This thesis examines the scope, role and contemporary application of the traditional principle of public hearings, with a particular focus on the specific dispute resolution system of investor-state arbitration. Whereas there have been extensive discussions in recent years surrounding developments which aim to increase the procedural openness and transparency of this traditionally private dispute resolution system, the emergence of a distinct requirement of holding public hearings in such contexts has not yet been given much attention. This thesis seeks to provide a better understanding of public hearings in investment treaty arbitration. By going beyond the usual narrative of the legitimacy and policy objectives of transparency, a more systematic and comprehensive approach to the issue of public hearings in investor-state arbitration is adopted. In addressing existing gaps in the literature, this thesis contends that current developments related to the principle of public hearings should not be analysed as a phenomenon specific to investor-state arbitration, but should instead be analysed within the broader context of the analogous developments at both the domestic and international level. In conducting such an investigation, this thesis situates the debate surrounding public hearings in investment treaty arbitration within a broader legal landscape, encompassing both national and international courts and tribunals. By examining the evolution of public hearings, it is argued that a steady shift in the understanding of the principle of public hearings over time may be detected. Public hearings have gone from serving merely as a means of protecting the individual from the secrecy and arbitrariness of the state, to becoming a democratic tool which the public is entitled to use not only in order to monitor and evaluate the administration of justice, but also as a platform for facilitating further public debate. In other words, the thesis demonstrates a shift in the understanding of the principle of public hearings from being a mere right of an individual to be heard in an open court, to the (additional) right of the general public to have an insight into what goes on in the courtroom and the active duty of the courts to ensure that this right is respected. This latter aspect of the principle of public hearings is subject to comparative analysis which examines the normative and practical solutions adopted by national and international courts when applying the principle of public hearings. While detecting a divergent legal landscape when it comes to providing public access to hearings, this thesis reveals a general trend towards greater regulation of the ways in which the public may obtain such access. What is more, it shall be shown that, in an era of expanded media coverage of public hearings, the subsequent enlargement of the audiences for such hearings, and the possibility to instantly disseminate information about proceedings through various technologies creates new paths for procedural openness and new challenges for the courts. Based on the findings of this comparative analysis, the thesis argues that it is not only the principle of public hearings which has been renewed and transformed. In seeking to adapt to the principle, the procedures in which the principle of public hearings operates have also started to change. This comparative analysis then forms the basis upon which a critical analysis and in-depth assessment is provided within the context of public hearings in investor-state arbitration. From a more “dispute-oriented” perspective, the thesis looks into the considerations and challenges that ought to be taken into account by arbitral tribunals and parties when organising a public hearing. By not losing sight of the implications for the system as a whole, however, the thesis addresses the future impact that the introduction of public hearings into the system investor-state arbitration may have on that system and, notably, upon its procedures. The key finding here is that the increasing relevance of public hearings in investor-state arbitration constitutes merely one part of the overall evolution of the “public” dimension of the requirement of public hearings. When taking these developments together, the thesis concludes that the debate on what constitutes a truly public hearing has entered a new epoch, with new actors and new challenges. [less ▲]

The paper explores the issue of new urban development areas from two specific perspectives: on the one hand, rather than concentrating on housing, we address the question of science and research, in particular university locations and science parks, as a central guiding principle for urban expansion. On the other hand, the paper focuses on the analysis of urban management and governance practices and, more specifically, the disjoining of large projects from their common urban planning context. Emphasis is put on the fact that such undertakings are defined as ‘projects’ and that they are subordinated to a specific management approach. Amid debates concerning large-scale urban development projects and urban governance, we develop the thesis that the risk for projects to unfold as a sort of ‘foreign matter’ in the urban realm increases as the degree to which they are subject to proven planning processes and regulatory practices diminishes. This argument will be empirically illustrated with Belval, the science city in the south of Luxembourg, which is developed ever since 2003 and whose progress is critically assessed here. The general conclusions include planning requirements for dealing with new large-scale development projects. [less ▲]

