The European Union is a union under the rule of law and accordingly all exercise of public authority needs to conform with the principle of legality. The legal framework of the EU is, however, as much as that of any state or international organization, subject to change over time. That part of this legal framework specifically governing EU administration has been particularly dynamic. The central reason for this dynamism is to be found in the evolving nature of European integration, and in the changing requirements and conditions for implementing EU policies. The legal framework of administration has been both the subject of, and a response to, change in the ambient political and institutional environment. The EU, having started as an organization of six Member States focused on economic integration, has evolved into a Union of twenty-seven Member States now touching almost all elements of the exercise of public power in a modern society. The evolutionary development of the constitutional basis of EU law, with its many phases of Treaty reforms and change induced by case-law, finds its parallel in EU administrative law. European administrative law has in this process grown, changed, and indeed matured over time, and has emerged as an important, yet sometimes not well understood, factor which materially shapes policy in the EU and its achievement in reality. The rise of the importance of EU administrative law is itself attributable both to the specificities of European integration and to the general increase in the importance of administrative regulation in the past decades. On the one hand, the protection of the society against risks associated with private activity such as banking, food production, energy production and distribution, transport, or activities threatening to the environment, to name just a few, and the achievement of a balance between their benefits and dangers have become increasingly important subjects of attention. On the other hand, the provision of services and infrastructure necessary to ensure and protect basic standards of living such as pensions, health care, access to water, energy supply and telecommunications services have been the subject of mixed regimes, often still having a strong public service element, but increasingly left to private provision subject to various levels of market regulation. Both kinds of motivation for regulatory measures and their implementation by appropriate authorities have added to, and substantially changed, the broad character of public administration in Europe in recent decades. Such changes have occurred not just on a national, that is, Member State level, but also, pre-eminently, on the level of the European Community and now Union. Indeed, many of the changes have themselves been triggered on the European level as integral or at least adjuvant elements of the establishment of the European internal market. The role, then, of administrative law and administrative activity on the European level is extensive and important. Rules and principles governing the exercise of administrative functions, the organization of the institutions and bodies exercising these functions, and applicable procedures are the essence of EU administrative law. These are the subject of this book. There are, it must be observed, many perspectives from which one can view, analyse and comprehend both administration and administrative law. Three models or perspectives appear to us to be particularly helpful: administration and administrative law may be usefully considered from functional, organizational, and procedural standpoints. The functional aspect of administration refers to the totality of the tasks of administration, no matter who undertakes them and how they are carried out. The organizational perspective emphasises the organization and structure of the institutions, bodies, and actors engaged in undertaking such tasks. Finally, a procedural understanding of administration observes the processes which link the various actors and authorities in the performance of administrative functions. None of these models standing alone provides a fully rounded understanding or conceptualisation of the subject matter of the book. A proper analysis of EU administrative law cannot view it from only one of these perspectives. Taken together, however, these three standpoints do offer a comprehensive perception, giving the subject a more multi-dimensional shape, and thus allowing a more tractable presentation of what is very complex material. For this reason, we offer a discussion of each of these three perspectives — the functional, organizational, and procedural aspects of European Union administration and the associated legal framework — by way of introduction. The three models are, of course, closely interlinked and in reality scarcely separable but, for analytical and presentational clarity, they are here addressed separately. [less ▲]

Annotated Legal Documents on Islam in Luxembourg consist of an annotated book of currently valid legal documents affecting the status of Islam and Muslims in Luxembourg. By legal documents are meant the texts of legislation, including relevant secondary legislation, as well as significant court decisions. Each legal text will be preceded by an introduction describing the historical, political and legal circumstances of its adoption, plus a short paragraph summarising its content. The legal texts will be published in the original language while the annotations and supporting material will be in English. The focus of the book is on the religious dimensions of being Muslim in Luxembourg, i.e. on individuals' access to practise their religious obligations and on the ability to organise and manifest their religious life. It's a part of a project will cover the 28 member states of the European Union (including Croatia), Norway and Switzerland plus the European Union and the European Court of Justice. [less ▲]

