Betreuungstage? Wie finden sie sich in Kollektive ein? Entlang der Videos wird ein analytischer Begriff von Übergangspraktiken entfaltet, der auf die institutionelle Grammatik von Bildungs- und Betreuungsarrangements zielt – und zwar im Hinblick auf die eigenständigen Beiträge, die Kinder dazu leisten. ReNEUAL Musterentwurf für ein EU Verwaltungsverfahrensrecht. Im Rahmen eines fünfjährigen Forschungsprojekts wurde der hier vorgelegte Musterentwurf eines europäischen Verwaltungsverfahrensrechts (ReNEUAL Model Rules on EU Administrative Procedure) erarbeitet. Ziel des Projekts ist die Verbesserung der Durchführung des Rechts der Europäischen Union durch eine Kodifikation des EU- Verwaltungsverfahrensrechts, die eine effektive Erfüllung öffentlicher Aufgaben ebenso wie individuellen Rechtsschutz gewährleistet. Der Schwerpunkt liegt auf Verfahren vor EU-Behörden, einbezogen werden aber auch wichtige Probleme der europäischen Verbundverwaltung. 18 Autorinnen und Autoren und weitere ca. 100 Fachleute des Verwaltungsverfahrensrechts waren europaweit an der Erstellung des Musterentwurfs beteiligt. This book examines the multiple ways in which rural regions in Europe are being restructured through globalization and the regional development responses that they have adopted. It provides an understanding of the key challenges and opportunities for rural regions arising from the major economic, social, political and cultural changes associated with globalization, including trade liberalization and economic deregulation, increased international migration, and the rise of global consciousness about environmental issues. Drawing on examples and findings from a major European research project, DERREG, the book presents detailed case studies of ten regions in different parts of Europe, exploring the factors that lead to different experiences of globalization in each of the regions, and highlighting examples of good practice in regional development responses. The book concludes by proposing a typology of regional responses to globalization and considering the policy implications of the research findings. The current retrenchment of the welfare states is buffering the growing demographic and economic pressures in European countries at the expense of the young and the elderly. However, both investment in the young, which determines a society’s future, and providing public support for the elderly, the most deserving needy group, are seen as musts. This book encompasses a selection of empirical studies reflecting on when and why the young and the elderly are at risk in several (mostly Western) European countries. How are copyright infringements on the Internet responded to? This study outlines the international, European as well as national legal frameworks with a particular focus on the law of the EU Member States France, the UK and Germany. As regards the analysis of national law, the study differentiates between enforcement mechanism against end-users directly and mechanisms that are directed against infringing materials as such. The study highlights that copyright enforcement on the Internet is a struggle to find the right target and an effective, yet proportionate enforcement mechanism. In addition to the outline and analysis of national approaches in terms of compatibility with fundamental rights and European law, a focus is set on questions of digital evidence and technological feasibility/efficiency of individual enforcement mechanisms. Published in conjunction with Flaka Haliti’s solo presentation conceived for the Kosovo Pavilion at the 56th Venice Biennale, this book continues the artist’s invitation to encounter a visual field in which territorial boundaries are referenced and mediated by the sensory. Through the use of a saturated blue color altered by light and demarcated by architectural forms, the installation at the Venice Biennale reflects on the salient concept of the border. The United Nations building in Pristina was a point of departure for the exhibition, as Vanessa Joan Müller backgrounds in her essay on the project, as well as relating to concerns of the threshold and the horizon line: “Concatenated concrete pylons form a tall, compact barrier which separates the UN building at the city limits from that very city. The concrete of the barriers was painted on the outside to downplay the appearance of a military safety zone. Different shades of blue.” The conversation between Markus Miessen and Haliti in the book tracks topics from migration to subjectivity, material states in relation to the digital and the status of internationalism. Haliti’s approach is to recontextualize these politics into a spatial and visual abstraction. The accompanying book follows through on the exhibition’s experience of place and the notion of the horizon as emblems of both possibilities and limitations; bounded by a deep blue, pages have been set as color fields and the typography of the texts shift in scale. Speculating on the Blue offers multiple entry points for imagining present and future relations to histories and institutions. [less ▲]

