Annotated Legal Documents on Islam in Luxembourg consist of an annotated book of currently valid legal documents affecting the status of Islam and Muslims in Luxembourg. By legal documents are meant the texts of legislation, including relevant secondary legislation, as well as significant court decisions. Each legal text will be preceded by an introduction describing the historical, political and legal circumstances of its adoption, plus a short paragraph summarising its content. The legal texts will be published in the original language while the annotations and supporting material will be in English. The focus of the book is on the religious dimensions of being Muslim in Luxembourg, i.e. on individuals' access to practise their religious obligations and on the ability to organise and manifest their religious life. It's a part of a project will cover the 28 member states of the European Union (including Croatia), Norway and Switzerland plus the European Union and the European Court of Justice. [less ▲]

Inclusive education has become a leading theme internationally over the past several decades, as it addresses key issues, often controversial, of exclusion/inclusion, learning opportunities, and educational equality and justice. Among international organizations as well as supranational governments, we find an increasing emphasis on recognizing diversity and enabling education for all. This is visible in the Salamanca Declaration (1994), the overall “education-for-all” agenda, the Sustainable Developments Goals (e.g., Education, SDG 4), and the worldwide ratification of the UN Convention on the Rights of People with Disabilities (e.g., Article 24 on Education), which mandates among state parties the establishment of an inclusive education system across levels, from early childhood to lifelong learning. This frame of reference is not only significant in terms of definitions and contents but also in the context of the strengthening of world society. The world societal level is not the same as what occurs in the relations between nation states, as important as such learning in policies and practices may be but extends beyond. This is evident in the definition of “inclusion” that has become significant internationally as a category signifying attempts to guarantee access and participation in different levels of education systems, but one that has contrasting and divergent understandings, implications, and implementation consequences between national and local contexts. The goal of participation that follows normatively and legally from such understandings of inclusion, is recontextualized differently, sometimes even paradoxically, when in fact segregated and separate settings are extended under the banner of inclusion. In Germany, for example, despite inclusion discourse flowing from such international agendas that focus on processes of integration and participation, the structures, cultures, and practices that disadvantage and disable continue to exist or even become strengthened. Even if the myriad dimensions of diversity are increasingly discussed and intersectional approaches become more important, the emphasis on difference of disability or “special educational needs” continues. In educational research, numerous publications have delineated the establishment of inclusive education from diverse perspectives. Over the past decade in particular, this has occurred in relation to the UN CRPD, which also implies a connection to the world society-frame; however, theorization and in-depth empirical analyses are lacking to explain more recent developments on multiple levels. Even for nation-states, few systematic and comparative studies have analyzed the diverse forms of inclusive education in different contexts. The consequence has been a divergence between the national discourses of inclusive education, for example, in the German-speaking countries, that remain focused on special educational needs, and the more global discourse that understands inclusive education in human rights terms and a key developmental process in democracies. Although some recent comparative research projects and dissertations provide insights into specific country contexts, a more comprehensive publication that collects such research results of international inclusive educational research has been lacking. Furthermore, the opportunity presents itself to extend the dialogue through a world society perspective on inclusion to reflect global inequalities via integrating case studies from the Global South. International and intercultural perspectives enable the investigation of structures, cultures and practices of different countries to the crucial comparison of educational processes. This is especially necessary in the case of inclusive education, whether as a source of inspiration, a reflexive critique of taken-for-grantedness or as a means to identify disparities and social inequalities. Thus, in several dozen chapters, the Handbook Inclusion International presents diverse global, national, and local perspectives on inclusive education. [less ▲]

