The European Union is a union under the rule of law and accordingly all exercise of public authority needs to conform with the principle of legality. The legal framework of the EU is, however, as much as that of any state or international organization, subject to change over time. That part of this legal framework specifically governing EU administration has been particularly dynamic. The central reason for this dynamism is to be found in the evolving nature of European integration, and in the changing requirements and conditions for implementing EU policies. The legal framework of administration has been both the subject of, and a response to, change in the ambient political and institutional environment. The EU, having started as an organization of six Member States focused on economic integration, has evolved into a Union of twenty-seven Member States now touching almost all elements of the exercise of public power in a modern society. The evolutionary development of the constitutional basis of EU law, with its many phases of Treaty reforms and change induced by case-law, finds its parallel in EU administrative law. European administrative law has in this process grown, changed, and indeed matured over time, and has emerged as an important, yet sometimes not well understood, factor which materially shapes policy in the EU and its achievement in reality. The rise of the importance of EU administrative law is itself attributable both to the specificities of European integration and to the general increase in the importance of administrative regulation in the past decades. On the one hand, the protection of the society against risks associated with private activity such as banking, food production, energy production and distribution, transport, or activities threatening to the environment, to name just a few, and the achievement of a balance between their benefits and dangers have become increasingly important subjects of attention. On the other hand, the provision of services and infrastructure necessary to ensure and protect basic standards of living such as pensions, health care, access to water, energy supply and telecommunications services have been the subject of mixed regimes, often still having a strong public service element, but increasingly left to private provision subject to various levels of market regulation. Both kinds of motivation for regulatory measures and their implementation by appropriate authorities have added to, and substantially changed, the broad character of public administration in Europe in recent decades. Such changes have occurred not just on a national, that is, Member State level, but also, pre-eminently, on the level of the European Community and now Union. Indeed, many of the changes have themselves been triggered on the European level as integral or at least adjuvant elements of the establishment of the European internal market. The role, then, of administrative law and administrative activity on the European level is extensive and important. Rules and principles governing the exercise of administrative functions, the organization of the institutions and bodies exercising these functions, and applicable procedures are the essence of EU administrative law. These are the subject of this book. There are, it must be observed, many perspectives from which one can view, analyse and comprehend both administration and administrative law. Three models or perspectives appear to us to be particularly helpful: administration and administrative law may be usefully considered from functional, organizational, and procedural standpoints. The functional aspect of administration refers to the totality of the tasks of administration, no matter who undertakes them and how they are carried out. The organizational perspective emphasises the organization and structure of the institutions, bodies, and actors engaged in undertaking such tasks. Finally, a procedural understanding of administration observes the processes which link the various actors and authorities in the performance of administrative functions. None of these models standing alone provides a fully rounded understanding or conceptualisation of the subject matter of the book. A proper analysis of EU administrative law cannot view it from only one of these perspectives. Taken together, however, these three standpoints do offer a comprehensive perception, giving the subject a more multi-dimensional shape, and thus allowing a more tractable presentation of what is very complex material. For this reason, we offer a discussion of each of these three perspectives — the functional, organizational, and procedural aspects of European Union administration and the associated legal framework — by way of introduction. The three models are, of course, closely interlinked and in reality scarcely separable but, for analytical and presentational clarity, they are here addressed separately. [less ▲]

