The twelfth volume of the Critical Spatial Practice series focuses on “Don’t Follow the Wind,” the acclaimed collaborative project situated in the radioactive Fukushima exclusion zone. The book explores the long-term environmental crisis in the coastal Japanese region through this ongoing, inaccessible exhibition, which maintains traces of human presence amid the fallout of the March 2011 nuclear reactor meltdown that displaced entire towns. What can art do in a continuing catastrophe when destruction and contamination have made living impossible? The exhibition is located inside the exclusion zone, an evacuated radioactive area established after the nuclear disaster that forcibly separated residents from their homes, land, and community. In cooperation with former residents, participating artists installed newly commissioned works at sites in the exclusion zone. Although the exhibition opened in March 2015, the zone is still inaccessible to the public—the exhibition, like the radiation, is virtually invisible. The exhibition can only be viewed when restrictions are lifted and people are permitted to return. This might take several years or decades—a period that could extend beyond our lifetime. While nuclear contamination has displaced and ruptured communities, new temporary and translocal formations have emerged among the residents who have lent their sites, other former residents collaborating on the project, and the artists, curators, and cultural workers. This book includes new texts by feminist theorist Silvia Federici, art historians Noi Sawaragi and Sven Lütticken, and political philosopher Jodi Dean. The project was codeveloped and curated by the collective Don’t Follow the Wind , whose members include Chim↑Pom, Kenji Kubota, Eva & Franco Mattes, and Jason Waite. By acknowledging the flexible and complex nature of the precautionary principle under EU law and by referring to methodological pluralism, the goal of this book is to provide a polycentric interpretation of this principle based on diversity rather than uniformity. The polycentric interpretation is anchored in the construction of the conceptual network of the precautionary principle. This allows for the unitas multiplex between the different definitions and applications of this principle to be identified and assessed. The core claim of the book is that the polycentric interpretation of the precautionary principle can be built on two concepts: anticipation and action that represent the two main knots of its conceptual network. These knots are not isolated, but they are connected via some links to other knots that constitute the main concepts allowing identifying and applying the precautionary principle under EU law. The volume presents the results of a research project (named “Legafight”) funded by the Luxembourg Fond National de la Recherche in order to verify if and how digital tracing applications could be implemented in the Grand-Duchy in order to counter and abate the Covid-19 pandemic. This inevitably brought to a deep comparative overview of the various existing various models, starting from that of the European Union and those put into practice by Belgium, France, Germany and Italy, with attention also to some Anglo-Saxon approaches (the UK and Australia). Not surprisingly the main issue which had to be tackled was that of the protection of the personal data collected through the tracing applications, their use by public health authorities and the trust laid in tracing procedures by citizens. Over the last 18 months tracing apps have registered a rise, a fall, and a sudden rebirth as mediums devoted not so much to collect data, but rather to distribute real time information which should allow informed decisions and be used as repositories of health certifications. The impact of EU law on the Member States depends decisively on the application by national judges of principles and rules elaborated by the EU Court of Justice in response to the preliminary ruling references made by the national judges themselves. Therefore the good functioning of the complex system resulting from the interaction between the EU legal order and the Member States implies a constructive relationship between the Court of Justice and the national judges. With this premise, the volume aims to face the di culties experienced in the ‘dialogue’ between all national courts (on the merits, supreme, constitutional) and the EU Court of Justice. To this purpose the national judges themselves are called to express their opinions: they were requested to illustrate, from their experience, the drawbacks encountered in the communication with the CJEU. Le Règlement 655/2014 a établi une Ordonnance européenne de saisie conservatoire (OESC) des comptes bancaires permettant aux juges des Etats membres d’ordonner la saisie de comptes bancaires situés dans d’autres Etats membres et, le cas échéant, de rechercher des informations permettant d’identifier l’existence de comptes bancaires dans d’autres Etats. Entrée en vigueur depuis 2017, cette procédure européenne, quoique uniforme, n’est pas complète et nécessite une application coordonnée des dispositions du Règlement avec les règles nationales applicables aux institutions équivalentes des Etats membres (saisie conservatoire, saisie-arrêt). L’ouvrage propose un commentaire systématique des dispositions du Règlement et une analyse des problèmes de mise en œuvre qu’il soulève, en particulier dans le