The European Union has adopted several Directives harmonising the rights of the suspects and accused persons in criminal proceedings. The effectiveness of defence rights granted by EU legal instruments does not simply rely on their correct implementation in national law, but also depends on the existence of enforcement and control mechanisms granting judicial protection to individuals. Although the Directives impose remedial obligations on the Member States, the different structure and scope of judicial control under national law is likely to undermine the justiciability of procedural safeguards granted by EU law. Divergences among national criminal justice systems raise further challenges in the field of cross-border cooperation. In light of the recent case law of the European Courts, the present book explores the scope and meaning of the right to effective judicial protection in criminal proceedings in relation to the first three Directives of the Stockholm roadmap. It offers a comparative analysis of the national implementations of these so-called ABC Directives in six Member States, focusing on legal remedies that ensure the effectiveness of the rights granted by the EU Directives. This volume presents the results of a study carried out by a group of European criminal law experts from 2015 to 2017 thanks to the financial support of the EU Commission. [less ▲]

Since the late 2000s, German-Iranian artist Bettina Pousttchi has been creating works at the intersection of sculpture, architecture, and photography. Her large-scale installations investigate the history and memory of places, exploring the connections between time and space from a transnational perspective, and have gained her international recognition and praise. This book features Pousttchi’s new photographic installation at Nivola Museum in Orani on the Italian island of Sardinia. She chose the Metropolitan Life Building on 1 Madison Avenue in Manhattan as her subject for this piece. Criticized for its blatant Italian references at the time of its completion in 1909—and the world’s tallest structure until 1913—the building displays a hybrid identity, recalling cultural and temporal-spatial dislocations between the Old and the New World, Renaissance and Modernism. Published alongside the images of Metropolitan Life and other works by Pousttchi are an essay by art historian Greg Foster-Rice and a conversation between the artist, critic, and curator Hans Ulrich Obrist and architect and writer Markus Miessen. Elles sont aujourd'hui des éléments incontournables du quotidien pour la plupart d'entre nous. Qu'il s'agisse des smartphones, d'objets connectés ou de dispositifs numériques médicaux et d'e-santé, ces outils numériques prolifèrent littéralement dans notre environnement. Ils font office de prothèses qui « augmentent » nos capacités cognitives mais également d'orthèses qui influencent bon nombre de nos comportements. La généralisation de ces machines semble même en mesure de transformer nos modes d'organisation sociale de manière conséquente. Les outils numériques qui emmaillotent sans cesse davantage le corps et l'esprit sont-ils en mesure de bouleverser notre ordre social ? Pourraient-ils littéralement entraîner demain la disparition de la société telle que nous la connaissons aujourd'hui ? Attention plays a pivotal role in the experience of pain and its impact upon daily activities. Accordingly, research on the interplay between attention and pain has a long scientific history. Within this chapter, we discuss the theoretical frameworks that aim to explain the relationship between attention and pain. We argue for a motivational perspective on pain that highlights the critical role of cognitive, affective and contextual factors in explaining the interplay between attention and pain. To substantiate this argument, we provide an overview of available research addressing the bottom-up capture of attention by pain and the top-down modulation (both inhibition and facilitation) of attention for pain. We conclude this chapter with guidelines and suggestions for future research and discuss clinical implications of adopting a motivational perspective on pain. [less ▲]

“Xeno” speaks to the turn away from “what is” toward “what could be”: the (as yet) unknown, the alien—having been employed in recent years through such speculative-political approaches as xenofeminism and xenopoetics. Perhaps It Is Time for a Xeno-architecture to Match documents a conversation series from January to March 2017 that explored what an intervention of the xeno might bring to bear on contemporary and future (infra)structure. This book aims to unpack the prefix, probing what it entails—not merely rhetorically but also as a means of practice, in an attempt to bring the ideas it contains more concretely into the domain of architecture. It proposes to link the more philosophical discussions on the notion of xeno with questions of instrumentalization and governance that are necessarily involved in the praxis of architecture. And it relates the significance of legal architecture and technologically driven transformation in the metaphysics of law back to the agenda of xeno-architecture. The Greater Region Saar-Lor-Lux : Towards cross-border supraregionalisation ? Border areas are often portrayed as 'laboratories of European integration'. Beyond