Annotated Legal Documents on Islam in Luxembourg consist of an annotated book of currently valid legal documents affecting the status of Islam and Muslims in Luxembourg. By legal documents are meant the texts of legislation, including relevant secondary legislation, as well as significant court decisions. Each legal text will be preceded by an introduction describing the historical, political and legal circumstances of its adoption, plus a short paragraph summarising its content. The legal texts will be published in the original language while the annotations and supporting material will be in English. The focus of the book is on the religious dimensions of being Muslim in Luxembourg, i.e. on individuals' access to practise their religious obligations and on the ability to organise and manifest their religious life. It's a part of a project will cover the 28 member states of the European Union (including Croatia), Norway and Switzerland plus the European Union and the European Court of Justice. [less ▲]

The European Union is a union under the rule of law and accordingly all exercise of public authority needs to conform with the principle of legality. The legal framework of the EU is, however, as much as that of any state or international organization, subject to change over time. That part of this legal framework specifically governing EU administration has been particularly dynamic. The central reason for this dynamism is to be found in the evolving nature of European integration, and in the changing requirements and conditions for implementing EU policies. The legal framework of administration has been both the subject of, and a response to, change in the ambient political and institutional environment. The EU, having started as an organization of six Member States focused on economic integration, has evolved into a Union of twenty-seven Member States now touching almost all elements of the exercise of public power in a modern society. The evolutionary development of the constitutional basis of EU law, with its many phases of Treaty reforms and change induced by case-law, finds its parallel in EU administrative law. European administrative law has in this process grown, changed, and indeed matured over time, and has emerged as an important, yet sometimes not well understood, factor which materially shapes policy in the EU and its achievement in reality. The rise of the importance of EU administrative law is itself attributable both to the specificities of European integration and to the general increase in the importance of administrative regulation in the past decades. On the one hand, the protection of the society against risks associated with private activity such as banking, food production, energy production and distribution, transport, or activities threatening to the environment, to name just a few, and the achievement of a balance between their benefits and dangers have become increasingly important subjects of attention. On the other hand, the provision of services and infrastructure necessary to ensure and protect basic standards of living such as pensions, health care, access to water, energy supply and telecommunications services have been the subject of mixed regimes, often still having a strong public service element, but increasingly left to private provision subject to various levels of market regulation. Both kinds of motivation for regulatory measures and their implementation by appropriate authorities have added to, and substantially changed, the broad character of public administration in Europe in recent decades. Such changes have occurred not just on a national, that is, Member State level, but also, pre-eminently, on the level of the European Community and now Union. Indeed, many of the changes have themselves been triggered on the European level as integral or at least adjuvant elements of the establishment of the European internal market. The role, then, of administrative law and administrative activity on the European level is extensive and important. Rules and principles governing the exercise of administrative functions, the organization of the institutions and bodies exercising these functions, and applicable procedures are the essence of EU administrative law. These are the subject of this book. There are, it must be observed, many perspectives from which one can view, analyse and comprehend both administration and administrative law. Three models or perspectives appear to us to be particularly helpful: administration and administrative law may be usefully considered from functional, organizational, and procedural standpoints. The functional aspect of administration refers to the totality of the tasks of administration, no matter who undertakes them and how they are carried out. The organizational perspective emphasises the organization and structure of the institutions, bodies, and actors engaged in undertaking such tasks. Finally, a procedural understanding of administration observes the processes which link the various actors and authorities in the performance of administrative functions. None of these models standing alone provides a fully rounded understanding or conceptualisation of the subject matter of the book. A proper analysis of EU administrative law cannot view it from only one of these perspectives. Taken together, however, these three standpoints do offer a comprehensive perception, giving the subject a more multi-dimensional shape, and thus allowing a more tractable presentation of what is very complex material. For this reason, we offer a discussion of each of these three perspectives — the functional, organizational, and procedural aspects of European Union administration and the associated legal framework — by way of introduction. The three models are, of course, closely interlinked and in reality scarcely separable but, for analytical and presentational clarity, they are here addressed separately. [less ▲]

