The European Union is a union under the rule of law and accordingly all exercise of public authority needs to conform with the principle of legality. The legal framework of the EU is, however, as much as that of any state or international organization, subject to change over time. That part of this legal framework specifically governing EU administration has been particularly dynamic. The central reason for this dynamism is to be found in the evolving nature of European integration, and in the changing requirements and conditions for implementing EU policies. The legal framework of administration has been both the subject of, and a response to, change in the ambient political and institutional environment. The EU, having started as an organization of six Member States focused on economic integration, has evolved into a Union of twenty-seven Member States now touching almost all elements of the exercise of public power in a modern society. The evolutionary development of the constitutional basis of EU law, with its many phases of Treaty reforms and change induced by case-law, finds its parallel in EU administrative law. European administrative law has in this process grown, changed, and indeed matured over time, and has emerged as an important, yet sometimes not well understood, factor which materially shapes policy in the EU and its achievement in reality. The rise of the importance of EU administrative law is itself attributable both to the specificities of European integration and to the general increase in the importance of administrative regulation in the past decades. On the one hand, the protection of the society against risks associated with private activity such as banking, food production, energy production and distribution, transport, or activities threatening to the environment, to name just a few, and the achievement of a balance between their benefits and dangers have become increasingly important subjects of attention. On the other hand, the provision of services and infrastructure necessary to ensure and protect basic standards of living such as pensions, health care, access to water, energy supply and telecommunications services have been the subject of mixed regimes, often still having a strong public service element, but increasingly left to private provision subject to various levels of market regulation. Both kinds of motivation for regulatory measures and their implementation by appropriate authorities have added to, and substantially changed, the broad character of public administration in Europe in recent decades. Such changes have occurred not just on a national, that is, Member State level, but also, pre-eminently, on the level of the European Community and now Union. Indeed, many of the changes have themselves been triggered on the European level as integral or at least adjuvant elements of the establishment of the European internal market. The role, then, of administrative law and administrative activity on the European level is extensive and important. Rules and principles governing the exercise of administrative functions, the organization of the institutions and bodies exercising these functions, and applicable procedures are the essence of EU administrative law. These are the subject of this book. There are, it must be observed, many perspectives from which one can view, analyse and comprehend both administration and administrative law. Three models or perspectives appear to us to be particularly helpful: administration and administrative law may be usefully considered from functional, organizational, and procedural standpoints. The functional aspect of administration refers to the totality of the tasks of administration, no matter who undertakes them and how they are carried out. The organizational perspective emphasises the organization and structure of the institutions, bodies, and actors engaged in undertaking such tasks. Finally, a procedural understanding of administration observes the processes which link the various actors and authorities in the performance of administrative functions. None of these models standing alone provides a fully rounded understanding or conceptualisation of the subject matter of the book. A proper analysis of EU administrative law cannot view it from only one of these perspectives. Taken together, however, these three standpoints do offer a comprehensive perception, giving the subject a more multi-dimensional shape, and thus allowing a more tractable presentation of what is very complex material. For this reason, we offer a discussion of each of these three perspectives — the functional, organizational, and procedural aspects of European Union administration and the associated legal framework — by way of introduction. The three models are, of course, closely interlinked and in reality scarcely separable but, for analytical and presentational clarity, they are here addressed separately. [less ▲]