Cable overloading is one of the most critical disturbances that may occur in smart grids, as it can cause damage to the distribution power lines. Therefore, the circuits are protected by fuses so that, the overload could trip the fuse, opening the circuit, and stopping the flow and heating. However, sustained overloads, even if they are below the safety limits, could also damage the wires. To prevent overload, smart grid operators can switch the fuses on or off to protect the circuits, or remotely curtail the over-producing/over-consuming users. Nevertheless, making the most appropriate decision is a daunting decision-making task, notably due to contractual and technical obligations. In this paper, we define and formulate the overloading prevention problem as a Multiobjective Mixed Integer Quadratically Constrained Program. We also suggest a solution method using a combinatorial optimization approach with a state-of-the-art exact solver. We evaluate this approach for this real-world problem together with Creos Luxembourg S.A., the leading grid operator in Luxembourg, and show that our method can suggest optimal countermeasures to operators facing potential overloading incidents. This paper deals with a question that is becoming increasingly important for historians who work with digitised cultural heritage: what are the politics of digitisation and what are its implications for historical research? Is the often-lauded democratising potential of digitisation also offset by risks, inherent in selection processes that might privilege the digitisation of heritage corresponding to existing national master narratives, the availability of funding and/or the priorities set by cultural policies and certain research agendas? How does transnational heritage fit into this picture when most digitisation projects are, in one way or another, nationally framed? What biases can digital archives introduce in our work and how does that differ from issues of bias and selection in the ‘paper’ archive? In discussing these questions, I will provide a couple of examples before emphasising the importance of more transparency in this regard and the need for guidelines about how digital archives are constituted. A key point to highlight is that professional historians can and should be more open to learn from the experience of digital archivists and librarians who are at the forefront of the digital turn in heritage work. Diese Ambivalenz ist sehr typisch für den Umgang mit Leprakranken, auch Leprose genannt, im Mittelalter und in der frühen Neuzeit. Und sie spiegelt sich auch in Vorurteilen wider, mit denen die an Lepra Erkrankten konfrontiert waren. Das Spektrum reicht hier von Imaginationen himmlischer Erlösung bis hin zur Unterstellung von Sünden und Verbrechen. Der Vortrag beschreibt zunächst Ursprünge und Ausprägungen von Vorurteilen gegenüber Leprakranken beschreiben. Kann man überhaupt von „den Leprosen“ sprechen, die stets als typische Randgruppe der mittelalterlichen Gesellschaft bezeichnet werden? Oder führten Vorurteile in unterschiedlichen zeitlichen und sozialen Kontexten womöglich zur Bildung verschiedener Gruppen? Hierzu werden im zweiten Teil ausgewählte Quellenbeispiele in den Blick genommen. Sie zeigen auf, welche konkreten Auswirkungen bestehende Vorurteile in der Praxis auf die Lebenswelt von Leprakranken hatten. Background Parkinson’s disease (PD) is a neurodegenerative disorder with complex genetic architecture. Besides rare mutations in high-risk genes related to monogenic familial forms of PD, multiple variants associated with sporadic PD were discovered via association studies. Methods We studied the whole-exome sequencing data of 340 PD cases and 146 ethnically matched controls from the Parkinson’s Progression Markers Initiative (PPMI) and performed burden analysis for different rare variant classes. Disease prediction models were built based on clinical, non-clinical and genetic features, including both common and rare variants, and two machine learning methods. Results We observed a significant exome-wide burden of singleton loss-of-function variants (corrected p=0.037). Overall, no exome-wide burden of rare amino acid changing variants was detected. Finally, we built a disease prediction model combining singleton loss-of-function variants, a polygenic risk score based on common variants, and family history of PD as features and reached an area under the curve of 0.703 (95% CI 0.698 to 0.708). By incorporating a rare variant feature, our model increased the performance of the state-of-the-art classification model for the PPMI dataset, which reached an area under the curve of 0.639 based on common variants alone. Conclusion The main finding of this study is to highlight the contribution of singleton loss-of-function variants to the complex genetics of PD and that disease risk prediction models combining singleton and common variants can improve models built solely on common variants. Buildings are being demolished without taking into the account the waste generated, and the housing shortage problem is getting more critical as cities are growing and the demand for built space and the use of resources are increasing. Architectural projects have been using prefabrication and modular systems to solve these problems. However, there is an absence of structures that can be disassembled and reused when the structure’s life ran its course. This paper presents three building prototypes of new recyclable architectural typologies: (i) a Slab prototype designed as a shelf structure where wooden housing modules can be plugged in and out, (ii) a Tower prototype allowing for an easy change of layout and use of different floors and (iii) a Demountable prototype characterized by the entire demountability of the building. These typologies combine modularity, flexibility, and disassembling to address the increasing demands for multi‐use, re‐usable and resource‐efficient constructions. Design, drawings, plans, and 3D models are developed, tested and analyzed as a part of the research. The results show that the implementation of the recyclable architectural concept at the first design stage is feasible and realistic, and ensures the adaptation through time, increases life span, usability and the material reusability, while avoiding demolition, which in turn reduces the construction waste and, consequently, the CO2 emissions. Early literacy skills are critical for children’s later academic achievement. A wealth of research showed that children’s home languages should not be abandoned, as they are crucial for promoting dynamic multilingualism, assuring cross-linguistic transfer and developing identities. To explore home literacy environment and family language policy of language minority preschool children in Luxembourg, we obtained 600 parent questionnaires, tested 226 children age 4 to 6 in their home languages and Luxembourgish, and interviewed 32 families. The results from the questionnaires showed that the home resources and parent involvement influenced children’s language awareness and their print knowledge irrespective of parent’s education and their wealth. Concerning children’s competences in Luxembourgish, children with positive attitudes towards their school did better than their peers in other schools. In the interviews, parents explained that maintaining home language is important for keeping connections with family, friends and their culture. This is the language parents feel emotionally connected to and the easiest to transmit to their children. Language maintenance is mostly achieved through conversations, movies, games and books in the home languages, children’s attendance of language schools on weekends, celebrations of traditions as well as holidays in the native country of the parents. The home language is, however, not something parents enforce too strictly, as they mostly correct the children’s linguistic mistakes by simple repetition. It is often with great pride that parents report their children having an excellent proficiency in their home language. Finally, through our professional development training in translanguaging we are helping teachers to integrate children’s different home languages and cultures into the classroom and strengthen the home-school collaboration in order to support children’s well-being, learning and identities. The recent trends in the domain of wireless communications indicate severe upcoming challenges, both in terms of infrastructure as well as design of novel techniques. On the other hand, the world population keeps witnessing or hearing about new generations of mobile/wireless technologies within every half to one decade. It is certain the wireless communication systems have enabled the exchange of information without any physical cable(s), however, the dependence of the mobile devices on the power cables still persist. Each passing year unveils several critical challenges related to the increasing capacity and performance needs, power optimization at complex hardware circuitries, mobility of the users, and demand for even better energy efficiency algorithms at the wireless devices. Moreover, an additional issue is raised in the form of continuous battery drainage at these limited-power devices for sufficing their assertive demands. In this regard, optimal performance at any device is heavily constrained by either wired, or an inductive based wireless recharging of the equipment on a continuous basis. This process is very inconvenient and such a problem is foreseen to persist in future, irrespective of the wireless communication method used. Recently, a promising idea for simultaneous wireless radio-frequency (RF) transmission of information and energy came into spotlight during the last decade. This technique does not only guarantee a more flexible recharging alternative, but also ensures its co-existence with any of the existing (RF-based) or alternatively proposed methods of wireless communications, such as visible light communications (VLC) (e.g., Light Fidelity (Li-Fi)), optical communications (e.g., LASER-equipped communication systems), and far-envisioned quantum-based communication systems. In addition, this scheme is expected to cater to the needs of many current and future technologies like wearable devices, sensors used in hazardous areas, 5G and beyond, etc. This Thesis presents a detailed investigation of several interesting scenarios in this direction, specifically concerning design and optimization of such RF-based power transfer systems. The first chapter of this Thesis provides a detailed overview of the considered topic, which serves as the foundation step. The details include the highlights about its main contributions, discussion about the adopted mathematical (optimization) tools, and further refined minutiae about its organization. Following this, a detailed survey on the wireless power transmission (WPT) techniques is provided, which includes the discussion about historical developments of WPT comprising its present forms, consideration of WPT with wireless communications, and its compatibility with the existing techniques. Moreover, a review on various types of RF energy harvesting (EH) modules is incorporated, along with a brief and general overview on the system modeling, the modeling assumptions, and recent industrial considerations. Furthermore, this Thesis work has been divided into three main research topics, as follows. Firstly, the notion of simultaneous wireless information and power transmission (SWIPT) is investigated in conjunction with the cooperative systems framework consisting of single source, multiple relays and multiple users. In this context, several interesting aspects like relay selection, multi-carrier, and resource allocation are considered, along with problem formulations dealing with either maximization of throughput, maximization of harvested energy, or both. Secondly, this Thesis builds up on the idea of transmit precoder design for wireless multigroup multicasting systems in conjunction with SWIPT. Herein, the advantages of adopting separate multicasting and energy precoder designs are illustrated, where we investigate the benefits of multiple antenna transmitters by exploiting the similarities between broadcasting information and wirelessly transferring power. The proposed design does not only facilitates the SWIPT mechanism, but may also serve as a potential candidate to complement the separate waveform designing mechanism with exclusive RF signals meant for information and power transmissions, respectively. Lastly, a novel mechanism is developed to establish a relationship between the SWIPT and cache-enabled cooperative systems. In this direction, benefits of adopting the SWIPT-caching framework are illustrated, with special emphasis on an enhanced rate-energy (R-E) trade-off in contrast to the traditional SWIPT systems. The common notion in the context of SWIPT revolves around the transmission of information, and storage of power. In this vein, the proposed work investigates the system wherein both information and power can be transmitted and stored. The Thesis finally concludes with insights on the future directions and open research challenges associated with the considered framework. [less ▲]