Inclusive education has become a leading theme internationally over the past several decades, as it addresses key issues, often controversial, of exclusion/inclusion, learning opportunities, and educational equality and justice. Among international organizations as well as supranational governments, we find an increasing emphasis on recognizing diversity and enabling education for all. This is visible in the Salamanca Declaration (1994), the overall “education-for-all” agenda, the Sustainable Developments Goals (e.g., Education, SDG 4), and the worldwide ratification of the UN Convention on the Rights of People with Disabilities (e.g., Article 24 on Education), which mandates among state parties the establishment of an inclusive education system across levels, from early childhood to lifelong learning. This frame of reference is not only significant in terms of definitions and contents but also in the context of the strengthening of world society. The world societal level is not the same as what occurs in the relations between nation states, as important as such learning in policies and practices may be but extends beyond. This is evident in the definition of “inclusion” that has become significant internationally as a category signifying attempts to guarantee access and participation in different levels of education systems, but one that has contrasting and divergent understandings, implications, and implementation consequences between national and local contexts. The goal of participation that follows normatively and legally from such understandings of inclusion, is recontextualized differently, sometimes even paradoxically, when in fact segregated and separate settings are extended under the banner of inclusion. In Germany, for example, despite inclusion discourse flowing from such international agendas that focus on processes of integration and participation, the structures, cultures, and practices that disadvantage and disable continue to exist or even become strengthened. Even if the myriad dimensions of diversity are increasingly discussed and intersectional approaches become more important, the emphasis on difference of disability or “special educational needs” continues. In educational research, numerous publications have delineated the establishment of inclusive education from diverse perspectives. Over the past decade in particular, this has occurred in relation to the UN CRPD, which also implies a connection to the world society-frame; however, theorization and in-depth empirical analyses are lacking to explain more recent developments on multiple levels. Even for nation-states, few systematic and comparative studies have analyzed the diverse forms of inclusive education in different contexts. The consequence has been a divergence between the national discourses of inclusive education, for example, in the German-speaking countries, that remain focused on special educational needs, and the more global discourse that understands inclusive education in human rights terms and a key developmental process in democracies. Although some recent comparative research projects and dissertations provide insights into specific country contexts, a more comprehensive publication that collects such research results of international inclusive educational research has been lacking. Furthermore, the opportunity presents itself to extend the dialogue through a world society perspective on inclusion to reflect global inequalities via integrating case studies from the Global South. International and intercultural perspectives enable the investigation of structures, cultures and practices of different countries to the crucial comparison of educational processes. This is especially necessary in the case of inclusive education, whether as a source of inspiration, a reflexive critique of taken-for-grantedness or as a means to identify disparities and social inequalities. Thus, in several dozen chapters, the Handbook Inclusion International presents diverse global, national, and local perspectives on inclusive education. [less ▲]

[less ▲]

After World War II, as Europe floundered economically, British Prime Minister Clement Attlee looked to disengage Britain from some of its broad international obligations and increase American support for its new foreign agenda. One place he sought to do so was in Greece, which was in the midst of a civil war. Through an in-depth study of Anglo-American diplomacy in Greece from 1946-50, Spero Simeon Z. Paravantes reveals how the relationship between Britain and the US developed in this formative period. He argues that, in many ways, Britain used the fast-escalating tensions of (what would become) the Cold War to direct and manipulate US policy in Greece, encouraging the Americans to take a more active role and (essentially) take Britain's place in the region. In the process, he sheds fresh light onto how the American experience in Greece contributed to the formulation of the Truman Doctrine, the infamous NSC-68 document and the ultimate birth of the Cold War. Drawing on a wide range of sources from Britain, the US, Greece and across the Balkans, Paravantes has produced the first book to focus on this crucial period in such close detail, and reveals the ways in which various foreign and domestic concerns coincided at a pivotal moment of twentieth century history. This book is essential reading for all scholars looking to gain fresh insight into post-WWII Greece, the Anglo-American alliance and the complex origins of the Cold War. [less ▲]