The problem of banks being 'too big to fail' was the defining regulatory issue of the global financial crisis. However, attempts to tackle the problem by separating retail banking from higher risk trading activities - known as structural reform - proved to be highly divisive and contributed to significant regulatory divergence. In this book, David Howarth and Scott James explain this variation by examining the politics of bank structural reform across six key jurisdictions: the United States, the European Union, the United Kingdom, France, Germany, and the Netherlands. Integrating political economy and public policy approaches, they develop a novel 'comparative financial power' framework to analyse how financial industry influence is mediated by two factors: first, whether bank lobbying is unified and centralized (cooperative financial power) or divided and fragmented (competitive financial power); and second, policy makers' use of venue shifting to depoliticize contentious policy issues. The book explains that the US and UK governments implemented major reforms because the banking industry was divided and faced significant opposition. However, venue shifting to an independent committee led to durable reform in the UK, while political polarization in the US contributed to contested reform. By contrast, the French and German governments balanced unified bank lobbying and political pressures to act by pursuing limited symbolic reforms; the Dutch government deflected the issue through delegation to multiple commissions (no reform); while political stalemate at the EU level resulted from early venue shifting and concerted pan-European bank lobbying. The book makes a major contribution to scholarship on the political economy of finance and business power. [less ▲]

I introduce the book starting by my own personal experience of growing up in a mixed family and being myself in a mixed marriage. I describe the structure of the book by building up my own method: how I chose this topic, who were the people I interviewed, how (interviews, stories, and objects) and why was the single-but-critical instances analysis important. I focus on the richness of the interaction I had with the interviewees. I underlie the phenomenological stories of struggles, trust and vulnerability. The chapters resolve around power relations, expressing affection, in-depth communication, child rearing, conflict resolution strategies, empathy, female identity, future planning, the role of humor, the biggest cultural and linguistic challenges and opportunities. The focus is on the phenomenon captured in single-but-critical instances in participants' stories. I conclude by describing what significance culture has in intimate intercultural relationships. As in all fields and disciplines of the humanities, Jewish Studies scholars find themselves confronted with the rapidly increasing availability of digital resources (data), new technologies to interrogate and analyze them (tools), and the question of how to critically engage with these developments. This volume discusses how the digital turn has affected the field of Jewish Studies. It explores the current state of the art and probes how digital developments can be harnessed to address the specific questions, challenges and problems that Jewish Studies scholars confront. In a field characterised by dispersed sources, and heterogeneous scripts and languages that speak to a multitude of cultures and histories, of abundance as well as loss, what is the promise of Digital Humanities methods--and what are the challenges and pitfalls? The articles in this volume were originally presented at the international conference #DHJewish - Jewish Studies in the Digital Age, which was organised at the Centre for Contemporary and Digital History (C²DH) at University of Luxembourg in January 2021. The first big international conference of its kind, it brought together more than sixty scholars and heritage practitioners to discuss how the digital turn affects the field of Jewish Studies. In 1922, Harald Bohr and Johannes Mollerup established a remarkable characterization of the Euler gamma function using its log-convexity property. A decade later, Emil Artin investigated this result and used it to derive the basic properties of the gamma function using elementary methods of the calculus. Bohr-Mollerup's theorem was then adopted by Nicolas Bourbaki as the starting point for his exposition of the gamma function. This open access book develops a far-reaching generalization of Bohr-Mollerup's theorem to higher order convex functions, along lines initiated by Wolfgang Krull, Roger Webster, and some others but going considerably further than past work. In particular, this generalization shows using elementary techniques that a very rich spectrum of functions satisfy analogues of several classical properties of the gamma function, including Bohr-Mollerup's theorem itself, Euler's reflection formula, Gauss' multiplication theorem, Stirling's formula, and Weierstrass' canonical factorization. The scope of the theory developed in this work is illustrated through various examples, ranging from the gamma function itself and its variants and generalizations (q-gamma, polygamma, multiple gamma functions) to important special functions such as the Hurwitz zeta function and the generalized Stieltjes constants. This volume is also an opportunity to honor the 100th anniversary of Bohr-Mollerup's theorem and to spark the interest of a large number of researchers in this beautiful theory. [less ▲]