cadre de leur coordination avec les dispositions de droit national. The visual turn recovers new pasts. With a focus on education, this book seeks to present a body of reflections that question a certain historicism. It renovates historiographical debate about how to conceptualize visual media while presenting new themes and methods for researchers. Images are interrogated as part of régimes of the visible, of a history of visual technologies and visual practices. Considering the socio-material quality of the image, the analysis moves away from the use of images as mere illustrations of written arguments, and seriously questions the life and death of artifacts – that is, their particular historicity. Questioning the visual and material evidence in this ways means considering how, when, and in which régime of the visible it has come to be considered as a source, and what this means for the questions contemporary researchers may ask. Par le passé les conduites humaines ont été étudiées selon une approche générale ou une approche différentielle donnant lieu à des courants séparés de la psychologie, les modèles comportementaux laissent, aujourd’hui, une place de plus en plus importante aux variations inter et intra-individuelles. La psychologie différentielle longtemps restreinte à l’étude de champs particuliers, comme celui des méthodes par exemple, bénéficie de ce nouveau paradigme et participe activement à cette évolution conceptuelle. En parallèle, ses thématiques de recherche se voient modifiées par la prise en compte des intérêts des autres disciplines avec lesquelles elle collabore. Dès lors, elle aborde, comme ses précurseurs l’avaient définie, des champs plus en lien avec les évolutions sociétales actuelles : éducation différenciée, formation tout-au-long de la vie, orientation, sélection des personnes ou ressources humaines. De plus, les avancées techniques et technologiques lui permettent de faire évoluer ses outils d’investigation et de diagnostic, sur lesquels elle s’est, depuis son origine, arcboutée et qui sont actuellement le testing assisté par ordinateur, le testing adaptatif, l’intelligence artificielle ou les interfaces homme-machine. Enfin, par la prise en compte des théories et des méthodes de sciences émergentes (sciences cognitives et neurosciences), elle se dote de nouveaux moyens d’analyse des différences individuelles. Ainsi une certaine mutation de la psychologie différentielle s’observe au travers de différents travaux récents initiés au sein de cette discipline et que le présent ouvrage Recherches actuelles en psychologie différentielle tente de mettre en lumière. En effet, ce recueil, composé des synthèses de certaines communications orales et affichées présentées lors des XXIIIème Journées de Psychologie Différentielle (Luxembourg, 2018) se veut, sans être exhaustif, le reflet de certaines voies nouvelles de ce domaine scientifique et souhaite ainsi donner une image nouvelle et actuelle de la psychologie différentielle, des réalisations et perspectives de recherche de cette discipline. Marked by expanding and diverse forms of collaboration and competition, the investigation of contemporary developments in higher education and science systems need additional attention. Therefore, this research topic provides a forum for multidisciplinary exchange of pioneering research ideas and dialogues as well as complementary research that contribute to the field of knowledge, and aspires to support innovative, cutting-edge, and policy relevant research at the nexus of higher education research and science studies (HERSS), bibliometrics, scientometrics, and computational social sciences –traditionally separate communities focusing either on small scale and in-depth case studies or on large-scale “big data” research. Researchers bringing together the aforementioned scientific communities can be classified as important bridge-builders to bolster the growing research and current initiatives in the field of Science of Science between diverse scientific communities and the wider public. Especially sociology with its ambition to pair classic and innovative theoretical approaches with new methods to analyze and to qualitatively interpret quantitative “big data” with machine learning algorithms initiates a fascinating and promising approach to interlink the still separate scientific communities in favor of a more holistic understanding of Science of Science. In this Research Topic -as part of the Lecture Series: Science of Science in the Spotlight at the University of Luxembourg- we invite members of these diverse scientific communities and researchers who are working at the intersection as “translators” to present their latest research. We aim to promote and provide evidence-based insights into the drivers of multidisciplinary and international research and innovation, networks, and collaboration, including higher education developments, scientific knowledge production (e.g. publications, citations, patents), science capacity-building, research evaluation, policy reforms, cultural and societal change processes, and institutions and organizations as well as scientists’ geographical mobility, gender inequalities and career paths in science, and of migrant scientists. Furthermore, we want to stimulate debate on theoretical in-depth context knowledge and innovative methodological approaches (for example social network analysis and machine learning algorithms), and on data