Regional (sub-)groupings have played a significant, but comparatively neglected role in the processes of European integration. The BENELUX and the Nordic Council both offer longstanding models of regional cooperation which have, in various ways, often been cited as examples for the wider European integration project. More recently, both the Visegrád and Baltic states have seen the (re-) emergence of forms of regional cooperation in connection with their accession to and later membership of the European Union. Yet, though often cited, these experiences of (sub-)regional cooperation within the wider European project have been the object of relatively little systematic or comparative study. The aim of the edited volume is to address this gap by bringing together specialists on these regional groupings with a view to providing a fuller understanding of both their historical significance and their possible future role relative to a potentially fragmenting European political landscape. This book provides a concise, practical guide to the European Union’s Anti-Tax Avoidance Directive (ATAD). Presenting unique insights into the ATAD’s five specific anti-avoidance rules, its chapters explain the background of those rules, the directive’s interactions with relevant jurisprudence, and the challenges posed to the ATAD’s interpretation and implementation in domestic law. Key features include: • critical, article-by-article analysis of the ATAD • contextual information on the legislative environment in which the ATAD operates, embedding it in the wider landscape of CJEU jurisprudence • insights into the day-to-day application of the ATAD rules in practice • contributions from leading academics and practitioners in the field of tax law • examples of the challenges to the interpretation and implementation of ATAD, taken from a range of EU Member States. European and international tax advisors, along with policy makers in the field of tax law, will find this book to be a comprehensive yet accessible guide to the ATAD and its correct application. Those who carry out research in European tax law can also benefit from this book’s critical approach to the ATAD and the questions that surround anti-tax avoidance legislation in the European Union. The volume brings together the work of sixteen scholars focused on the diverse debates surrounding the construction and operation of Banking Union (BU), and its necessary reform. BU represents one of the most important developments in European integration since the launch of Monetary Union. Furthermore, the design of the BU agreed between 2012 and 2014 was a messy compromise among EU member states. It is not surprising then that BU has sparked a lively academic debate and triggered an ever-growing number of publications from different disciplinary backgrounds. The first wave of academic work on BU focuses upon the economic rationale underpinning the supranationalisation of control over banking — regulation, supervision, support and resolution — and the political dynamics and legal issues that shaped the design of the Union agreed. This volume is located at the intersection of this first phase of academic research and a second stage which analyses the functioning of the different elements of BU. New research questions are triggered by the albeit limited empirical evidence on BU’s implementation and operation. Contributions to this second wave of research attempt to identify potentially dangerous lacunae and contribute to on-going reform debates. [less ▲]

Multilingual Approaches for Teaching and Learning outlines the opportunities and challenges o multilingual approaches in mainstream education in Europe. The book, which draws on research findings from several officially monolingual, bilingual, and multilingual countries in Europe, discusses approaches to multilingual education which capitalise on students’ multilingual resources from early childhood to higher education. This book synthesises research on multilingual education, relates theory to practice, and discusses different pedagogical approaches from diverse perspectives. The first section of the book outlines multilingual approaches in early childhood education and primary school, the second looks at multilingual approaches in secondary school and higher education, and the third examines the influence of parents, policy-makers, and professional development on the implementation and sustainability of multilingual approaches. The book demonstrates that educators can leverage students’ multilingualism to promote learning and help students achieve their full potential. This book will be of great interest to academics, researchers, and postgraduate students in the fields of language education, psychology, sociolinguistics, and applied linguistics. [less ▲]