Book Description The second edition of Public History: A Textbook of Practice offers an updated guide to the many opportunities and challenges that public history practitioners can encounter in the field. Historians can play a dynamic and essential role in contributing to public understanding of the past, and those who work in historic preservation, in museums and archives, in government agencies, as consultants, as oral historians, or who manage crowdsourcing projects need very specific skills. This book links theory and practice and provides students and practitioners with the tools to do public history in a wide range of settings. This new edition reflects how much the field of public history has changed in the past few years, with public history now being more established and international. New chapters have therefore been added on the definition, history, and international scope of public history, as well as on specific practices and theories such as historical fictions, digital public history, and shared authority. Split into four sections, this textbook provides approaches, methodologies, and tools for historians and other public history practitioners to play a bigger role in public debates and public productions of historical interpretations: Part I focuses on the past, present, and future of public history. Part II explores public history sources, and offers an overview of the creation, collection, management, and preservation of materials (archives, material culture, oral history, or historical sites). Part III deals with the different ways in which public history practitioners can produce historical narratives through different media (including texts, fictions, audio-visual productions, exhibitions, and performances). Part IV discusses the opportunities and challenges that public history practitioners encounter when working with different collaborators. Whether in public history methods courses or as a resource for practicing public historians, this book lays the groundwork for making meaningful connections between historical sources and popular audiences. This book describes Python3 programming resources for implementing decision aiding algorithms in the context of a bipolar-valued outranking approach. These computing resources, made available under the name Digraph3, are useful in the field of Algorithmic Decision Theory and more specifically in outranking-based Multiple-Criteria Decision Aiding (MCDA). The first part of the book presents a set of tutorials introducing the Digraph3 collection of Python3 modules and its main objects such as bipolar-valued digraphs and outranking digraphs. The second part illustrates in eight methodological chapters multiple-criteria evaluation models and decision algorithms. These chapters are mostly problem oriented and show how to edit a new multiple-criteria performance tableau, how to build a best choice recommendation, how to compute the winner of an election and how to rank or rate with incommensurable criteria. The book's third part presents three real decision case studies, while the fourth part addresses more advanced topics, such as computing ordinal correlations between bipolar-valued outranking digraphs, computing kernels in bipolar-valued digraphs, testing for confidence or stability of outranking statements when facing uncertain or solely ordinal criteria significance weights, and tempering plurality tyranny effects in social choice problems. The last part is more specifically focused on working with undirected graphs, tree graphs and forests. The closing chapter explores comparability, split, interval and permutation graphs. The book is primarily intended for graduate students in management sciences, computational statistics and operations research. Chapters presenting algorithms for ranking multicriteria performance records will be of computational interest for designers of web recommender systems. Similarly, the relative and absolute quantiles-rating algorithms, discussed and illustrated in several chapters, will be of practical interest for public or private performance auditors. [less ▲]

This book focuses on the enforcement aspect of tobacco control policy, and argues that the intense regulation of the tobacco market will never be successful as long as it can be circumvented by the availability of illicit tobacco products. Yet, current efforts to combat illicit tobacco trade are insufficient, suffering from several flaws and gaps at the regulatory and operational levels. The aim of this book is to provide an analysis of the legal framework and practice of enforcement with regard to illicit tobacco products. Combining criminological and legal perspectives, it presents and critically analyses the phenomenon of illicit tobacco trade, as well as the policies, legal frameworks and practices in six EU countries with regard to combatting this phenomenon, assessing the strengths and weaknesses of their approaches. Furthermore, it studies the relationship between the EU and third countries (e.g. Ukraine) in terms of how the EU can influence policy and enforcement in these countries in order to counter illicit tobacco trafficking. Not exclusively focusing on the EU, the book also includes an analysis of enforcement against illicit tobacco products in the US. The EU Member States analysed in the book (Belgium, Germany, Italy, Latvia, the Netherlands and Poland) reflect the range of currently available approaches. Some of them have ratified the WHO Protocol against tobacco smuggling; others have not. They belong to different legal traditions and face different challenges due to their respective border situations. While Belgium and the Netherlands are key entry ports to the EU, Poland and Latvia represent the Eastern land border of the EU, with various regional challenges. Italy has a long maritime border, where trafficking is possible from Northern Africa and from the Middle East. It also has significant experience in fighting organised crime. Lastly, Germany is the largest market in Europe and situated in the middle of these trafficking routes. [less ▲]

