Depuis les référendums sur le feu Traité constitutionnel européen en 2005 et suite au déclenchement de la crise de la dette souveraine d’Etats membres de la zone euro en 2009, la confiance accordée par les citoyens à l’Union européenne et aux gouvernements qui la composent s’affaiblit. Le scrutin pour désigner le nouveau Parlement européen en mai 2014 a confirmé ce « réalignement électoral » au profit de forces politiques qui sont classées et/ou qui se considèrent parfois elles-mêmes comme relevant du « populisme ». Ce rapport de force inédit nous oblige à traiter « à nouveaux frais » de l’identité des populismes et de leurs rapports à la démocratie d’autant plus qu’ils aspirent désormais, s’ils ne l’ont pas déjà fait, à exercer des fonctions gouvernementales. Bien plus, il n’existe aucune théorie politique qui ne se réfère directement ou indirectement à l’égalité ou à l’inégalité à un point tel qu’on puisse dire que, dans la plupart des cas, du moins depuis les Révolutions américaine et française, la justice d’un ordre social et politique se traduit par l’égalité ou l’inégalité entre ses membres. D’où la controverse qui entoure son usage dans les contextes sociaux et politiques. C’est à juste titre qu’on a pu dire que la justice représente un “essentially contested concepts”.1 Néanmoins, même en politique, ce ne sont pas toutes les occurrences ou emploi du terme égalité ou inégalité qui devraient donner lieu à des contestations. By legal documents are meant the texts of legislation, including relevant secondary legislation, as well as significant court decisions. Each legal text will be preceded by an introduction describing the historical, political and legal circumstances of its adoption, plus a short paragraph summarising its content. The legal texts will be published in the original language while the annotations and supporting material will be in English. The focus of the book is on the religious dimensions of being Muslim in Luxembourg, i.e. on individuals' access to practise their religious obligations and on the ability to organise and manifest their religious life. It's a part of a project will cover the 28 member states of the European Union (including Croatia), Norway and Switzerland plus the European Union and the European Court of Justice. [less ▲]

This volume discusses how the digital turn has affected the field of Jewish Studies. It explores the current state of the art and probes how digital developments can be harnessed to address the specific questions, challenges and problems that Jewish Studies scholars confront. Global pandemics, devastating wars and natural disasters with increasing frequency and impact are disrupting previously carefully balanced manufacturing networks. All industrial companies are required to examine their operations and adjust accordingly. The increasing cost of resources require enterprises to re-design their value creation processes to be more sustainable, to optimize the supplier network to become more resilient and to accelerate digitizing of operations to enhance operational effectiveness. This year's WGAB research seminar is themed around Digitization of the work environment for sustainable production and seeks to contribute solutions to the current challenges. The scientific discourse aims to advance the sustainable and data-based organization of value creation processes. Exemplary efforts for the sustainable production of 3D printed footwear and the circular supply chain of energy production will be discussed. With advances in sensory data collection in cyber-physical production systems (CPPS), there are new opportunities for sensing the status of manufacturing systems, which enable advanced data analytics to contribute to a sustainable production. Intelligent processes enable sustainable value creation and bi-directional knowledge exchange between humans and machines. With people at the centre of the CPPS, production systems shall be both adaptive and personalized for every worker. People need to be involved in the technological and organizational changes. Simulating the migration from a linear economy to a circular economy supports the trend of regionalized production networks. Digital assistance systems are tested to back up resilient manufacturing. We would like to thank all authors for their efforts in preparing the contributions, which are valuable inputs to the discourse to solve the current challenges. [less ▲]