The legal sector is being hit by profound economic and technological changes (digitalization, open data, blockchain, artificial intelligence ...) forcing law firms and legal departments to become ever more creative in order to demonstrate their added value. To help lawyers meet this challenge, this book draws on the perspectives of lawyers and creative specialists to analyze the concept and life cycle of legal innovations, techniques and services, whether related to legislation, legal engineering, legal services, or legal strategies, as well as the role of law as a source of creativity and interdisciplinary collaboration. This book provides a concise, practical guide to the European Union’s Anti-Tax Avoidance Directive (ATAD). Presenting unique insights into the ATAD’s five specific anti-avoidance rules, its chapters explain the background of those rules, the directive’s interactions with relevant jurisprudence, and the challenges posed to the ATAD’s interpretation and implementation in domestic law. Key features include: • critical, article-by-article analysis of the ATAD • contextual information on the legislative environment in which the ATAD operates, embedding it in the wider landscape of CJEU jurisprudence • insights into the day-to-day application of the ATAD rules in practice • contributions from leading academics and practitioners in the field of tax law • examples of the challenges to the interpretation and implementation of ATAD, taken from a range of EU Member States. European and international tax advisors, along with policy makers in the field of tax law, will find this book to be a comprehensive yet accessible guide to the ATAD and its correct application. Those who carry out research in European tax law can also benefit from this book’s critical approach to the ATAD and the questions that surround anti-tax avoidance legislation in the European Union. The volume brings together the work of sixteen scholars focused on the diverse debates surrounding the construction and operation of Banking Union (BU), and its necessary reform. BU represents one of the most important developments in European integration since the launch of Monetary Union. Furthermore, the design of the BU agreed between 2012 and 2014 was a messy compromise among EU member states. It is not surprising then that BU has sparked a lively academic debate and triggered an ever-growing number of publications from different disciplinary backgrounds. The first wave of academic work on BU focuses upon the economic rationale underpinning the supranationalisation of control over banking — regulation, supervision, support and resolution — and the political dynamics and legal issues that shaped the design of the Union agreed. This volume is located at the intersection of this first phase of academic research and a second stage which analyses the functioning of the different elements of BU. New research questions are triggered by the albeit limited empirical evidence on BU’s implementation and operation. Contributions to this second wave of research attempt to identify potentially dangerous lacunae and contribute to on-going reform debates. [less ▲]

This volume analyses Belgian garrisons in the Rhineland and Westphalia after the Second World War. They are analysed as contact zones that clearly indicate the political, economic, societal and military consequences of European integration for daily coexistence. The book’s contributions focus on mechanisms and catalysts of entanglement, dissolution and coexistence in local spaces, which did not relocate transnational contacts within Europe to national borderlines, but permanently (re-) configured them in a confined space. How do transnational contacts take place? How have they changed in the face of different geopolitical and geostrategic circumstances? This volume intends to give European integration history new impetus by rediscovering European regional history. [less ▲]

For a decade now, borders in Europe have been back on the political agenda. Border research has responded and is breaking new ground in thinking about and exploring borders. This book follows this development and strengthens a perspective that is interested in life realities and that focuses on everyday cultural experiences of borders. The authors reconstruct such experiences in the context of different forms of migration and mobility as well as language contact situations and are sensitive to the freedom of the participants. In this way, they empirically identify everyday cultural usage or appropriation strategies of borders as vastly different experiences of borders. The readers of this volume will gain insights into current developments in border research and life realities in Europe where borders are (made) relevant. In November 2017, Council Regulation (EU) 2017/1939 implementing enhanced cooperation on the establishment of the European Public Prosecutor’s Office (‘EPPO’) entered into force. The EPPO is a new body of the European Union that will investigate and prosecute perpetrators of criminal offences affecting the financial interests of the Union. Being the first EU authority to exercise direct powers vis-à-vis individuals in the field of criminal law, the EPPO represents a paradigm shift in the EU criminal justice field and requires several amendments of national legislation. The Member States that take part in the EPPO enhanced cooperation are currently in the process of implementing the Regulation in order to make their criminal justice systems compatible with its provisions, and allow the EPPO to carry out its activities once the Office will be up and running. Building on the Symposium that took place in Coimbra on 29–30 March 2017, which was co-organised by the European Criminal Law Academic Network (ECLAN) and the Instituto Jurídico of the Law Faculty of the University of Coimbra, this book offers a comprehensive overview of crucial aspects of this ambitious and debated EU initiative, in both its European and national dimensions. It aims to analyse key issues related to the functioning and legitimacy of the EPPO from a European perspective, such as EPPO independence and material competence, judicial review of its acts, and protection of fundamental rights in the framework of EPPO proceedings. At the same time, it also represents the first publication that, in the wake of the Regulation’s adoption, discusses the challenges that the implementation of this EU legal instrument is currently raising in some Member States, namely Austria, Finland, Germany, Lithuania, Luxembourg, and the Netherlands.