Zetzsche behandelt die Entstehung, Funktion und Wirkungsweise von Investmentfonds aus der Perspektive des Privatrechts, der Rechtsökonomie und Rechtsethik unter Berücksichtigung von acht Rechtsordnungen. Er zeigt, dass der im Vertrags-, Trust- und Gesellschaftsrecht übliche Formenzwang dem Investmentfonds nicht gerecht wird. Infolgedessen haben sich in allen Rechtsordnungen, in denen Investmentfonds intensiv genutzt werden, Mischformen gebildet, die zwischen Vertrag, Trust, Körperschaft und Personengesellschaft angesiedelt sind. Der Autor demonstriert die Konsequenzen dieser Typenvermischung anhand der wesentlichen Abschnitte in der Existenz eines Investmentfonds und zeigt daran die erhebliche Bedeutung der Selbstkontrolle der Finanzintermediäre für die Funktionsweise und Akzeptanz von Investmentfonds auf. In the context of globalisation and demographic change, the internationalisation of society is becoming increasingly important, why these anthology raises the awareness for this topic. The first part deals with the topic 'spatial construction through migrants', focusing on the culturally differentiated construction of spaces and landscapes from a theoretical point of view. From a social perspective, the shifts in such needs/requirements and values that people tie to different parts of their spatial environment are of particular interest. For example due to globalisation processes, identity constructions underlie a growing erosion process, concerning the understanding of space and landscape as well as their acquisition. Thus, the different levels of spatial planning are confronted with further differentiated demands in terms of space and landscape presenting major challenges. Based on different case studies, the second topic ‘migration and specific spaces’ that follows the theoretical considerations, reflects spatial demands of migrants and the potential of internationalisation. The selected case studies mainly deal with rural areas as well as the internationalisation in those cities which were not in the academic focus until now. At first, the focus is on the investigation of spatial acquisitions and demands of US-American, Muslim and Turkish migrants. Then the housing situation of migrants is the focal point. This includes the cross-border commuters at the German-Luxembourgish border. The following part is devoted to the potential which can be accompanied by the increasing internationalisation of the society. This is done on the one hand with a theoretical example of identity, home as well as inclusion and exclusion. On the other hand identities and self-attributions of repatriates (so called Aussiedler and Spätaussiedler) from former Soviet Union in Rhineland-Palatinate are discussed. Finally and based on the different articles, recommodations are derived and discussed for the future spatial development that arise in the course of internationalisation of society. This publication of the Research Network on EU Administrative Law (ReNEUAL) is the result of a cooperative effort by many people and institutions. ReNEUAL was set up in 2009 upon the initiative of Professors Herwig C.H. Hofmann and Jens-Peter Schneider who coordinate the network together with Professor Jacques Ziller. ReNEUAL has grown to a membership of well over one hundred scholars and practitioners active in the field of EU and comparative public law. The objectives of ReNEUAL are oriented towards developing an understanding of EU public law as a field which ensures that the constitutional values of the Union are present and complied with in all instances of exercise of public authority. It aims at contributing to a legal framework for implementation of EU law by non-legislative means through a set of accessible, functional and transparent rules which make visible rights and duties of individuals and administrations alike. The Model Rules on EU Administrative Procedure are proof that it is possible to draft an EU regulation of administrative procedures adapted to the sometimes complex realities of implementing EU law by Union bodies and Member States in cooperation. De manière générale, le livre vise à évaluer la nature et le degré d’autonomie de la Chambre des Députés du Luxembourg et son rôle dans le processus décisionnel en regard de la démocratie parlementaire (le principe directeur du régime politique grand-ducal), et, par rapport aux critères notamment fixés par l’Union interparlementaire en 2007 et en 2008 et par la Commission européenne pour la démocratie par le droit en 2004 et en 2008 dans ces domaines, particulièrement l’initiative législative, le contrôle parlementaire, le statut de la chambre législative dans la constitution et le processus décisionnel. Par l’évaluation du rôle et de l’autonomie parlementaire, le livre vise à donner au législateur des pistes de réflexion et éventuellement des instruments pour améliorer le contrôle démocratique de la décision politique. Il apparaît cependant que cette vision étroite de la démocratie n’est pas satisfaisante et menace la démocratie elle-même. Une exigence morale doit donc être réaffirmée aujourd’hui et se traduire davantage dans les faits. Mais comment ? En premier lieu, du champ théologique au champ des sciences sociales, qu’implique ici le concept de « valeur spirituelle » dans son rapport à la démocratie ? En second lieu, sous quelles conditions les religions peuvent-elles apporter aux démocraties des ressources qui leur manquent plus aujourd’hui qu’hier, en acceptant de se placer dans le cadre démocratique. Today, numerous organisations rely on information software systems to run their businesses. The effectiveness of the information software system then, depends largely on the degree to which the organisation’s business is accurately captured in the business model. The business model is an abstract description of the way an organisation’s functions. Thus, the more precise the business model, the more accurate the requirement definition of the information software system to be engineered. A dependable business process is one whose failures or the number of occurrences in which business process misses its goal are not unacceptably frequent or severe, from certain viewpoint. A collaborative business process is one that requires the interaction of multiple participants to attain its goal. A time-constrained business process is one that owns at least one property expressed in terms of an upper or lower time bound. This book investigates how Dependable, Collaborative and Time-constrained business processes can be described such that the resulting model captures all the relevant aspects of each dimension of interest.