the discourses and symbols, what does the concept of cross-border region actually entail? By characterising the region as the construction of an identity, a territoriality and a governance system perpetuated over time, this publication identifies and questions the specificities of these processes in the cross-border context. It distinguishes between inter- and supraregional cooperation thus questioning a border area's capacity to develop an ad hoc cross-border cooperation whose raison d'être consists in strengthening the commitments pertaining to the border area's interests. This study is underpinned by a discourse analysis and a conceptualisation of cross-border territoriality and supraregional institution. In this respect, the significance of the EGTC (European Grouping for Territorial Cooperation), a European instrument providing a legal framework for cooperation, is analysed. This issue is explored in depth using the emblematic case of the Greater Region, a border area that launched in 2008 a long-term strategy to develop a 'cross-border polycentric metropolitan region'. Composed of Lorraine (France), Luxembourg, Wallonia (Belgium), Rhineland-Palatinate and Saarland (Germany), the Greater Region constitutes one of the oldest border areas (1971) and presents the highest concentration of cross-border workers in Europe. The prohibition of slavery is a fundamental norm in contemporary international law. It is an integral part of all major human rights instruments, and it is generally presented as an obligation towards the international community as a whole. Prior to the Second World War and the emergence of international human rights, the international antislavery law was tightly linked to the ambiguous idea of “civilisation” and, more precisely, to the ability of the Western States to define themselves as “civilised nations” as compared to the rest of the world. As a matter of fact, the very notion of “civilised nations” appeared for the first time in the history of international law in the Declaration of the Eight Courts Relative to the Universal Abolition of the Slave Trade of 8 February 1815. Signed at the Congress of Vienna, the Declaration was also the first multilateral instrument that condemned the slave trade. As shown through the book’s systematic survey of relevant State practice (including more than 450 slavery-related treaties and numerous pieces of colonial legislation relating to slavery and forced labour), the antislavery principle proclaimed in 1815 soon gave rise to more stringent and detailed norms. However, its precise scope remained under constant debate. One major question that arose during these debates was whether a “civilised nation” which had formally abolished the institution of slavery but tolerated or used certain forms of forced labour could be accused of having infringed its obligations under international antislavery law. Only in 1945 would the adoption of the Nuremberg Charter bring a positive answer to that question. In short: - First systematic comparative study of slavery and forced labour in international and colonial law before the advent of international human rights - First systematic survey of hundreds of antislavery treaties (including several hundred treaties with non-Western polities). Friedhelm Brusniak will have duly celebrated his sixty-fifth birthday with birthday cake, sparkling wine and other culinary delicacies in the family. The present academic birthday cake is addressed to the friend and colleague Friedhelm Brusniak in recognition of his life achievement. The authorship is composed of companions with whom Friedhelm Brusniak, on the one hand, was, closely connected during his long career as a scholar, and, on the other hand, with fellow researchers, he came later into contact as a networker in the international context. For the editor, it was important that the academic freedom of every one should be respected and that no restrictions should be imposed on the authors. The 21 articles, in four languages – German, English, French, Italian – are published in alphabetical order of the authors. (The only exception are the texts by Andreas Eschen and Anna-Christine Rhode-Jüchtern. They are related and printed successively.) The authors come from Germany, France, Great Britain, Italy, Luxembourg, Austria, Poland, Slovenia, Hungary and the United States of America. The portrait at the beginning of the book was drawn by Barbara Plattner. The articles are preceded by four greeting messages, including a sounding one composed by longtime friend Heinz Werner Zimmermann. Although ordered without a thematic context, the contributions reflect the considerable spectrum of the long-standing scientific work of Friedhelm Brusniak. In addition to his ambitious work as a university professor and scholar, he did never refrain from accepting additional responsibilities, e.g. from 1994 to 2002 as President of the German Mozart-Society and from 2009 to 2013 as the first chairman of the Hermann Zilcher Society. The texts in connection with Leo Kestenberg occupy a large part of the book. This will be noted with satisfaction by Friedhelm Brusniak, president (since 2012) of the International Leo-Kestenberg-Society. Furthermore, the reader will find texts on choral, wind and amateur music research ("community music") as well as on questions