[less ▲]

This collection of essays celebrates the 70th birthday of Professor Roland Naul. The chapters, written by colleagues and friends, illustrate the development of sport and physical activity research over four decades. They give an overview and update of relevant fields that determined the academic work of Roland Naul and new insights. Chapters have been grouped under the following aspects: Roland Naul as Schola Ludens Europaea, with a focus on his special fields of interest and research; general education and sport education including the relationship between sport pedagogy and social pedagogy; old and new challenges for the Olympic Games movement, as described from the perspective of different countries; health-enhancing physical activity (HEPA), a key policy area which Roland Naul has helped shape in the European Union; and finally, sport policy on a local level. This commemorative publication acknowledges the merits of Roland Naul for European studies in physical education and youth sports, as well as for the sport policy context in Europe. [less ▲]

Im Fokus stehen u.a. [less ▲]

The 50th anniversary of the death in 1967 of the famous music teacher, ethnomusicologist and composer Zoltán Kodály reminded us that another renowned music pedagogue, Leo Kestenberg (1882-1962), was born in the same year as Kodály. As such, the joint Kodály Kestenberg Conference provided a welcome opportunity not only to address aspects of music pedagogical and biographical research which had hitherto received a limited amount of attention, but also to highlight a number of key moments in history, and the resulting impact these had had on music pedagogy. The significant level of international interest which music educators showed in the Kodály Kestenberg Conference fulfilled the organisers' desire to create a forum for the free exchange ideas. It also enabled participants to review our commonalities and differences and to look beyond our individual national developments and evaluate the methods and concepts of two significant personalities in the history of musical education in the first half of the 20th century. The sheer diversity of historical and current topics in music education research both inside and outside of Europe, not only reflects the fact that in the 21st century, music education research has established and profiled itself in a wide range of sub-disciplines in addition to revealing new fields of inter-disciplinary research. The effectiveness of reforms initiated and implemented by Kodály and Kestenberg extend to the present day and continue to influence discussions around the future perspectives of music education. This is illustrated by the example of formal and informal learning in the field of elementary music pedagogy. The "Century of the Child" proclaimed in 1900 by the Swedish reform pedagogue Ellen Key (1849–1926) has left its mark on music education through reformers such as Kodály and Kestenberg into the 21st century. This conference book contains articles which are subdivided in five sub-categories: (1) The function of Music Education, (2) The Historical Era of Kodály and Kestenberg, (3) Learning and Instruction, (4) Assessment Technologies in Music Education and (5) Effects of Music Training. The contributors come from six different countries namely, Austria, England, Germany, Hungary, Israel and Luxembourg. The editors would like to record their thanks to both: (1) the Pedagogical Faculty of the John von Neumann University, Kecskemét and the dean Dr. Fülöp Tamás and the vice-dean Dr. Sági Norberta for hosting the conference, (2) the International Leo Kestenberg Society. The editors also acknowledge that this research is supported by EFOP-3.6.1- 16-2016-00006 “The development and enhancement of the research potential at John von Neumann University” project. The Project is supported by the Hungarian Government and co-financed by the European Social Fund. The editors finally thank Ms. Caroline Reuter from the University of Luxembourg for the review of the layout. [less ▲]