We study the radial part of sub-Riemannian Brownian motion in the context of totally geodesic foliations. Itô's formula is proved for the radial processes associated to Riemannian distances approximating the Riemannian one. We deduce very general stochastic completeness criteria for the sub-Riemannian Brownian motion. In the context of Sasakian foliations and H-type groups, one can push the analysis further, and taking advantage of the recently proved sub-Laplacian comparison theorems one can compare the radial processes for the sub-Riemannian distance to one-dimensional model diffusions. As a geometric application, we prove Cheng's type estimates for the Dirichlet eigenvalues of the sub-Riemannian metric balls, a result which seems to be new even in the Heisenberg group. [less ▲]

We investigate the terms arising in an identity for hyperbolic surfaces proved by Luo and Tan, namely showing that they vary monotonically in terms of lengths and that they verify certain convexity properties. Using these properties, we deduce two results. As a first application, we show how to deduce a theorem of Thurston which states, in particular for closed hyperbolic surfaces, that if a simple length spectrum "dominates" another, then in fact the two surfaces are isometric. As a second application, we show how to find upper bounds on the number of pairs of pants of bounded length that only depend on the boundary length and the topology of the surface. [less ▲]

Créer les conditions de l’effectivité des libertés numériques représente à l’évidence un enjeu central pour les prochaines années.