of music education in a historical context and an empirical perspective. Also, the contributions cover a timeframe of more than 400 years. They deal s.l. with cultural heritage in a multi-faceted Europe and beyond. Finally, the essays with a philosophical-religious background and in connection with Freemasonry should be emphasized do not stand alone but should be considered as an integrative part. The editor is particularly satisfied and grateful from coming personally in contact with Karl-Heinrich Ehrenforth, the esteemed colleague and friend of Friedhelm Brusniak, and that Prof. Ehrenforth probably provided his last publication to this Festschrift. After his death, his daughter, Christiane Ehrenforth, granted permission to publish. Friedhelm Brusniak’s affinity for interdisciplinarity was met more unconsciously than consciously. He uses the term "interface research"! This has been the case for biography research since his employment with Conrad Rein as well as for musicological research from his home region Waldeck. This is especially true for choral music research, which became his central field of scholarship at the beginning of the nineties. Friedhelm Brusniak comes from a family wind musicians. In the research efforts of the International Society for the Research and Promotion of Wind Music (IGEB), he recognised the congeniality to choral music research, s.l. "community music". For many years now, his contributions to IGEB conferences have received much attention. Conversely, Friedhelm Brusniak received, since the beginning of the eighties, the decisive impulses from the IGEB under Wolfgang Suppan, which he was able to transfer to choral music research and to the Singer Museum in Feuchtwangen, where he serves as a scientific head. As a trained music educator and chair of the Department of Music Education at the University of Würzburg, Friedhelm Brusniak maintained European and international partnerships with music pedagogues, initially in the Arbeitsgemeinschaft Süd (AG Süd) and then in the Forum of European Music Pedagogy (FEMP). His connection with Luxembourg, at the intersection of French and German music pedagogic traditions, was a matter of concern to Friedhelm Brusniak. He was particularly inspired to detect and expand European networks. Please refer to Martin Straus, who provides a more detailed glimpse in the following article. The number of non-German authors is an impressive proof of Friedhelm Brusniak’s constant and interesting view across the borders of his country and his successfully established and maintained contacts. Die vorliegende Veröffentlichung ist ein Ergebnis dreier Forschungsprojekte, darunter hauptsächlich „Musikgeschichte in Luxemburg“. Es wurde in den Jahren 2012- 2015 unter der Leitung von Damien Sagrillo durchgeführt und von der Universität Luxemburg finanziert. Mit der staatlichen Unabhängigkeit Luxemburgs im 19. Jahrhundert und der Errichtung eines Bischofsitzes im Jahre 1870 hat sich, neben der weltlichen, zudem die Kirchenmusik in Luxemburg etabliert. Die zweite Hälfte des 19. Jahrhunderts ist geprägt durch die kirchenmusikalische Reformbewegung des Cäcilianismus, der seinen Niederschlag auch in Luxemburg hauptsächlich in der Person Heinrich Oberhoffers fand. Im vorliegenden Band wird – ergänzend zu Band 1, in welchem der Briefwechsel zwischen Heinrich Oberhoffer und Franz Xaver Witt thematisiert wurde – der Briefwechsel mit Witt im Zusammenhang mit Luxemburg als Faksimile und in transkribierter Form erstmals veröffentlicht. Vorangestellt sind biographische Skizzen von Witt und den Briefautoren in Zusammenhang mit Luxemburg, sowie eine Einführung in den Cäcilianismus. Die Studie ist nicht nur für den Cäcilianismus luxemburgischer Prägung von Belang, sondern versteht sich außerdem als Anregung für weitere Forschungsanstrengungen im Zusammenhang mit katholischer Kirchenmusik zwischen 1850 und 1900. Many libraries own an extensive collection of historical maps. Beside their value as historical objects, these maps are an important source of information for researchers in various scientific disciplines. This ranges from the actual history of cartography and general history to the geographic and social sciences. With the progressing digitisation of libraries and archives, these maps become more easily available to a larger public. A basic level of digitisation consists of scanned bitmap images, tagged with some basic bibliographic information such as title, author and year of production. In order to make the maps more accessible, further metadata describing the contained information is desirable. This would enable more user-friendly interfaces, relevant queries of a database, and automatic analyses. This international workshop provides a forum for the communication of results that may be useful to the community. Researchers and practitioners of many areas working on unlocking the content of old maps have contributed to this year’s program — humanities scholars, developers, computer and information scientists and map enthusiasts. Europe’s sovereign debt crisis and the accompanying national bank crises in the European Union brought bank regulation and supervision to the top of the EU policy agenda. In a few short years, we have witnessed a ‘great leap forward’ for European integration marked by over a dozen pieces of EU legislation