The problem of banks being 'too big to fail' was the defining regulatory issue of the global financial crisis. However, attempts to tackle the problem by separating retail banking from higher risk trading activities - known as structural reform - proved to be highly divisive and contributed to significant regulatory divergence. In this book, David Howarth and Scott James explain this variation by examining the politics of bank structural reform across six key jurisdictions: the United States, the European Union, the United Kingdom, France, Germany, and the Netherlands. Integrating political economy and public policy approaches, they develop a novel 'comparative financial power' framework to analyse how financial industry influence is mediated by two factors: first, whether bank lobbying is unified and centralized (cooperative financial power) or divided and fragmented (competitive financial power); and second, policy makers' use of venue shifting to depoliticize contentious policy issues. The book explains that the US and UK governments implemented major reforms because the banking industry was divided and faced significant opposition. However, venue shifting to an independent committee led to durable reform in the UK, while political polarization in the US contributed to contested reform. By contrast, the French and German governments balanced unified bank lobbying and political pressures to act by pursuing limited symbolic reforms; the Dutch government deflected the issue through delegation to multiple commissions (no reform); while political stalemate at the EU level resulted from early venue shifting and concerted pan-European bank lobbying. The book makes a major contribution to scholarship on the political economy of finance and business power. [less ▲]

I introduce the book starting by my own personal experience of growing up in a mixed family and being myself in a mixed marriage. I describe the structure of the book by building up my own method: how I chose this topic, who were the people I interviewed, how (interviews, stories, and objects) and why was the single-but-critical instances analysis important. I focus on the richness of the interaction I had with the interviewees. I underlie the phenomenological stories of struggles, trust and vulnerability. The chapters resolve around power relations, expressing affection, in-depth communication, child rearing, conflict resolution strategies, empathy, female identity, future planning, the role of humor, the biggest cultural and linguistic challenges and opportunities. The focus is on the phenomenon captured in single-but-critical instances in participants' stories. I conclude by describing what significance culture has in intimate intercultural relationships. In 1922, Harald Bohr and Johannes Mollerup established a remarkable characterization of the Euler gamma function using its log-convexity property. A decade later, Emil Artin investigated this result and used it to derive the basic properties of the gamma function using elementary methods of the calculus. Bohr-Mollerup's theorem was then adopted by Nicolas Bourbaki as the starting point for his exposition of the gamma function. This open access book develops a far-reaching generalization of Bohr-Mollerup's theorem to higher order convex functions, along lines initiated by Wolfgang Krull, Roger Webster, and some others but going considerably further than past work. In particular, this generalization shows using elementary techniques that a very rich spectrum of functions satisfy analogues of several classical properties of the gamma function, including Bohr-Mollerup's theorem itself, Euler's reflection formula, Gauss' multiplication theorem, Stirling's formula, and Weierstrass' canonical factorization. The scope of the theory developed in this work is illustrated through various examples, ranging from the gamma function itself and its variants and generalizations (q-gamma, polygamma, multiple gamma functions) to important special functions such as the Hurwitz zeta function and the generalized Stieltjes constants. This volume is also an opportunity to honor the 100th anniversary of Bohr-Mollerup's theorem and to spark the interest of a large number of researchers in this beautiful theory. [less ▲]

This book describes Python3 programming resources for implementing decision aiding algorithms in the context of a bipolar-valued outranking approach. These computing resources, made available under the name Digraph3, are useful in the field of Algorithmic Decision Theory and more specifically in outranking-based Multiple-Criteria Decision Aiding (MCDA). The first part of the book presents a set of tutorials introducing the Digraph3 collection of Python3 modules and its main objects such as bipolar-valued digraphs and outranking digraphs. The second part illustrates in eight methodological chapters multiple-criteria evaluation models and decision algorithms. These chapters are mostly problem oriented and show how to edit a new multiple-criteria performance tableau, how to build a best choice recommendation, how to compute the winner of an election and how to rank or rate with incommensurable criteria. The book's third part presents three real decision case studies, while the fourth part addresses more advanced topics, such as computing ordinal correlations between bipolar-valued outranking digraphs, computing kernels in bipolar-valued digraphs, testing for confidence or stability of outranking statements when facing uncertain or solely ordinal criteria significance weights, and tempering plurality tyranny effects in social choice problems. The last part is more specifically focused on working with undirected graphs, tree