Im September 2020 ist es soweit: Der neue Medienstaatsvertrag löst den bisherigen Rundfunkstaatsvertrag ab. Er bedeutet nicht weniger als eine umfassende Neuregulierung der elektronischen Medien. Auch die Vorschriften zur Aufsicht erfahren umfangreiche Neuregelungen. Insgesamt lassen sich im Vergleich zum Rundfunkstaatsvertrag erhebliche Änderungen sowohl in der Systematik als auch in vielen Details verzeichnen. Der Medienstaatsvertrag trägt damit technischen Entwicklungen ebenso Rechnung wie der Umsetzung von neuen Vorgaben auf unionaler Ebene. Überarbeitet und geändert wurden Regelungen zum Rundfunkbegriff- und Zulassungsvorschriften sowie die Plattformregulierung. Teilweise völlig neu oder mindestens erheblich geändert sind die Abschnitte zu neuen Medienformen und -plattformarten, zu "Medienintermediären", "Benutzeroberflächen" und "Video-Sharing-Diensten". Unser Standardwerk zum bisherigen Rundfunkstaatsvertrag sowie Jugendmedienschutzstaatsvertrag trägt diesen weitreichenden Änderungen Rechnung und wird zum Heidelberger Kommentar Medienstaatsvertrag Jugendmedienschutz-Staatsvertrag. In gewohnter Qualität und Expertise - Herausgeber und Autoren sind namhafte Experten aus der deutschen Medienlandschaft - wird die gesamte historische Entwicklung des föderal vereinbarten Rundfunk- und Telemedienrechts einschließlich des Jugendmedienschutzrechts und der europäischen Entwicklungen berücksichtigt und es wird eine vollständige Informationsquelle zu verfassungsrechtlichen, einfachgesetzlichen und praktischen Streitfragen geboten. This book focuses on the enforcement aspect of tobacco control policy, and argues that the intense regulation of the tobacco market will never be successful as long as it can be circumvented by the availability of illicit tobacco products. Yet, current efforts to combat illicit tobacco trade are insufficient, suffering from several flaws and gaps at the regulatory and operational levels. The aim of this book is to provide an analysis of the legal framework and practice of enforcement with regard to illicit tobacco products. Combining criminological and legal perspectives, it presents and critically analyses the phenomenon of illicit tobacco trade, as well as the policies, legal frameworks and practices in six EU countries with regard to combatting this phenomenon, assessing the strengths and weaknesses of their approaches. Furthermore, it studies the relationship between the EU and third countries (e.g. Ukraine) in terms of how the EU can influence policy and enforcement in these countries in order to counter illicit tobacco trafficking. Not exclusively focusing on the EU, the book also includes an analysis of enforcement against illicit tobacco products in the US. The EU Member States analysed in the book (Belgium, Germany, Italy, Latvia, the Netherlands and Poland) reflect the range of currently available approaches. Some of them have ratified the WHO Protocol against tobacco smuggling; others have not. They belong to different legal traditions and face different challenges due to their respective border situations. While Belgium and the Netherlands are key entry ports to the EU, Poland and Latvia represent the Eastern land border of the EU, with various regional challenges. Italy has a long maritime border, where trafficking is possible from Northern Africa and from the Middle East. It also has significant experience in fighting organised crime. Lastly, Germany is the largest market in Europe and situated in the middle of these trafficking routes. [less ▲]

As media environments and communication practices evolve over time, so do theoretical concepts. This book analyzes some of the most well-known and fiercely discussed concepts of the digital age from a historical perspective, showing how many of them have pre-digital roots and how they have changed and still are constantly changing in the digital era. Written by leading authors in media and communication studies, the chapters historicize 16 concepts that have become central in the digital media literature, focusing on three main areas. The first part, Technologies and Connections, historicises concepts like network, media convergence, multimedia, interactivity and artificial intelligence. The second one is related to Agency and Politics and explores global governance, datafication, fake news, echo chambers, digital media activism. The last one, Users and Practices, is finally devoted to telepresence, digital loneliness, amateurism, user generated content, fandom and authenticity. The book aims to shed light on how concepts emerge and are co-shaped, circulated, used and reappropriated in different contexts. The contributions to this book examine the two main asymmetries of the Euro Area as they have intensified during the second decade of Economic and Monetary Union (EMU): the first between monetary union (more supranational governance) versus ‘economic’ union (less centralised governance); the second between those Euro Area member states of the so-called ‘core’ and those of the ‘periphery’. EMU stands as one of the European Union’s (EU) flagship integration achievements. Set up in 1999, with the large majority of EU member states at the time, EMU was described as ‘asymmetrical’ even prior to its start. From the outset, it involved asymmetrical integration in monetary and ‘economic’ union. Although a major element of the blueprint that paved the way for the final stage of EMU, the concept of ‘economic’ union was insufficiently developed. The second decade of the single currency gave rise to a second asymmetry, namely one between those Euro Area member states of the ‘core’ and those of the ‘periphery’. The ten contributions to this volume speak to one or both of these asymmetries, covering the major political, political economy and policy dimensions of EMU and the ongoing debates about necessary policy and institutional reforms to overcome these asymmetries and bolster Euro Area stability. The outbreak of the Coronavirus (Covid-19) Crisis in 2020 created unprecedented socio-economic challenges for Euro Area member states, heightening the perceived urgency of reform. [less ▲]