Now in its second edition, and with significant updates and new material, Gilles Cuniberti’s innovative textbook offers a comparative treatment of private international law, a field of great importance in an increasingly globalized world. Written by a leading voice in the field, and using a text and cases approach, this text systematically presents and compares civil law and common law approaches to issues primarily within the United Kingdom, United States, France and the EU, as well as offering additional updated insights into rules applicable in other jurisdictions such as Japan, China and Germany. Key features of the second edition include: • New topics covered in the fields of jurisdiction and foreign judgments • Original discussions surrounding the 2019 Hague Convention on Judgments and the changes contemplated by the new US Restatement on Conflict of Laws • US, EU, French and English perspectives integrated throughout the text to ensure maximum relevance and encourage students to make comparative assessments • Carefully selected extracts from primary and secondary sources that build a clear picture of the field, as well as expert analytical commentaries and questions that set these extracts in context. Subjectivation research explores the relationship amongst social theory, reflections of the modern self, and empirical analyses of subject formations. Drawing on these empirical analyses of interactions between subjects and instances of subjectivation, this volume highlights how subjects can ‘talk back’. Readers are introduced to theoretical foundations, methodological approaches as well as empirically based theories on subjectivation in contemporary societies. [less ▲]

[less ▲]

Post-Growth Geographies examines the spatial relations of diverse and alternative economies between growth-oriented institutions and multiple socio-ecological crises. The book brings together conceptual and empirical contributions from geography and its neighbouring disciplines and offers different perspectives on the possibilities, demands and critiques of post-growth transformation. Through case studies and interviews, the contributions combine voices from activism, civil society, planning and politics with current theoretical debates on socio-ecological transformation. The study is researching dual-employed couples whose child has been marked as 'disabled'. Couple arrangements are reconstructed in their interactive dynamics. It becomes clear against which barriers such a model of dual employment has to be defended: Intersectional effects, regarding gender and disability, become invisible within the private sphere. They are answered by seemingly individual work sharing arrangements between partners. The focus of the analysis is less on a 'special' group than on processes of becoming special, being addressed and subjectified as 'other parents'. The subjectivation of a couple as 'parents of a child with disabilities' contributes to the reproduction of gendered care arrangements and highlights social processes of drawing boundaries and conditions of recognisability. The aim of this guide is to provide a starting point for using web archives as a source for social science research. With the migration of many aspects of the so- cial world online, fundamental questions have been raised about how and even when social science research happens in the online sphere (Karpf, 2012). Web archives, or archives of content and communications from the Web through time, crucially provide the means for retrospectively studying dynamic media and online interactions that are often subject to change and deletion. In addition to the opportunities afforded by web archives as a primary source, however, given their scale and complexity, these collections also present challenges for researchers who want to use them. This guide provides a primer for how to approach web archives research design by first outlining what web archives are and how they differ from other types of web data, as well as identifying key sources for web archives collections. Following this, we provide several high-level descriptions and examples of existing research to demonstrate how web archives offer particular methodological opportunities for studying different types of web phenomena. Next, we draw on the literature to highlight three key considerations for designing a project using web archives, including the ethical implications of using archived web data without the consent of content producers. The guide concludes by summarising the opportunities and challenges of using web archives and provides additional sources to consult. [less ▲]