graphs and forests. The closing chapter explores comparability, split, interval and permutation graphs. It becomes clear against which barriers such a model of dual employment has to be defended: Intersectional effects, regarding gender and disability, become invisible within the private sphere. They are answered by seemingly individual work sharing arrangements between partners. The focus of the analysis is less on a 'special' group than on processes of becoming special, being addressed and subjectified as 'other parents'. The subjectivation of a couple as 'parents of a child with disabilities' contributes to the reproduction of gendered care arrangements and highlights social processes of drawing boundaries and conditions of recognisability. The aim of this guide is to provide a starting point for using web archives as a source for social science research. With the migration of many aspects of the so- cial world online, fundamental questions have been raised about how and even when social science research happens in the online sphere (Karpf, 2012). Web archives, or archives of content and communications from the Web through time, crucially provide the means for retrospectively studying dynamic media and online interactions that are often subject to change and deletion. In addition to the opportunities afforded by web archives as a primary source, however, given their scale and complexity, these collections also present challenges for researchers who want to use them. This guide provides a primer for how to approach web archives research design by first outlining what web archives are and how they differ from other types of web data, as well as identifying key sources for web archives collections. Following this, we provide several high-level descriptions and examples of existing research to demonstrate how web archives offer particular methodological opportunities for studying different types of web phenomena. Next, we draw on the literature to highlight three key considerations for designing a project using web archives, including the ethical implications of using archived web data without the consent of content producers. The guide concludes by summarising the opportunities and challenges of using web archives and provides additional sources to consult. [less ▲]

Proportionality increasingly dominates legal imagination. Initially conceived of as a principle that regulates police action, today it is progressively established as an advanced tool of liberal constitutional science. Its spread, accompanied by a global paradigm of constitutional rights, appears to be an irresistible natural development. This thesis was inspired by the intuition that even though courts and lawyers around the world reason more and more in proportionality terms, proportionality can mean very different things in different contexts, even within the same legal system. While the relevant literature has paid little attention to differences in the use of proportionality, identifying the local meanings of proportionality is crucial to making sense of its spread, to assessing its success, and to appraising the possibility of convergence between legal systems. Through an in-depth study and comparison of the use of proportionality by legal actors in France, England and Greece, this work shows that the local meanings of proportionality are not simply deviant applications of a global model. Instead, they reflect the legal cultures in which they evolve, local paths of cultural change and local patterns of Europeanisation. [less ▲]

Peripheries at the Centre compares the experiences of schooling in Upper Silesia in Poland and Eupen, Sankt Vith, and Malmedy in Belgium — border regions detached from the German Empire after the First World War. It demonstrates how newly configured countries envisioned borderland schools and language learning as tools for realizing the imagined peaceful Europe that underscored the political geography of the interwar period. Entrée en vigueur depuis 2017, cette procédure européenne, quoique uniforme, n’est pas complète et nécessite une application coordonnée des dispositions du Règlement avec les règles nationales applicables aux institutions équivalentes des Etats membres (saisie conservatoire, saisie-arrêt). L’ouvrage propose un commentaire systématique des dispositions du Règlement et une analyse des problèmes de mise en œuvre qu’il soulève, en particulier dans le cadre de leur coordination avec les dispositions de droit national. Die Erstellung des nationalen Berichtes zur Situation der Jugend in Luxemburg geht auf den Artikel 15 (1) des Jugendgesetzes vom 4. Juli 2008 zurück, wonach der Minister, zu dessen Zuständigkeitsbereich die Jugendpolitik gehört, der Abgeordnetenkammer alle fünf Jahre einen Bericht vorlegt. Nach dem ersten Bericht im Jahr 2010, der als Gesamtbericht verschiedene Themen behandelte, thematisierte der zweite Bericht im Jahr 2015 die Übergänge vom Jugend- ins Erwachsenenalter. Der thematische Schwerpunkt des vorliegenden dritten Berichtes ist das Wohlbefinden und die Gesundheit von Jugendlichen in Luxemburg. Der Bericht umfasst zwei Teile: eine wissenschaftliche Analyse und Bestandsaufnahme, die von dem Centre for Childhood and Youth Research (CCY) an der Universität Luxemburg erstellt wurde, sowie einen Beitrag des Ministeriums