For a decade now, borders in Europe have been back on the political agenda. Border research has responded and is breaking new ground in thinking about and exploring borders. This book follows this development and strengthens a perspective that is interested in life realities and that focuses on everyday cultural experiences of borders. The authors reconstruct such experiences in the context of different forms of migration and mobility as well as language contact situations and are sensitive to the freedom of the participants. In this way, they empirically identify everyday cultural usage or appropriation strategies of borders as vastly different experiences of borders. The readers of this volume will gain insights into current developments in border research and life realities in Europe where borders are (made) relevant. In November 2017, Council Regulation (EU) 2017/1939 implementing enhanced cooperation on the establishment of the European Public Prosecutor’s Office (‘EPPO’) entered into force. The EPPO is a new body of the European Union that will investigate and prosecute perpetrators of criminal offences affecting the financial interests of the Union. Being the first EU authority to exercise direct powers vis-à-vis individuals in the field of criminal law, the EPPO represents a paradigm shift in the EU criminal justice field and requires several amendments of national legislation. The Member States that take part in the EPPO enhanced cooperation are currently in the process of implementing the Regulation in order to make their criminal justice systems compatible with its provisions, and allow the EPPO to carry out its activities once the Office will be up and running. Building on the Symposium that took place in Coimbra on 29–30 March 2017, which was co-organised by the European Criminal Law Academic Network (ECLAN) and the Instituto Jurídico of the Law Faculty of the University of Coimbra, this book offers a comprehensive overview of crucial aspects of this ambitious and debated EU initiative, in both its European and national dimensions. It aims to analyse key issues related to the functioning and legitimacy of the EPPO from a European perspective, such as EPPO independence and material competence, judicial review of its acts, and protection of fundamental rights in the framework of EPPO proceedings. At the same time, it also represents the first publication that, in the wake of the Regulation’s adoption, discusses the challenges that the implementation of this EU legal instrument is currently raising in some Member States, namely Austria, Finland, Germany, Lithuania, Luxembourg, and the Netherlands. From complex multi-players to casual gaming: video games are the most common virtual environment for entertainment that younger generations spend a significant time in. Although early game titles already featured morality-related topics, implementing meaningful eudaimonic playing based on moral decision making has become increasingly popular. Unfortunately, scientific analyses of game-related moral decisions mostly revolve around the effects of players engaging in virtual violence, leading to ongoing heated debates in academia and the general public (e.g., Anderson et al., 2010; Ferguson, 2007). To date, however, only few studies have tried to disentangle the moral aspects of video games from virtual violence (e.g., Joeckel, Bowman, & Dogruel, 2012). The present chapter provides an overview on both established and novel theories on psychological processing of moral decision making in virtual worlds in line with cutting-edge game examples. These theories aim at explaining how games can elicit moral processing as well as the factors that modulate these processes once the player is morally engaged. Based on i.a. aspects of the theory of presence (Biocca, Harms, & Burgoon, 2003; Tamborini & Skalski, 2006), moral disengagement (Bandura, 2002; Hartmann & Vorderer, 2010) and a dual process model of moral judgement (Greene, Sommerville, Nystrom, Darley, & Cohen, 2001; Gubbins & Byrne, 2014; Haidt, 2001), a new model is proposed. Furthermore, individual characteristics such as playing experience, player motivation and moral salience according to the moral foundations theory (Haidt & Joseph, 2008; Tamborini, 2011) are integrated in the model. Can the rules of the European Union’s E-Commerce Directive, which date back to the year 2000, continue to be valid with regard to the dissemination of content in view of the constantly evolving online environment and the changing role of platforms as a result of new business models? The relevant legal foundations in this respect at EU and national level are complex, and their interplay is often unclear. The resulting uncertainty about who is responsible and therefore liable for certain content requires a critical review of the current legal framework. This study, conducted by the Institute of European Media Law (EMR) on behalf of the State Media Authority NRW, analyses the current legal framework and reveals ways of enforcing the applicable provisions concerning illegal content. It pays special attention to the need for reform of the E-Commerce Directive in light of the changing role of platforms. [less ▲]

This volume analyses Belgian garrisons in the Rhineland and Westphalia after the Second World War. They are analysed as contact zones that clearly indicate the political, economic, societal and military consequences of European integration for daily coexistence. The book’s contributions focus on mechanisms and catalysts of entanglement, dissolution and coexistence in local spaces, which did not relocate transnational contacts within Europe to national borderlines, but permanently (re-) configured them in a confined space. How do transnational contacts take place? How have they changed in the face of different geopolitical and geostrategic circumstances? This volume intends to give European integration history new impetus by rediscovering European regional history. [less ▲]

Why drama of multilingualism? The book starts with a vignette on the (mis)understandings of the kindergarten situation around strawberries. By this vignette, I introduce different levels of power relations between children, parents and teachers around language use. I then use Nancy Hornberger’s (1989) Continua of Biliteracy model through which I broaden this vignette and describe the structure of the book: why I chose to deal with this subject, what is my approach, why I conducted the interviews and discussion with the experts and their students in the US and how I plan to integrate this into something novel worth reading. Through the interaction with the experts on the topic I had during the interviews I focus on several topics: the necessity of defining and theorising in a specific social context, power relations, language policy, linguistic creativity and criticality, support for multilingual identity, gap in research. I conclude by underlining the notion of whether there is more or less drama in this field and who cares about it. [less ▲]