acquisition and analysis -long identified as an important research gap in Science of Science. The aim of this research topic is to consolidate common themes and research interests to maintain and improve collaborations among researchers with different academic backgrounds and expertise from a wide range of disciplines. The BENELUX and the Nordic Council both offer longstanding models of regional cooperation which have, in various ways, often been cited as examples for the wider European integration project. More recently, both the Visegrád and Baltic states have seen the (re-) emergence of forms of regional cooperation in connection with their accession to and later membership of the European Union. Yet, though often cited, these experiences of (sub-)regional cooperation within the wider European project have been the object of relatively little systematic or comparative study. The aim of the edited volume is to address this gap by bringing together specialists on these regional groupings with a view to providing a fuller understanding of both their historical significance and their possible future role relative to a potentially fragmenting European political landscape. After World War II, as Europe floundered economically, British Prime Minister Clement Attlee looked to disengage Britain from some of its broad international obligations and increase American support for its new foreign agenda. One place he sought to do so was in Greece, which was in the midst of a civil war. Through an in-depth study of Anglo-American diplomacy in Greece from 1946-50, Spero Simeon Z. Paravantes reveals how the relationship between Britain and the US developed in this formative period. He argues that, in many ways, Britain used the fast-escalating tensions of (what would become) the Cold War to direct and manipulate US policy in Greece, encouraging the Americans to take a more active role and (essentially) take Britain's place in the region. In the process, he sheds fresh light onto how the American experience in Greece contributed to the formulation of the Truman Doctrine, the infamous NSC-68 document and the ultimate birth of the Cold War. This work covers the challenges of excise duty collection from tobacco products and nicotine-containing products, driven by the tobacco market development. It also studies the in-depth theoretical basis of excise taxation of heated tobacco products and e-cigarettes in the context of achieving fiscal and regulatory goals. It describes the types and general approaches to the classification of novel tobacco products and nicotine-containing products. This research determines the tendencies and features of excise duty collection from heated tobacco products and e-cigarettes in EU countries in terms of broader distribution of these products on national markets. It describes specific aspects of the tobacco products excise policy in Moldova and Georgia. It also analyzes the specifics of the transformation of domestic tobacco products market due to the high excise duty burden carried by these products. The work also proposes ways of improving excise taxation of heated tobacco products and e-cigarettes in Ukraine to pump up the budget and regulate the tobacco market development. The survey findings can be useful to the state agencies and a broad range of other stakeholders when developing proposals regarding the formation and implementation of the excise policy for tobacco products and alternatives [less ▲]

The broad representation of the migration flows between the two countries is illustrated with a lot of data and facts and with numerous, often previously unpublished documents and pictures. A large number of individual and family fates are described, which can be traced to this day in the Luxembourg population. It is the first comprehensive publication on this subject. The book is based on several years of research carried out within the framework of the Center for Contemporary and Digital History of the University of Luxembourg (C2DH). Thanks to her language skills, the author was able to use Russian archives and gain new insights into, among other things, the history of the Luxembourg conscripts in Tambov. She also made contact with descendants of the emigrants in Luxembourg and discussed their history in numerous conversations, which are reflected in the book. BU represents one of the most important developments in European integration since the launch of Monetary Union. Furthermore, the design of the BU agreed between 2012 and 2014 was a messy compromise among EU member states. It is not surprising then that BU has sparked a lively academic debate and triggered an ever-growing number of publications from different disciplinary backgrounds. The first wave of academic work on BU focuses upon the economic rationale underpinning the supranationalisation of control over banking — regulation, supervision, support and resolution — and the political dynamics and legal issues that shaped the design of the Union agreed. This volume is located at the intersection of this first phase of academic research and a second stage which analyses the functioning of the different elements of BU. New research questions are triggered by the albeit limited empirical evidence on BU’s implementation and operation. From complex multi-players to casual gaming: video games are the most common virtual environment for entertainment that younger generations spend a significant time in. Although