shaping the operation of banks, rules on bank capital, reconfigured supervisory agencies, and Banking Union. The significance of these measures lies however, in the fact that they constitute the most dramatic transfer of policy-making powers to the European level since the start of Economic and Monetary Union in 1999. This volume addresses the three main political battles behind the adoption of these new regulatory and supervisory policies. First, it examines divisions among states, both according to their domestic institutional structures, including distinct financial systems, as well as their creditor or debtor status in the crisis. Second, it studies the battle over national versus supranational jurisdiction. Le tabularium médiéval de Sant'Apollinare, à présent dispersé dans plusieurs archives et bibliothèques milanaises, préserve en outre des nombreux témoignages indirects du processus de transformation de l'appareil communal ambrosien vers les nouvelles formes de la Seigneurie, qui eut lieu à partir du milieu du XIIIe siècle. Bei der Erhebung von 50'000 stellungspflichtigen Männern in den Jahren 2012/13 sowie rund 1’800 gleichaltrigen Schweizerinnen standen zwei Fragen im Vordergrund. Erstens: Was sind die aktuellen Lebens- und Zukunftsvorstellungen der jungen Erwachsenen? Und: Welche Rolle spielen neue Medien im Leben einer der ersten Generationen von Digital Natives? Die Vergleiche mit früheren ch-x-Erhebungen bei den jungen Erwachsenen an der Schwelle von der Jugend- ins Erwachsenenalter belegen eine hohe Trendstabilität bei den Grundwerten, bei der Rangierung der Wichtigkeit von Lebensbereichen sowie bei den Determinanten der Berufswahl und den Familien- und Geschlechterrollenbildern. Werte, Familie und Freizeit Junge Erwachsene streben nach Unabhängigkeit und Selbstverwirklichung, betonen individuelle Bedürfnisse und aspirieren auf einen hohen sozialen Status mittels beruflichem Erfolg. Sie rangieren die Wichtigkeit der Lebensbereiche gleich wie die Befragten früherer ch-x-Erhebungen. Bei der Familiengestaltung sind herkömmliche Familien- und Geschlechtermodelle nach wie vor hoch im Kurs. Man möchte heiraten und Kinder haben. Der Mann wird ungebrochen in der Ernährerrolle gesehen, während die Frau sich um die Familie kümmern sollte. Diesbezüglich unterscheiden sich die Lebensansichten und Zukunftsvorstellungen der Digital Natives nur geringfügig von denjenigen der vorhergehenden Generationen. Wandel prägt indes das Freizeitverhalten insofern, als informationstechnische Unterhaltungsangebote und soziale Netzwerke neben herkömmlichen Medien zu wichtigen Gestaltungsfaktoren für die Freizeit avanciert sind. Die jungen Erwachsenen stehen heute in einem sich akzentuierenden Spannungsfeld zwischen dem Wunsch nach Selbstverwirklichung und dem Festhalten an traditionellen institutionalisierten Strukturen und Rollenbildern. Für erstere bieten die neuen digitalen Medien in Art und Form zahlreiche neue Optionen, die rege genutzt werden. Für letztere steht das Festhalten an klassischen Familienmodellen und hohen Berufszielen. Damit steht diese Generation vor der Herausforderung, viele nur noch schwer zu vereinbarende Wünsche mit gesellschaftlichen Erwartungen in Übereinstimmung zu bringen. [less ▲]

With the demise of four multinational empires at the end of the First World War (Russian, German, Habsburg and Ottoman), nationalist forces all over Europe claimed the right to a territory for what they considered to be their own people. The peace treaties resulting from the Paris Peace Conference in 1919 caused a major redrawing of the map of Europe. As a result of the Treaty of Versailles, Germany handed over a considerable amount of its territory at its Western, Northern and, most significantly, Eastern borders, to neighbouring states. This edited volume focuses on the regions lying in what one could call a ring around Germany lost by Germany after the First World War. The European border regions of an-nexation, as I call them, switched their sovereignty as follows: Alsace-Lorraine became French, Eupen-Malmedy Belgian, North Schleswig Danish, various former Prussian Eastern provinces became Polish, the Hlučin region Czechoslovakian, and the Memel region Lithuanian. By set-ting up a historical comparison of the living conditions of children in European borderlands of annexation throughout the 20th Century, this edited volume provided the context for an encounter of a new combination of categories from different disciplines: Borderland Studies meets Child Studies. Il titolo del libro separa in endiadi un’espressione unitaria – conversione del contratto di lavoro – tanto ricorrente nel linguaggio comune e nella prassi quanto ritenuta inaccoglibile sul piano giuridico. L’accostamento della tecnica della conversione del contratto alla disciplina dei rapporti di lavoro è volto a segnalare, almeno in ipotesi, una certa contrapposizione tra la fattispecie di cui all’art. 1424 c.c. e le norme del diritto del lavoro che implicano l’invalidazione del contratto originario e ne prospettano una proiezione futura. Sullo sfondo di tale meccanismo si registrano risultanze normative che negli anni recenti hanno mutato sensibilmente la fisionomia, l’estensione e gli equilibri interni della legislazione lavoristica. Tra queste, la progressiva individualizzazione del diritto del lavoro si è