In the wake of the so-called digital revolution numerous attempts have been made to rethink and redesign what scholarly publications can or should be. Beyond the Flow examines the technologies as well as narratives driving this unfolding transformation. However, facing challenges such as the serial crisis, knowledge burying or sudoku research the discourses and practices of scholarly publishing today are mainly shaped by confusion, heterogeneity and uncertainty. By critically interrogating the current state of digital publishing in academia the book asks for how a sustainable post-digital publishing ecology can be imagined. [less ▲]

"A contemporary history of Luxembourg in 70 chronicles" by Denis Scuto is a collection of 70 press chronicles, published from 2014 to 2019 in the Luxembourg newspaper Tageblatt. It is "public history" in the best sense of the word, because Denis Scuto as a professional historian intervenes directly in today's debates and enlightens them in a dazzling way by replacing them in the history of Luxembourg and Europe. It is a book aimed directly at the general public, which does not necessarily read scholarly works, but is interested in understanding the country in which it lives and works, with its indissolubly linked past and present. It is therefore a contemporary history because, over the course of the current debates commented by Denis Scuto, the essential elements of the construction of contemporary Luxembourg appear: the birth of the Grand Duchy as a nation-state, its hard learning of independence throughout the nineteenth century, political and social struggles, the consequences of the two world wars, its destiny as a country made of migratory flows, the upheaval of a rural country that became an industrial power and then a European and financial centre, etc. [less ▲]

[less ▲]