für Bildung, Kinder und Jugend, welche den Kontext erläutert und die zukünftigen Schwerpunkte der luxemburgischen Jugendpolitik reflektiert. Bei der wissenschaftlichen Analyse und Bestandsaufnahme stehen die Jugendlichen und ihre subjektiven Sichtweisen, ihre Bewertungen und Handlungen im Zusammenhang mit ihrem Wohlbefinden und ihrer Gesundheit im Fokus. Der Bericht zeigt auf, (1) wie Jugendliche ihr Wohlbefinden und ihre Gesundheit einschätzen, (2) was Jugendliche für ihr Wohlbefinden und ihre Gesundheit tun oder nicht tun, (3) welche Bedeutung das soziale Umfeld für das Wohlbefinden der Jugendlichen hat, (4) wie Jugendliche die Covid-19-Pandemie und die Maßnahmen wahrnehmen und (5) wie luxemburgische Experten über das Wohlbefinden und die Gesundheit Jugendlicher diskutieren. Die Datengrundlage bilden vor allem die eigens für den Bericht erhobenen Daten aus standardisierten Umfragen und qualitativen Interviews. Um die Veränderung der Situation der Jugendlichen durch die Covid-19-Pandemie zu beschreiben, wurde während der Erarbeitung des Jugendberichtes eine weitere Studie entwickelt und durchgeführt, deren Ergebnisse im Bericht gesondert dargestellt werden. Der Bericht liefert eine umfassende Informationsgrundlage für die zukünftige Ausrichtung und Weiterentwicklung der Jugendpolitik der luxemburgischen Regierung, die in einem nationalen Jugendpakt zusammengefasst wird. Or, cette interprétation de l’activité philosophique est à son tour un concept : « le concept de concept. » Comme tout autre, ce concept répond à un problème – « quel est le propre de la philosophie ? » – et il recèle une multiplicité, un volume, des variations, un voisinage. Même si le concept de concept saisit l’essentiel de l’activité philosophique, on pourra alors croire qu’il est d’une portée limitée et voué à être dépassé comme n’importe quel autre concept. By acknowledging the flexible and complex nature of the precautionary principle under EU law and by referring to methodological pluralism, the goal of this book is to provide a polycentric interpretation of this principle based on diversity rather than uniformity. The polycentric interpretation is anchored in the construction of the conceptual network of the precautionary principle. This allows for the unitas multiplex between the different definitions and applications of this principle to be identified and assessed. The core claim of the book is that the polycentric interpretation of the precautionary principle can be built on two concepts: anticipation and action that represent the two main knots of its conceptual network. These knots are not isolated, but they are connected via some links to other knots that constitute the main concepts allowing identifying and applying the precautionary principle under EU law. International migration originating from highly developed countries is a crucial component of global migration flows. There are, however, surprisingly little data about the international mobility of the populations of affluent countries. The German Emigration and Remigration Panel Study (GERPS) aims to provide a resource that enables the analysis of individual consequences of international migration as well as the socio-structural consequences for the country of origin. GERPS is based on an origin-based multistage probability sample using the German population registers as a sampling frame. The second wave yields a net sample of roughly 7,000 persons who recently moved abroad from Germany and persons who returned from Germany after having lived abroad. The study follows a multidestination- country-design and enables the comparative analysis of migrants and nonmigrants, who stayed in the country of origin. GERPS is a panel study with at least four waves during a period of at least 24 months. This documentation presents the methods and data of the second wave. It provides information for researchers and invites them to use the new data infrastructure for their own research. [less ▲]

The Commissions' proposal for an EU ‘Digital Services Act’ aims to update the horizontal framework for intermediaries and create a safe online environment. However, as far as content mediation is concerned, European fundamental rights and values require that the specificities of media law must be taken into account. This study, conducted by the Institute of European Media Law (EMR) on behalf of the Media Authority of NRW, describes the current legal framework and the DSA proposal, and provides a comprehensive assessment from the perspective of media law, complemented by alternative proposals for further improvement. One place he sought to do so was in Greece, which was in the midst of a civil war. Through an in-depth study of Anglo-American diplomacy in Greece from 1946-50, Spero Simeon Z. He argues that, in many ways, Britain used the fast-escalating tensions of (what would become) the Cold War to direct and manipulate US policy in Greece, encouraging the Americans to take a more active role and (essentially) take Britain's place in the region. In the process, he sheds fresh light onto how the American experience in Greece contributed to the formulation of the Truman Doctrine, the infamous NSC-68 document and the ultimate birth of the Cold War. Drawing on a wide range of sources from Britain, the US, Greece and across the