The suggestion to “align international taxation with value creation” first emerged in the context of the OECD BEPS Project aimed at tackling aggressive tax planning strategies resulting in base erosion and profit shifting. The concept of “value creation” was then further relied on in the broader discussion that followed about the impact of digitalization on the global economy generally and the fair allocation of taxes between countries in this new environment. Although the idea – or the guiding principle – that profits should be taxed where economic activities occur and where value is expected to be created initially received a relatively large support, it rapidly became clear (at least to academics) that there would be no obvious answer to the question “where is value being created?” in a manner that would be relevant for (international) tax purposes, inter alia in view of the different models of value creation within corporate entities. Based on 9 thematic reports (offering an interdisciplinary discussion of the concept of value creation mostly from an international perspective) and on 23 national reports (focusing on the meaning of value creation in domestic tax law), this book seeks to contribute to the discussion on whether the concept of value creation is viable, both theoretically and in practice, as a criterion for the allocation of taxing rights under a modernized international tax framework. “You never knew. That was his power.” These words, which picture Keyser Söze in The Usual Suspects (1995), also describe a specific mode of action typical of evil protagonists in popular culture of the 20th and 21st centuries, namely their non-appearance. One can indeed distinguish several types of evil in popular culture: on the one hand, the representatives of the “other” in the sense of a political enemy (the stereotypical character of the Nazi, the Communist, the Arab terrorist, etc.); on the other hand, the figure of the faceless, disguised, not (stereotypically) apparent evil. The secret organization that James Bond fights against in several films is significantly named “Specter”. Similarly, Lord Voldemort remains faceless and ghostlike in the Harry Potter series. These figures do not represent the “other” as a clearly identifiable political antagonist, but an “other other” whose unknowability and namelessness are an essential part to his or her power and (non-)identity. The “bad guys” can always be interpreted as reflections of a political order: by not adhering to the moral, social, and political rules of the community, they reflect on the contingency of these rules and may also try to enforce alternative models of coexistence through violence. It would therefore be interesting to ask to what extent the faceless figure of evil represents a political model without being clearly identified to a political or ideological “other”? In the context of media diversity in popular culture in the 20th and 21st centuries, the portrayal of faceless figures of evil produces an equally wide variety of aesthetic manifestations. The question of the representations of evil thus necessarily exists at the interface between politics and poetics. This issue of Cultural Express wants to examine this interface in popular and youth literature, fantasy, science-fiction, horror, crime fiction, movies, TV series, songs, comics, graphic novels, video games, etc. [less ▲]

Par le passé les conduites humaines ont été étudiées selon une approche générale ou une approche différentielle donnant lieu à des courants séparés de la psychologie, les modèles comportementaux laissent, aujourd’hui, une place de plus en plus importante aux variations inter et intra-individuelles. La psychologie différentielle longtemps restreinte à l’étude de champs particuliers, comme celui des méthodes par exemple, bénéficie de ce nouveau paradigme et participe activement à cette évolution conceptuelle. En parallèle, ses thématiques de recherche se voient modifiées par la prise en compte des intérêts des autres disciplines avec lesquelles elle collabore. Dès lors, elle aborde, comme ses précurseurs l’avaient définie, des champs plus en lien avec les évolutions sociétales actuelles : éducation différenciée, formation tout-au-long de la vie, orientation, sélection des personnes ou ressources humaines. De plus, les avancées techniques et technologiques lui permettent de faire évoluer ses outils d’investigation et de diagnostic, sur lesquels elle s’est, depuis son origine, arcboutée et qui sont actuellement le testing assisté par ordinateur, le testing adaptatif, l’intelligence artificielle ou les interfaces homme-machine. Enfin, par la prise en compte des théories et des méthodes de sciences émergentes (sciences cognitives et neurosciences), elle se dote de nouveaux moyens d’analyse des différences individuelles. Ainsi une certaine mutation de la psychologie différentielle s’observe au travers de différents travaux récents initiés au sein de cette discipline et que le présent ouvrage Recherches actuelles en psychologie différentielle