manifestata attraverso un tentativo di ridurre l’importanza della contrattazione collettiva e un ritorno al contratto individuale quale fonte di regolazione del rapporto di lavoro, fattori che hanno favorito l’accentuarsi di un’interazione più diretta fra legge e autonomia individuale. In misura crescente si sono così rilevati momenti di tensione tra uguaglianza e libertà, tra eteronomia e autonomia. Confrontandosi con tali mutamenti, il libro mira a raccogliere i diversi significati dell’espressione “conversione del contratto” impiegati nel diritto del lavoro per proporne una sistemazione ordinata, in linea con i caratteri tipici del rapporto fra norma invalidante e aspirazione ad assicurare ove possibile la continuità del rapporto di lavoro. In The Century of Science, a multicultural, international team of authors examines the global rise of scholarly research in science, technology, engineering, mathematics, and health (STEM+) fields. At the beginning of the 20th century, the global center-point of scientific productivity was about half way between Western Europe and the U.S., in the North Atlantic. Then, the center moved steadily westward and slightly southward—reflecting the burgeoning science capacity of the U.S. supported by America’s thriving public and private universities, technological innovation, and overall economic growth. After WWII, this began to change as the course of the world’s scientific center of gravity turned and for the next 70 years traveled eastward, the direction it still travels, especially due to the rise of China and other prolific East Asian countries, such as Japan, Taiwan, and South Korea. Europe continues to be the center of global science. Focusing on these developments, this volume provides historical and sociological understandings of the ways that higher education has become an institution that, more than ever before, shapes science and society. Case studies, supported by the most historically and spatially extensive database on STEM+ publications available, of selected countries in Europe, North America, East Asia, and the Middle East, emphasize recurring themes: the institutionalization and differentiation of higher education systems to the proliferation of university-based scientific research fostered by research policies that support continued university expansion leading to the knowledge society. Growing worldwide, research universities appear to be the most legitimate sites for knowledge production. Countries like France, Germany, the United Kingdom, the United States, and Japan began the 20th century with prerequisites in place to realize the emerging model of university-based research. Over the past several decades, China, South Korea, and Taiwan, with different historical legacies and conflicts in education and research policy, have witnessed explosive growth, sustained by public and private funds. Qatar recently embarked on an ambitious government-driven effort to develop a world-class university sector and cultivate academic STEM+ research from scratch. These more recent entrants to the global scientific enterprise pose the question whether it is possible to leapfrog across decades, or even centuries, of cultivating university systems, to compete globally. Simultaneously with international and regional competition, world-leading science increasingly implies collaboration across cultural and political borders as global scientific production and networking continue to rise exponentially. This volume’s case studies offer new insights into how countries develop the university-based knowledge thought fundamental to meeting social needs and economic demands. Despite repeated warnings that universities would lose in relevance to other organizational forms in the production of knowledge, our findings demonstrate incontrovertibly that universities have become more—not less—important actors in the world of knowledge. The Principles of European Cooperative Law (PECOL) focus on the ‘ideal’ legal identity of cooperatives. Drafted by a team of legal scholars, the PECOL aim to describe the common core of European cooperative law. They are based on both existing cooperative law in Europe and the EU regulation on the societas cooperativa europaea. The Principles are accompanied by commentaries which illustrate the rationale and legislative background of each principle, and link them to the key features of cooperative identity. The PECOL are articulated into five chapters corresponding to the main aspects around which a cooperative’s identity may be structured, namely the purpose pursued, internal governance, financial structure, external control and cooperation among cooperatives. The second part of the book presents the national reports upon which the PECOL were based. The reports offer a detailed overview of the cooperative law of seven European jurisdictions (Finland, France, Germany, Italy, Portugal, Spain, and the UK), and thus provide a unique opportunity for law-makers, practitioners and researchers to compare, circulate and apply best practices of cooperative legislation. Un colloque organisé à Yaoundé en 2013 est venu combler cette lacune académique ; voici rassemblées les conclusions auxquelles il est parvenu. Il apporte cependant de nombreuses réponses à ceux qui doutent du sens de cette législation applicable à 17 pays.