The 50th anniversary of the death in 1967 of the famous music teacher, ethnomusicologist and composer Zoltán Kodály reminded us that another renowned music pedagogue, Leo Kestenberg (1882-1962), was born in the same year as Kodály. As such, the joint Kodály Kestenberg Conference provided a welcome opportunity not only to address aspects of music pedagogical and biographical research which had hitherto received a limited amount of attention, but also to highlight a number of key moments in history, and the resulting impact these had had on music pedagogy. The significant level of international interest which music educators showed in the Kodály Kestenberg Conference fulfilled the organisers' desire to create a forum for the free exchange ideas. It also enabled participants to review our commonalities and differences and to look beyond our individual national developments and evaluate the methods and concepts of two significant personalities in the history of musical education in the first half of the 20th century. The sheer diversity of historical and current topics in music education research both inside and outside of Europe, not only reflects the fact that in the 21st century, music education research has established and profiled itself in a wide range of sub-disciplines in addition to revealing new fields of inter-disciplinary research. The effectiveness of reforms initiated and implemented by Kodály and Kestenberg extend to the present day and continue to influence discussions around the future perspectives of music education. This is illustrated by the example of formal and informal learning in the field of elementary music pedagogy. The "Century of the Child" proclaimed in 1900 by the Swedish reform pedagogue Ellen Key (1849–1926) has left its mark on music education through reformers such as Kodály and Kestenberg into the 21st century. This conference book contains articles which are subdivided in five sub-categories: (1) The function of Music Education, (2) The Historical Era of Kodály and Kestenberg, (3) Learning and Instruction, (4) Assessment Technologies in Music Education and (5) Effects of Music Training. The contributors come from six different countries namely, Austria, England, Germany, Hungary, Israel and Luxembourg. The editors would like to record their thanks to both: (1) the Pedagogical Faculty of the John von Neumann University, Kecskemét and the dean Dr. Fülöp Tamás and the vice-dean Dr. Sági Norberta for hosting the conference, (2) the International Leo Kestenberg Society. The editors also acknowledge that this research is supported by EFOP-3.6.1- 16-2016-00006 “The development and enhancement of the research potential at John von Neumann University” project. The Project is supported by the Hungarian Government and co-financed by the European Social Fund. This book - which features a foreword by Jean-Claude Juncker, President of the European Commission, and a Preface by Professor Harold James (Princeton Unviersity) -examines the European vocation and achievements of Pierre Werner (1913–2002),former Prime Minister, Finance Minister and Foreign Minister of Luxembourg, unanimously recognized as one of the architects of the Economic and Monetary Union. The author makes extensive use of Pierre Werner’s previously unpublished archives belonging to the Werner family, opened for the first time for research purposes. The book analyses the Werner Report, negotiations within the Werner Committee, the emergence of the Committee’s views on EMU, their political commitment to a European currency, the similarities and differences between their ideas, their personal networks, the influence of the states they represented, their theoretical and methodological input and their contribution to the political consensus. Chapters shed new light on various aspects of the European integration process and also on the role of Luxembourg and its European policy. In addition, the author has carried out a series of original interviews with Luxembourg and European figures who share their memories and thoughts concerning Pierre Werner, his achievements and his views on the European integration process, and also other topics such as the Economic and Monetary Union and Luxembourg‘s European policy. This book will be of interest and value to researchers, EU policy makers and students in the fields of political economy, political science, economic history and history of economic thought. Time is a crucial dimension in the application of any law. In tax law, however, where an environment characterized by rapid change on the national, European, and international levels complicates the provision of accurate legal advice, timing is particularly sensitive. This book is the first to analyse the relationship between time and three key areas of tax: treaties, EU law, and constitutional law issues, such as legal certainty and individual rights. The issues arising from the interplay of these various areas are analysed from a both academic and practical angle, providing important insights independent of the concrete national framework within which tax rules are applied. This volume contains the papers presented at the 42nd German Conference on Artificial Intelligence (KI 2019), held during September 23–26, 2019, in Kassel, Germany. The German conference on Artificial Intelligence (abbreviated KI for “Künstliche Intelligenz”) has developed from a series of inofficial meetings and workshops, organized by the German “Gesellschaft für Informatik” (association for computer science, GI), into an annual conference series dedicated to research on theory and applications of intelligent system technology. While KI is primarily attended by researchers from Germany and neighboring countries, it warmly welcomes international participation. The KI 2019 conference took place in Kassel, Germany, September 23–26, 2019, and it was held in conjunction with the 49th Annual Conference of the German Computer Science Association (INFORMATIK 2019). Information about the event can be found at www.ki2019.de and informatik2019.de, respectively. KI 2019 had a special focus theme on “AI methods for Argumentation” and we especially invited contributions that use methods from all areas of AI to understand, formalize, or generate argument structures in natural language. The special focus theme was organized in cooperation with the DFG funded priority program “RATIO: Robust Argumentation Machines”. Besides this special focus theme, the conference invited original research papers and shorter technical communications on all topics of AI. Further, we asked for the submission of extended abstracts summarizing papers that had recently been presented at major AI conferences. KI 2019 received 82 submissions, with authors from 25 countries. Submissions were – except for some special cases – reviewed by three Program Committee members. The Program Committee, comprised of 51 experts from 9 countries, decided to accept 29 papers. Out of these, 16 submissions were accepted as full papers, 10 as short papers and 3 as extended abstracts. The program also included three invited talks: – Jürgen Altmann (University of Dortmund): Autonomous Weapon Systems – Dangers and Need for an International Prohibition – Michael Beetz (University of Bremen): Digital Twin Knowledge Bases – Knowledge Representation and Reasoning for Robotic Agent – Antony Hunter (University College London): Towards Computational Persuasion for Behaviour Change Applications Two of these presentations are summarized in papers contained in this volume. Overall, it was a pleasure to organize KI 2019 and we are grateful to our co-organizers, Alexander Steen (Workshops and Tutorials Chair) and Kristina Yordanova (Doctoral Consortium Chair), who provided valuable additional support in organizing the event. We thank the Program Committee members and all additional reviewers for the effort and time they invested in the reviewing process. Further, we thank the Organizing Committee of INFORMATIK 2019 who took care of finances and local organization and allowed us to focus on the scientific aspects of the conference. Our appreciation also goes to the developers of EasyChair, which provides great functionalities that helped to organize the reviewing process and to create this volume. Last but not least, we would like to thank SAP SE for generously sponsoring travel grants for students to attend KI 2019. July 2019 Christoph Benzmüller Heiner Stuckenschmidt [less ▲]

Starting in the 1980s, competitive pressures and the ideology of competitiveness have shaken and transformed traditional models of development, public policy, and governance in Europe. This edited book carries out a comprehensive, interdisciplinary, and innovative analysis of the relationship between competitiveness and solidarity in the contemporary European Union. It offers an original contribution to the scholarly debates on the current developments and challenges of welfare states, social and economic policies, and forms of governance in the European Union. Bringing together an international team of cutting-edge scholars in the social sciences and the humanities, Competitiveness and Solidarity in the European Union sheds light on the conceptual richness and policy relevance of these relationships, pointing to important avenues to make the European Union more economically successful and socially fairer. Ubi servi erant?