early game titles already featured morality-related topics, implementing meaningful eudaimonic playing based on moral decision making has become increasingly popular. Unfortunately, scientific analyses of game-related moral decisions mostly revolve around the effects of players engaging in virtual violence, leading to ongoing heated debates in academia and the general public (e.g., Anderson et al., 2010; Ferguson, 2007). To date, however, only few studies have tried to disentangle the moral aspects of video games from virtual violence (e.g., Joeckel, Bowman, & Dogruel, 2012). The present chapter provides an overview on both established and novel theories on psychological processing of moral decision making in virtual worlds in line with cutting-edge game examples. These theories aim at explaining how games can elicit moral processing as well as the factors that modulate these processes once the player is morally engaged. Based on i.a. aspects of the theory of presence (Biocca, Harms, & Burgoon, 2003; Tamborini & Skalski, 2006), moral disengagement (Bandura, 2002; Hartmann & Vorderer, 2010) and a dual process model of moral judgement (Greene, Sommerville, Nystrom, Darley, & Cohen, 2001; Gubbins & Byrne, 2014; Haidt, 2001), a new model is proposed. Furthermore, individual characteristics such as playing experience, player motivation and moral salience according to the moral foundations theory (Haidt & Joseph, 2008; Tamborini, 2011) are integrated in the model. Para-Platforms investigates the social, spatial, and material reality of right-wing populism. Three case studies—presented in a symposium organized by Markus Miessen at the Gothenburg Design Festival in November 2017—form the core of this collection of essays: journalist Hannes Grassegger on Trump and Brexit; architectural theorist Stephan Trüby on spaces of right-wing extremism in Germany; and Christina Varvia on Forensic Architecture’s investigation of the murder of Halit Yozgat, a young German man of Turkish descent, at the hands of a far-right group in 2006. The presentations are reproduced along with the ensuing conversations with Miessen and the audience members. An essay by design scholar Mahmoud Keshavarz opening the book discusses the capacity of design to create conditions for certain politics to occur. In November 2017, Council Regulation (EU) 2017/1939 implementing enhanced cooperation on the establishment of the European Public Prosecutor’s Office (‘EPPO’) entered into force. The EPPO is a new body of the European Union that will investigate and prosecute perpetrators of criminal offences affecting the financial interests of the Union. Being the first EU authority to exercise direct powers vis-à-vis individuals in the field of criminal law, the EPPO represents a paradigm shift in the EU criminal justice field and requires several amendments of national legislation. The Member States that take part in the EPPO enhanced cooperation are currently in the process of implementing the Regulation in order to make their criminal justice systems compatible with its provisions, and allow the EPPO to carry out its activities once the Office will be up and running. Building on the Symposium that took place in Coimbra on 29–30 March 2017, which was co-organised by the European Criminal Law Academic Network (ECLAN) and the Instituto Jurídico of the Law Faculty of the University of Coimbra, this book offers a comprehensive overview of crucial aspects of this ambitious and debated EU initiative, in both its European and national dimensions. It aims to analyse key issues related to the functioning and legitimacy of the EPPO from a European perspective, such as EPPO independence and material competence, judicial review of its acts, and protection of fundamental rights in the framework of EPPO proceedings. At the same time, it also represents the first publication that, in the wake of the Regulation’s adoption, discusses the challenges that the implementation of this EU legal instrument is currently raising in some Member States, namely Austria, Finland, Germany, Lithuania, Luxembourg, and the Netherlands. Les différents chapitres de ce livre proposent une approche holistique pour faire évoluer le système de santé vers le partenariat de soins. Résultat de trois années de recherche et de concertation, le Livre Blanc s’appuie sur des recherches documentaires (analyse de la littérature scientifique et de la législation spécifique de chaque pays), des entretiens et des enquêtes auprès de nombreux acteurs, le repérage et l’analyse d’initiatives en GR et la discussion orientée vers le consensus. Par ailleurs, les propositions de recommandations ont été élaborées et discutées lors d’un séminaire interrégional réalisé en décembre 2019. Le Livre Blanc est structuré en 5 parties qui s’adressent chacune à un public ciblé. La première partie situe le contexte dans lequel s’est réalisé le projet et décrit la méthodologie du programme. La seconde partie est consacrée aux aspects réglementaires de l’approche patient partenaire et à leurs conséquences sur les pratiques et les initiatives analysées sur le terrain. Elle est destinée de manière privilégiée aux mandataires politiques. La troisième partie propose une réflexion sur le développement de stratégies de partenariat au niveau des institutions de santé. Elle concerne les gestionnaires des établissements de santé. La quatrième partie vise à amener les professionnels à s’interroger sur ce que