tente de mettre en lumière. En effet, ce recueil, composé des synthèses de certaines communications orales et affichées présentées lors des XXIIIème Journées de Psychologie Différentielle (Luxembourg, 2018) se veut, sans être exhaustif, le reflet de certaines voies nouvelles de ce domaine scientifique et souhaite ainsi donner une image nouvelle et actuelle de la psychologie différentielle, des réalisations et perspectives de recherche de cette discipline. The visual turn recovers new pasts. With a focus on education, this book seeks to present a body of reflections that question a certain historicism. It renovates historiographical debate about how to conceptualize visual media while presenting new themes and methods for researchers. Images are interrogated as part of régimes of the visible, of a history of visual technologies and visual practices. Considering the socio-material quality of the image, the analysis moves away from the use of images as mere illustrations of written arguments, and seriously questions the life and death of artifacts – that is, their particular historicity. Questioning the visual and material evidence in this ways means considering how, when, and in which régime of the visible it has come to be considered as a source, and what this means for the questions contemporary researchers may ask. The volume presents the results of a research project (named “Legafight”) funded by the Luxembourg Fond National de la Recherche in order to verify if and how digital tracing applications could be implemented in the Grand-Duchy in order to counter and abate the Covid-19 pandemic. This inevitably brought to a deep comparative overview of the various existing various models, starting from that of the European Union and those put into practice by Belgium, France, Germany and Italy, with attention also to some Anglo-Saxon approaches (the UK and Australia). Not surprisingly the main issue which had to be tackled was that of the protection of the personal data collected through the tracing applications, their use by public health authorities and the trust laid in tracing procedures by citizens. Over the last 18 months tracing apps have registered a rise, a fall, and a sudden rebirth as mediums devoted not so much to collect data, but rather to distribute real time information which should allow informed decisions and be used as repositories of health certifications. Inclusive education has become a leading theme internationally over the past several decades, as it addresses key issues, often controversial, of exclusion/inclusion, learning opportunities, and educational equality and justice. Among international organizations as well as supranational governments, we find an increasing emphasis on recognizing diversity and enabling education for all. This is visible in the Salamanca Declaration (1994), the overall “education-for-all” agenda, the Sustainable Developments Goals (e.g., Education, SDG 4), and the worldwide ratification of the UN Convention on the Rights of People with Disabilities (e.g., Article 24 on Education), which mandates among state parties the establishment of an inclusive education system across levels, from early childhood to lifelong learning. This frame of reference is not only significant in terms of definitions and contents but also in the context of the strengthening of world society. The world societal level is not the same as what occurs in the relations between nation states, as important as such learning in policies and practices may be but extends beyond. This is evident in the definition of “inclusion” that has become significant internationally as a category signifying attempts to guarantee access and participation in different levels of education systems, but one that has contrasting and divergent understandings, implications, and implementation consequences between national and local contexts. The goal of participation that follows normatively and legally from such understandings of inclusion, is recontextualized differently, sometimes even paradoxically, when in fact segregated and separate settings are extended under the banner of inclusion. In Germany, for example, despite inclusion discourse flowing from such international agendas that focus on processes of integration and participation, the structures, cultures, and practices that disadvantage and disable continue to exist or even become strengthened. Even if the myriad dimensions of diversity are increasingly discussed and intersectional approaches become more important, the emphasis on difference of disability or “special educational needs” continues. In educational research, numerous publications have delineated the establishment of inclusive education from diverse perspectives. Over the past decade in particular, this has occurred in relation to the UN CRPD, which also implies a connection to the world society-frame; however, theorization and in-depth empirical analyses are lacking to explain more recent developments on multiple levels. Even for nation-states, few systematic and comparative studies have analyzed the diverse forms of inclusive education in different contexts. The consequence has been a divergence between the national