Time is a crucial dimension in the application of any law. In tax law, however, where an environment characterized by rapid change on the national, European, and international levels complicates the provision of accurate legal advice, timing is particularly sensitive. This book is the first to analyse the relationship between time and three key areas of tax: treaties, EU law, and constitutional law issues, such as legal certainty and individual rights. The issues arising from the interplay of these various areas are analysed from a both academic and practical angle, providing important insights independent of the concrete national framework within which tax rules are applied. This volume contains the papers presented at the 42nd German Conference on Artificial Intelligence (KI 2019), held during September 23–26, 2019, in Kassel, Germany. The German conference on Artificial Intelligence (abbreviated KI for “Künstliche Intelligenz”) has developed from a series of inofficial meetings and workshops, organized by the German “Gesellschaft für Informatik” (association for computer science, GI), into an annual conference series dedicated to research on theory and applications of intelligent system technology. While KI is primarily attended by researchers from Germany and neighboring countries, it warmly welcomes international participation. The KI 2019 conference took place in Kassel, Germany, September 23–26, 2019, and it was held in conjunction with the 49th Annual Conference of the German Computer Science Association (INFORMATIK 2019). Information about the event can be found at www.ki2019.de and informatik2019.de, respectively. KI 2019 had a special focus theme on “AI methods for Argumentation” and we especially invited contributions that use methods from all areas of AI to understand, formalize, or generate argument structures in natural language. The special focus theme was organized in cooperation with the DFG funded priority program “RATIO: Robust Argumentation Machines”. Besides this special focus theme, the conference invited original research papers and shorter technical communications on all topics of AI. Further, we asked for the submission of extended abstracts summarizing papers that had recently been presented at major AI conferences. KI 2019 received 82 submissions, with authors from 25 countries. Submissions were – except for some special cases – reviewed by three Program Committee members. The Program Committee, comprised of 51 experts from 9 countries, decided to accept 29 papers. Out of these, 16 submissions were accepted as full papers, 10 as short papers and 3 as extended abstracts. The program also included three invited talks: – Jürgen Altmann (University of Dortmund): Autonomous Weapon Systems – Dangers and Need for an International Prohibition – Michael Beetz (University of Bremen): Digital Twin Knowledge Bases – Knowledge Representation and Reasoning for Robotic Agent – Antony Hunter (University College London): Towards Computational Persuasion for Behaviour Change Applications Two of these presentations are summarized in papers contained in this volume. Overall, it was a pleasure to organize KI 2019 and we are grateful to our co-organizers, Alexander Steen (Workshops and Tutorials Chair) and Kristina Yordanova (Doctoral Consortium Chair), who provided valuable additional support in organizing the event. We thank the Program Committee members and all additional reviewers for the effort and time they invested in the reviewing process. Further, we thank the Organizing Committee of INFORMATIK 2019 who took care of finances and local organization and allowed us to focus on the scientific aspects of the conference. Our appreciation also goes to the developers of EasyChair, which provides great functionalities that helped to organize the reviewing process and to create this volume. Last but not least, we would like to thank SAP SE for generously sponsoring travel grants for students to attend KI 2019. July 2019 Christoph Benzmüller Heiner Stuckenschmidt [less ▲]

The socio-discursive landscape surrounding the migration debate is characterised by a growing sense of crisis in both personal and collective identities. From this viewpoint, discourses about immigration are also always attempts at reconstructing the threatened ‘home identity’ of the respective host society. It is such attempts at reasserting identity-in-crisis (due to migration) that are the focus of the volume Migration and Media: Discourses about identities in crisis. This four-part book explores the representational strategies used to frame current migration debates as crises of identity, collective and individual. It features fourteen case-studies of varying sets of data including print media texts, TV broadcasts, online forums, politicians’ speeches, legal and administrative texts, and oral narratives, drawn from discourses in a range of languages – Croatian, English, French, German, Greek, Italian, Lithuanian, Polish, Russian, Serbian, Slovenian, Spanish, and Ukrainian – , and it employs different discourse-analytical methods, such as Argumentation and Metaphor Analysis, Gendered Language Studies, Corpus-assisted Semantics and Pragmatics, and Proximization Theory. Such a diverse range of sources, languages, and approaches provides innovative methodological and theoretical analysis on migration and identity which will be of interest to scholars, students, and policy makers working in the fields of migration studies, media studies, identity studies, and social and public policy. In the aftermath of the financial crisis, the individual liability of senior managers has been rediscovered as an important element in effectively countering economic and financial crime. Mainstream enforcement practices against white-collar crime in recent years, focusing mostly on the legal entity or the low- and mid-level employees, have been largely unsuccessful. The punishment of large corporations for economic offences has indeed been confronted with the “too big to jail” dilemma, and with concerns for the negative spillovers that their collapse may entail for employees, shareholders and consumers. The individual “rogue employee”, on the other hand, may be fungible and easily sacrificed as a scapegoat. The recent debate has therefore brought back to centre-stage the individual liability of senior managers, which is essential to close any “responsibility gap”. But are the ordinary rules of criminal law fit and adequate to hold senior managers accountable? This volume, presenting the findings of a study led by the University of Luxembourg and co-financed by the European Anti-Fraud Office (OLAF), aims to contribute to this debate with a special focus on the liability of senior managers for the commission of offences against the financial interests of the EU. It compares the criminal liability regimes for senior managers in five Member States (Finland, France, Germany, The Netherlands and Poland) and delivers a set of policy recommendations for establishing the liability of senior managers in compliance with the general principles of criminal law and respect for fundamental rights. Ubi servi erant?