Balkans, Paravantes has produced the first book to focus on this crucial period in such close detail, and reveals the ways in which various foreign and domestic concerns coincided at a pivotal moment of twentieth century history. This work covers the challenges of excise duty collection from tobacco products and nicotine-containing products, driven by the tobacco market development. It also studies the in-depth theoretical basis of excise taxation of heated tobacco products and e-cigarettes in the context of achieving fiscal and regulatory goals. It describes the types and general approaches to the classification of novel tobacco products and nicotine-containing products. This research determines the tendencies and features of excise duty collection from heated tobacco products and e-cigarettes in EU countries in terms of broader distribution of these products on national markets. It describes specific aspects of the tobacco products excise policy in Moldova and Georgia. It also analyzes the specifics of the transformation of domestic tobacco products market due to the high excise duty burden carried by these products. The work also proposes ways of improving excise taxation of heated tobacco products and e-cigarettes in Ukraine to pump up the budget and regulate the tobacco market development. The survey findings can be useful to the state agencies and a broad range of other stakeholders when developing proposals regarding the formation and implementation of the excise policy for tobacco products and alternatives [less ▲]

A large number of individual and family fates are described, which can be traced to this day in the Luxembourg population. It is the first comprehensive publication on this subject. The book is based on several years of research carried out within the framework of the Center for Contemporary and Digital History of the University of Luxembourg (C2DH). Thanks to her language skills, the author was able to use Russian archives and gain new insights into, among other things, the history of the Luxembourg conscripts in Tambov. She also made contact with descendants of the emigrants in Luxembourg and discussed their history in numerous conversations, which are reflected in the book. Initialement conçue comme un principe régissant l’utilisation des pouvoirs de police, elle est aujourd’hui considérée comme un outil avancé de science constitutionnelle. Sa généralisation, accompagnée par le paradigme du droit constitutionnel global, est perçue comme irrésistible et naturelle. Cette recherche a été guidée par l’intuition que, même si les juristes à travers le monde raisonnent de plus en plus en termes de proportionnalité, celle-ci peut avoir des sens très différents, et ce, même au sein d’un seul système juridique. Les différentes utilisations du langage de la proportionnalité sont rarement étudiées en tant que telles. Pour autant, l’identification des sens locaux de la proportionnalité est cruciale si l’on veut comprendre sa propagation, apprécier son succès et évaluer les possibilités de convergence entre systèmes juridiques. Ce travail consiste en une étude approfondie et comparative de l’utilisation du langage de la proportionnalité parmi les acteurs juridiques en France, en Angleterre et en Grèce. Il cherche à montrer que les sens locaux de la proportionnalité ne sont pas simplement des applications imparfaites d’un modèle global. The relevant legal foundations in this respect at EU and national level are complex, and their interplay is often unclear. The resulting uncertainty about who is responsible and therefore liable for certain content requires a critical review of the current legal framework. This study, conducted by the Institute of European Media Law (EMR) on behalf of the State Media Authority NRW, analyses the current legal framework and reveals ways of enforcing the applicable provisions concerning illegal content. Les différents chapitres de ce livre proposent une approche holistique pour faire évoluer le système de santé vers le partenariat de soins. Résultat de trois années de recherche et de concertation, le Livre Blanc s’appuie sur des recherches documentaires (analyse de la littérature scientifique et de la législation spécifique de chaque pays), des entretiens et des enquêtes auprès de nombreux acteurs, le repérage et l’analyse d’initiatives en GR et la discussion orientée vers le consensus. Par ailleurs, les propositions de recommandations ont été élaborées et discutées lors d’un séminaire interrégional réalisé en décembre 2019. Le Livre Blanc est structuré en 5 parties qui s’adressent chacune à un public ciblé. La première partie situe le contexte dans lequel s’est réalisé le projet et décrit la méthodologie du programme. La seconde partie est consacrée aux aspects réglementaires de l’approche patient partenaire et à leurs conséquences sur les pratiques et les initiatives analysées sur le terrain. Elle est destinée de manière privilégiée aux mandataires politiques. La troisième partie propose une réflexion sur le développement de stratégies de partenariat au niveau des institutions de santé. Elle concerne les gestionnaires des établissements de santé. La quatrième partie vise à amener les professionnels à s’interroger sur ce que le partenariat de soins peut leur apporter dans leurs pratiques de soins. Elle