le partenariat de soins peut leur apporter dans leurs pratiques de soins. Elle s’adresse, en particulier, aux acteurs en contact direct avec les patients. La cinquième et dernière partie suggère différentes voies possibles de développement de l’APPS dans les domaines de l’enseignement et de la recherche. Toutes ces parties s’adressent bien évidemment au patient, qui est au coeur de l’APPS. Les prises de position proposées par ce Livre Blanc s’appuient sur les données collectées par le consortium de recherche de 2017 à 2020. Dès lors, ce document ne peut être exhaustif et est appelé à évoluer, basé davantage sur une fonction vectrice de normes que de règles. Can the rules of the European Union’s E-Commerce Directive, which date back to the year 2000, continue to be valid with regard to the dissemination of content in view of the constantly evolving online environment and the changing role of platforms as a result of new business models? The relevant legal foundations in this respect at EU and national level are complex, and their interplay is often unclear. The resulting uncertainty about who is responsible and therefore liable for certain content requires a critical review of the current legal framework. This study, conducted by the Institute of European Media Law (EMR) on behalf of the State Media Authority NRW, analyses the current legal framework and reveals ways of enforcing the applicable provisions concerning illegal content. It pays special attention to the need for reform of the E-Commerce Directive in light of the changing role of platforms. [less ▲]

Ce premier volume est consacré à la détermination de la loi applicable et expose la théorie générale du conflit de lois ainsi que les solutions particulières concernant les obligations (contrats, délits, régime gé-néral de l’obligation), les biens (corporels et incorporels) et les sociétés (y compris en cas d’insolvabilité).A l’instar du droit des autres Etats membres, le droit international privé luxembourgeois est dominé par des sources d’origines européenne et internationale. Sa spécificité demeure forte, cependant, car le Luxembourg a ratifié des conven-tions internationales différentes de ses grands voisins francophones et adopté des normes nationales qui s’inspirent de plu-sieurs expériences juridiques étrangères, mais peuvent aussi être originales. Sans négliger la jurisprudence européenne, l’ouvrage tente enfin de rassembler la ju-risprudence des juridictions luxembour-geoises en la matière qui, à nouveau, si elle s’inspire le plus souvent de la jurisprudence française, s’en écarte parfois. La proportionnalité a progressivement pris une place centrale dans l’imaginaire juridique. Initialement conçue comme un principe régissant l’utilisation des pouvoirs de police, elle est aujourd’hui considérée comme un outil avancé de science constitutionnelle. Sa généralisation, accompagnée par le paradigme du droit constitutionnel global, est perçue comme irrésistible et naturelle. Cette recherche a été guidée par l’intuition que, même si les juristes à travers le monde raisonnent de plus en plus en termes de proportionnalité, celle-ci peut avoir des sens très différents, et ce, même au sein d’un seul système juridique. Les différentes utilisations du langage de la proportionnalité sont rarement étudiées en tant que telles. Pour autant, l’identification des sens locaux de la proportionnalité est cruciale si l’on veut comprendre sa propagation, apprécier son succès et évaluer les possibilités de convergence entre systèmes juridiques. Ce travail consiste en une étude approfondie et comparative de l’utilisation du langage de la proportionnalité parmi les acteurs juridiques en France, en Angleterre et en Grèce. Il cherche à montrer que les sens locaux de la proportionnalité ne sont pas simplement des applications imparfaites d’un modèle global. Au contraire, ils reflètent les cultures au sein desquelles ils évoluent, des chemins d’évolution culturelle propres à chaque système et des trajectoires locales d’européanisation. [less ▲]

This book follows this development and strengthens a perspective that is interested in life realities and that focuses on everyday cultural experiences of borders. Border research has undergone profound changes in the last few decades, which has changed the study of national borders as unchallenged phenomena. This reorientation is based on constructivist approaches and queries the processes of establishing, relativising, shifting or overcoming borders. It was based on this conception of borders as social constructions that in 2019 Florian Weber (Saarland University), Christian Wille (University of Luxembourg), Beate Caesar (TU Kaiserslautern) and Julian Hollstegge (University of Bayreuth) launched their book project "Geographien der Grenzen" (Geographies of Borders). The anthology, which was published in 2020 discusses the connection between spaces, orders and interdependencies. The authors from the spatial, social sciences and cultural studies choose different approaches to borders and analyze their (re)production processes as “geographies of borders”. By doing so, they also focus on borders other than nation-state borders, such as city-country hybrid differentiations. The volume therefore examines from various theoretical and thematic perspectives the question of how and which “geographies of border” can be (re)constructed in the interplay of various destabilizations and (re)stabilizations of borders.