discourses of inclusive education, for example, in the German-speaking countries, that remain focused on special educational needs, and the more global discourse that understands inclusive education in human rights terms and a key developmental process in democracies. Although some recent comparative research projects and dissertations provide insights into specific country contexts, a more comprehensive publication that collects such research results of international inclusive educational research has been lacking. Furthermore, the opportunity presents itself to extend the dialogue through a world society perspective on inclusion to reflect global inequalities via integrating case studies from the Global South. International and intercultural perspectives enable the investigation of structures, cultures and practices of different countries to the crucial comparison of educational processes. This is especially necessary in the case of inclusive education, whether as a source of inspiration, a reflexive critique of taken-for-grantedness or as a means to identify disparities and social inequalities. Thus, in several dozen chapters, the Handbook Inclusion International presents diverse global, national, and local perspectives on inclusive education. [less ▲]

Marked by expanding and diverse forms of collaboration and competition, the investigation of contemporary developments in higher education and science systems need additional attention. Therefore, this research topic provides a forum for multidisciplinary exchange of pioneering research ideas and dialogues as well as complementary research that contribute to the field of knowledge, and aspires to support innovative, cutting-edge, and policy relevant research at the nexus of higher education research and science studies (HERSS), bibliometrics, scientometrics, and computational social sciences –traditionally separate communities focusing either on small scale and in-depth case studies or on large-scale “big data” research. Researchers bringing together the aforementioned scientific communities can be classified as important bridge-builders to bolster the growing research and current initiatives in the field of Science of Science between diverse scientific communities and the wider public. Especially sociology with its ambition to pair classic and innovative theoretical approaches with new methods to analyze and to qualitatively interpret quantitative “big data” with machine learning algorithms initiates a fascinating and promising approach to interlink the still separate scientific communities in favor of a more holistic understanding of Science of Science. In this Research Topic -as part of the Lecture Series: Science of Science in the Spotlight at the University of Luxembourg- we invite members of these diverse scientific communities and researchers who are working at the intersection as “translators” to present their latest research. We aim to promote and provide evidence-based insights into the drivers of multidisciplinary and international research and innovation, networks, and collaboration, including higher education developments, scientific knowledge production (e.g. publications, citations, patents), science capacity-building, research evaluation, policy reforms, cultural and societal change processes, and institutions and organizations as well as scientists’ geographical mobility, gender inequalities and career paths in science, and of migrant scientists. Furthermore, we want to stimulate debate on theoretical in-depth context knowledge and innovative methodological approaches (for example social network analysis and machine learning algorithms), and on data acquisition and analysis -long identified as an important research gap in Science of Science. La révision constitutionnelle, en chantier depuis 2009, marque cependant un arrêt. L’espoir de disposer, dès 2020, d’un chapitre rénové relatif aux droits et libertés s’est éloigné. The volume brings together the work of sixteen scholars focused on the diverse debates surrounding the construction and operation of Banking Union (BU), and its necessary reform. BU represents one of the most important developments in European integration since the launch of Monetary Union. Furthermore, the design of the BU agreed between 2012 and 2014 was a messy compromise among EU member states. It is not surprising then that BU has sparked a lively academic debate and triggered an ever-growing number of publications from different disciplinary backgrounds. The first wave of academic work on BU focuses upon the economic rationale underpinning the supranationalisation of control over banking — regulation, supervision, support and resolution — and the political dynamics and legal issues that shaped the design of the Union agreed. This volume is located at the intersection of this first phase of academic research and a second stage which analyses the functioning of the different elements of BU. New research questions are triggered by the albeit limited empirical evidence on BU’s implementation and operation. Contributions to this second wave of research attempt to identify potentially dangerous lacunae and contribute to on-going reform debates. [less ▲]