As media environments and communication practices evolve over time, so do theoretical concepts. This book analyzes some of the most well-known and fiercely discussed concepts of the digital age from a historical perspective, showing how many of them have pre-digital roots and how they have changed and still are constantly changing in the digital era. Written by leading authors in media and communication studies, the chapters historicize 16 concepts that have become central in the digital media literature, focusing on three main areas. The first part, Technologies and Connections, historicises concepts like network, media convergence, multimedia, interactivity and artificial intelligence. The second one is related to Agency and Politics and explores global governance, datafication, fake news, echo chambers, digital media activism. The last one, Users and Practices, is finally devoted to telepresence, digital loneliness, amateurism, user generated content, fandom and authenticity. The book aims to shed light on how concepts emerge and are co-shaped, circulated, used and reappropriated in different contexts. It argues for the need for a conceptual media and communication history that will reveal new developments without concealing continuities and it demonstrates how the analogue/digital dichotomy is often a misleading one. Proportionality increasingly dominates legal imagination. Initially conceived of as a principle that regulates police action, today it is progressively established as an advanced tool of liberal constitutional science. Its spread, accompanied by a global paradigm of constitutional rights, appears to be an irresistible natural development. This thesis was inspired by the intuition that even though courts and lawyers around the world reason more and more in proportionality terms, proportionality can mean very different things in different contexts, even within the same legal system. While the relevant literature has paid little attention to differences in the use of proportionality, identifying the local meanings of proportionality is crucial to making sense of its spread, to assessing its success, and to appraising the possibility of convergence between legal systems. Through an in-depth study and comparison of the use of proportionality by legal actors in France, England and Greece, this work shows that the local meanings of proportionality are not simply deviant applications of a global model. Instead, they reflect the legal cultures in which they evolve, local paths of cultural change and local patterns of Europeanisation. [less ▲]

The contributions to this book examine the two main asymmetries of the Euro Area as they have intensified during the second decade of Economic and Monetary Union (EMU): the first between monetary union (more supranational governance) versus ‘economic’ union (less centralised governance); the second between those Euro Area member states of the so-called ‘core’ and those of the ‘periphery’. EMU stands as one of the European Union’s (EU) flagship integration achievements. Set up in 1999, with the large majority of EU member states at the time, EMU was described as ‘asymmetrical’ even prior to its start. From the outset, it involved asymmetrical integration in monetary and ‘economic’ union. Although a major element of the blueprint that paved the way for the final stage of EMU, the concept of ‘economic’ union was insufficiently developed. The second decade of the single currency gave rise to a second asymmetry, namely one between those Euro Area member states of the ‘core’ and those of the ‘periphery’. The ten contributions to this volume speak to one or both of these asymmetries, covering the major political, political economy and policy dimensions of EMU and the ongoing debates about necessary policy and institutional reforms to overcome these asymmetries and bolster Euro Area stability. The outbreak of the Coronavirus (Covid-19) Crisis in 2020 created unprecedented socio-economic challenges for Euro Area member states, heightening the perceived urgency of reform. [less ▲]

Regional development banks (RDB) have become increasingly important in the world economy, but have also been relatively under-researched to date. This timely volume addresses this lack of attention by providing a comprehensive, comparative, and empirically informed analysis of their origins, evolution, and contemporary role in the world economy through to the second decade of the twenty-first century. In Regional Development Banks in the World Economy, the editors provide an analytical framework that includes a revised categorisation of RDB by geographic operation and function. Part one offers detailed analyses of the origins, evolution, and contemporary role of the major RDB, including the Inter-American Development Bank, the African Development Bank, the Asian Development Bank, the European Investment Bank, the Central American Bank, the Andean Development Corporation, the European Bank for Reconstruction and Development, and the Asian Infrastructure Investment Bank. Part two offers comparative analyses of key topics on RDB, examining their initial design and their changing business models, their shifting role in promoting policies supported by the United States as hegemon and the private sector. The volume ends with a critical reflection on the role played by RDB to date and a strong defence of the need for these banks in an increasingly complex world economy. [less ▲]