Fabricating Modern Societies: Education, Bodies, and Minds in the Age of Steel, edited by Karin Priem and Frederik Herman, offers new interdisciplinary and transnational perspectives on the history of industrialization and societal transformation in early-twentieth-century Luxembourg. The individual chapters focus on how industrialists addressed a large array of challenges related to industrialization, borrowing and mixing ideas originating in domains such as corporate identity formation, mediatization, scientification, technological innovation, mechanization, capitalism, mass production, medicalization, educationalization, artistic production, and social utopia, while competing with other interest groups who pursued their own goals. The book looks at different focus areas of modernity, and analyzes how humans created, mediated, and interacted with the technospheres of modern societies. [less ▲]

In recent years, half of the newly constructed building floor areas in the world are built in China, thus it is important and interesting to know the Chinese design codes for buildings and compare them with Eurocodes, which are one of the most advanced design codes in the world. Funded by “Erasmus+ Strategic Partnerships” the project “AVEC BNT” was started in 2016 to compare the design codes mainly related to concrete structures and composite structures. This script is the main intellectual outputs from this project. It comprises codes background analysis, direct codes terms comparison and design examples. The script covers most of the design topics related to design of concrete structures and composite structure for building design as well as the design basics such as safety concept. It is a common achievements of students, researchers and professors from different universities and instructions of different countries. The main work is done at University of Luxembourg especially for the design basics part and the design of composite structure of steel and concrete. For design of concrete structure part, University of Applied Science Trier (Germany) and Thei (Hong Kong, China) has offered great helps and contributed many parts. To conform with the goals of Erasmus+ to promote the cooperation and mobility with the EU’ partner countries and to promote the sustainable development of its partners in the field of higher education and contribute to achieving the objectives of the EU Youth Strategy, the script involves many student’s work. The students could participate in the project through either joining special courses offered by the project partners, as well as, doing a student project, bachelor or master thesis related to this project. Further more the students participated within the transnational teaching activity weeks. With the guidance, the students were able to learn and compare difference design methods by EuroCodes and Chinese design codes and to cooperate with their colleges from different countries. To achieve good quality of the final script, which can be used as additional information and learn material for other students and engineers to learn about Eurocodes and Chinese codes for structural design. Also the work was edited into a uniform formatting to make it constant in style and easy to read. Although, besides the contribution from students, many other topics were added to make the documents complete, it was not possible to cover every topic in the codes due to the limited time and resources. Thus, topics such as fire design, seismic design, bridge design, pre-stressed structures and others are not within the scope of the work. The scripts are divided into 7 sub chapters and many small topics. Each topic has two main documents for Eurocodes and Chinese codes. The main documents have same list of contents, which allows readers to compare the design aspects from the two codes systems easily side by side. Besides that, each topic is also provided with a general summary of comparison, which points out the most important difference and general overview of the design. In the documents not only the content of the codes but also the background information is discussed, which will help students and engineers to understand not only the difference of design but also the reasons behind it.