s’adresse, en particulier, aux acteurs en contact direct avec les patients. La cinquième et dernière partie suggère différentes voies possibles de développement de l’APPS dans les domaines de l’enseignement et de la recherche. Toutes ces parties s’adressent bien évidemment au patient, qui est au coeur de l’APPS. From complex multi-players to casual gaming: video games are the most common virtual environment for entertainment that younger generations spend a significant time in. Although early game titles already featured morality-related topics, implementing meaningful eudaimonic playing based on moral decision making has become increasingly popular. Unfortunately, scientific analyses of game-related moral decisions mostly revolve around the effects of players engaging in virtual violence, leading to ongoing heated debates in academia and the general public (e.g., Anderson et al., 2010; Ferguson, 2007). To date, however, only few studies have tried to disentangle the moral aspects of video games from virtual violence (e.g., Joeckel, Bowman, & Dogruel, 2012). The present chapter provides an overview on both established and novel theories on psychological processing of moral decision making in virtual worlds in line with cutting-edge game examples. These theories aim at explaining how games can elicit moral processing as well as the factors that modulate these processes once the player is morally engaged. Based on i.a. aspects of the theory of presence (Biocca, Harms, & Burgoon, 2003; Tamborini & Skalski, 2006), moral disengagement (Bandura, 2002; Hartmann & Vorderer, 2010) and a dual process model of moral judgement (Greene, Sommerville, Nystrom, Darley, & Cohen, 2001; Gubbins & Byrne, 2014; Haidt, 2001), a new model is proposed. Furthermore, individual characteristics such as playing experience, player motivation and moral salience according to the moral foundations theory (Haidt & Joseph, 2008; Tamborini, 2011) are integrated in the model. In this provocative intellectual biography, architectural historian Mark Wigley makes the surprising claim that the thinking behind modernist architect Konrad Wachsmann’s legendary projects was dominated by the idea of television. While architecture is typically embarrassed by television, preferring to act as if it never happened, Wachsmann fully embraced it. Investigating the archives of one of the most influential designers of the twentieth century, Wigley scrutinizes Wachsmann’s design, research, and teaching, closely reading a succession of unseen drawings, models, photographs, correspondence, publications, syllabi, reports, and manuscripts to argue that Wachsmann is an anti-architect—a student of some of the most influential designers of the 1920s that dedicated thirty-five post–Second World War years to the disappearance of architecture. Wachsmann turned architecture against itself. His hypnotic projects for a new kind of space were organized around the thought that television liberates a different way of living together. Wachsmann dissolved buildings into pulsating mirages that were a huge influence on the experimental avant-gardes of the 1960s and 1970s. But Konrad Wachsmann’s Television: Post-architectural Transmissions demonstrates that this work was even more extreme than the experiments it inspired. Beobachtungen zu Permanenzen und Wandel stehen im Zentrum der Skizze zur Stadtentwicklung in Westeuropa. Diese unternimmt den Versuch, langlebige Verhältnisse und deutliche Einschnitte in einer weiten zeitlichen und räumlichen Perspektive zu skizzieren, die von der Verfestigung der neuen städtischen Lebensform im 12. Jahrhundert bis in das 19. Jahrhundert reicht, als sich mit der politischen Neuordnung und der Industrialisierung die Vorstellungen von Stadt, verändern. Zusammengeführt und partiell neu bewertet werden damit sowohl epochenspezifische Befunde der historischen Forschung zur mittelalterlichen und frühneuzeitlichen Stadt wie auch die bisher nur in begrenztem Ausmaß vorliegenden vergleichenden Untersuchungen zu regionalen Unterschieden in Westeuropa sowie Erkenntnisse anderer, an der Städteforschung beteiligter Disziplinen. "A contemporary history of Luxembourg in 70 chronicles" by Denis Scuto is a collection of 70 press chronicles, published from 2014 to 2019 in the Luxembourg newspaper Tageblatt. It is "public history" in the best sense of the word, because Denis Scuto as a professional historian intervenes directly in today's debates and enlightens them in a dazzling way by replacing them in the history of Luxembourg and Europe. It is a book aimed directly at the general public, which does not necessarily read scholarly works, but is interested in understanding the country in which it lives and works, with its indissolubly linked past and present. It is therefore a contemporary history because, over the course of the current debates commented by Denis Scuto, the essential elements of the construction of contemporary Luxembourg appear: the birth of the Grand Duchy as a nation-state, its hard learning of independence throughout the nineteenth century, political and social struggles, the consequences of the two world wars, its destiny as a country made of migratory flows, the upheaval of a rural country that became an industrial power and then a European and financial centre, etc. [less ▲]