The suggestion to “align international taxation with value creation” first emerged in the context of the OECD BEPS Project aimed at tackling aggressive tax planning strategies resulting in base erosion and profit shifting. The concept of “value creation” was then further relied on in the broader discussion that followed about the impact of digitalization on the global economy generally and the fair allocation of taxes between countries in this new environment. Although the idea – or the guiding principle – that profits should be taxed where economic activities occur and where value is expected to be created initially received a relatively large support, it rapidly became clear (at least to academics) that there would be no obvious answer to the question “where is value being created?” in a manner that would be relevant for (international) tax purposes, inter alia in view of the different models of value creation within corporate entities. Based on 9 thematic reports (offering an interdisciplinary discussion of the concept of value creation mostly from an international perspective) and on 23 national reports (focusing on the meaning of value creation in domestic tax law), this book seeks to contribute to the discussion on whether the concept of value creation is viable, both theoretically and in practice, as a criterion for the allocation of taxing rights under a modernized international tax framework. “You never knew. That was his power.” These words, which picture Keyser Söze in The Usual Suspects (1995), also describe a specific mode of action typical of evil protagonists in popular culture of the 20th and 21st centuries, namely their non-appearance. One can indeed distinguish several types of evil in popular culture: on the one hand, the representatives of the “other” in the sense of a political enemy (the stereotypical character of the Nazi, the Communist, the Arab terrorist, etc.); on the other hand, the figure of the faceless, disguised, not (stereotypically) apparent evil. The secret organization that James Bond fights against in several films is significantly named “Specter”. Similarly, Lord Voldemort remains faceless and ghostlike in the Harry Potter series. These figures do not represent the “other” as a clearly identifiable political antagonist, but an “other other” whose unknowability and namelessness are an essential part to his or her power and (non-)identity. The “bad guys” can always be interpreted as reflections of a political order: by not adhering to the moral, social, and political rules of the community, they reflect on the contingency of these rules and may also try to enforce alternative models of coexistence through violence. It would therefore be interesting to ask to what extent the faceless figure of evil represents a political model without being clearly identified to a political or ideological “other”? In the context of media diversity in popular culture in the 20th and 21st centuries, the portrayal of faceless figures of evil produces an equally wide variety of aesthetic manifestations. The question of the representations of evil thus necessarily exists at the interface between politics and poetics. This issue of Cultural Express wants to examine this interface in popular and youth literature, fantasy, science-fiction, horror, crime fiction, movies, TV series, songs, comics, graphic novels, video games, etc. [less ▲]

The legal sector is being hit by profound economic and technological changes (digitalization, open data, blockchain, artificial intelligence ...) forcing law firms and legal departments to become ever more creative in order to demonstrate their added value. To help lawyers meet this challenge, this book draws on the perspectives of lawyers and creative specialists to analyze the concept and life cycle of legal innovations, techniques and services, whether related to legislation, legal engineering, legal services, or legal strategies, as well as the role of law as a source of creativity and interdisciplinary collaboration. Following the Treaty of Versailles, European nation-states were faced with the challenge of instilling national loyalty in their new borderlands, in which fellow citizens often differed dramatically from one another along religious, linguistic, cultural, or ethnic lines. Peripheries at the Centre compares the experiences of schooling in Upper Silesia in Poland and Eupen, Sankt Vith, and Malmedy in Belgium — border regions detached from the German Empire after the First World War. It demonstrates how newly configured countries envisioned borderland schools and language learning as tools for realizing the imagined peaceful Europe that underscored the political geography of the interwar period. The corona crisis has put a spotlight on the importance of science in modern societies. But not only medicine and the ‘hard’ sciences, also the humanities and social sciences are called for: Which kinds of political rationality determine action in the global crisis? How does ‘Corona’ influence our understanding of borders, migration and international relations? How can we learn from the past? What are the challenges we face in organizing everyday life, teaching and research, art and culture, or in dealing with ourselves? And can digital technologies help us to compensate for the negative effects of the crisis? By trying to find answers to these (and other) questions, the volume brings together contributions from experts at the University of Luxembourg in the fields of psychology and social sciences, literature and linguistics, cultural studies, political science, border studies and educational science. It opens up a panorama of the research taking place at the Faculty of Humanities, Education and Social Sciences, and demonstrates the kinds of contributions these disciplines make when dealing with crises, and in shaping of society in general. At the same time, it reflects on the limits of knowledge these disciplines encounter in the face of a global challenge. [less ▲]

The volume presents the results of a research project (named “Legafight”) funded by the Luxembourg Fond National de la Recherche in order to verify if and how digital tracing applications could be implemented in the Grand-Duchy in order to counter and abate the Covid-19 pandemic. This inevitably brought to a deep comparative overview of the various existing various models, starting from that of the European Union and those put into practice by Belgium, France, Germany and Italy, with attention also to some Anglo-Saxon approaches (the UK and Australia). Not surprisingly the main issue which had to be tackled was that of the protection of the personal data collected through the tracing applications, their use by public health authorities and the trust laid in tracing procedures by citizens. Over the last 18 months tracing apps have registered a rise, a fall, and a sudden rebirth as mediums devoted not so much to collect data, but rather to distribute real time information which should allow informed decisions and be used as repositories of health certifications.