Depuis les référendums sur le feu Traité constitutionnel européen en 2005 et suite au déclenchement de la crise de la dette souveraine d’Etats membres de la zone euro en 2009, la confiance accordée par les citoyens à l’Union européenne et aux gouvernements qui la composent s’affaiblit. Le scrutin pour désigner le nouveau Parlement européen en mai 2014 a confirmé ce « réalignement électoral » au profit de forces politiques qui sont classées et/ou qui se considèrent parfois elles-mêmes comme relevant du « populisme ». Ce rapport de force inédit nous oblige à traiter « à nouveaux frais » de l’identité des populismes et de leurs rapports à la démocratie d’autant plus qu’ils aspirent désormais, s’ils ne l’ont pas déjà fait, à exercer des fonctions gouvernementales. D’où la controverse qui entoure son usage dans les contextes sociaux et politiques. C’est à juste titre qu’on a pu dire que la justice représente un “essentially contested concepts”.1 Néanmoins, même en politique, ce ne sont pas toutes les occurrences ou emploi du terme égalité ou inégalité qui devraient donner lieu à des contestations. In 1922, Harald Bohr and Johannes Mollerup established a remarkable characterization of the Euler gamma function using its log-convexity property. A decade later, Emil Artin investigated this result and used it to derive the basic properties of the gamma function using elementary methods of the calculus. Bohr-Mollerup's theorem was then adopted by Nicolas Bourbaki as the starting point for his exposition of the gamma function. This open access book develops a far-reaching generalization of Bohr-Mollerup's theorem to higher order convex functions, along lines initiated by Wolfgang Krull, Roger Webster, and some others but going considerably further than past work. In particular, this generalization shows using elementary techniques that a very rich spectrum of functions satisfy analogues of several classical properties of the gamma function, including Bohr-Mollerup's theorem itself, Euler's reflection formula, Gauss' multiplication theorem, Stirling's formula, and Weierstrass' canonical factorization. The scope of the theory developed in this work is illustrated through various examples, ranging from the gamma function itself and its variants and generalizations (q-gamma, polygamma, multiple gamma functions) to important special functions such as the Hurwitz zeta function and the generalized Stieltjes constants. This volume is also an opportunity to honor the 100th anniversary of Bohr-Mollerup's theorem and to spark the interest of a large number of researchers in this beautiful theory. [less ▲]

This book describes Python3 programming resources for implementing decision aiding algorithms in the context of a bipolar-valued outranking approach. These computing resources, made available under the name Digraph3, are useful in the field of Algorithmic Decision Theory and more specifically in outranking-based Multiple-Criteria Decision Aiding (MCDA). The first part of the book presents a set of tutorials introducing the Digraph3 collection of Python3 modules and its main objects such as bipolar-valued digraphs and outranking digraphs. The second part illustrates in eight methodological chapters multiple-criteria evaluation models and decision algorithms. These chapters are mostly problem oriented and show how to edit a new multiple-criteria performance tableau, how to build a best choice recommendation, how to compute the winner of an election and how to rank or rate with incommensurable criteria. The book's third part presents three real decision case studies, while the fourth part addresses more advanced topics, such as computing ordinal correlations between bipolar-valued outranking digraphs, computing kernels in bipolar-valued digraphs, testing for confidence or stability of outranking statements when facing uncertain or solely ordinal criteria significance weights, and tempering plurality tyranny effects in social choice problems. The last part is more specifically focused on working with undirected graphs, tree graphs and forests. The closing chapter explores comparability, split, interval and permutation graphs. The book is primarily intended for graduate students in management sciences, computational statistics and operations research. Chapters presenting algorithms for ranking multicriteria performance records will be of computational interest for designers of web recommender systems. This book focuses on the enforcement aspect of tobacco control policy, and argues that the intense regulation of the tobacco market will never be successful as long as it can be circumvented by the availability of illicit tobacco products. Yet, current efforts to combat illicit tobacco trade are insufficient, suffering from several flaws and gaps at the regulatory and operational levels. The aim of this book is to provide an analysis of the legal framework and practice of enforcement with regard to illicit tobacco products. Combining criminological and legal perspectives, it presents and critically analyses the phenomenon of illicit tobacco trade, as well as the policies, legal frameworks and practices in six EU countries with regard to combatting this phenomenon, assessing the strengths and weaknesses of their approaches. Furthermore, it studies the relationship between the EU and third countries (e.g. Ukraine) in terms of how the EU can influence policy and enforcement in these countries in order to counter illicit tobacco trafficking. Not exclusively focusing on the EU, the book also includes an analysis of enforcement against illicit tobacco products in the US. The EU Member States analysed in the book (Belgium, Germany, Italy, Latvia, the Netherlands and Poland) reflect the range of currently available approaches. Some of them have ratified the WHO Protocol against tobacco smuggling; others have not. They belong to different legal traditions and face different challenges due to their respective border situations. While Belgium and the Netherlands are key entry ports to the EU, Poland and Latvia represent the Eastern land border of the EU, with various regional challenges. Italy has a long maritime border, where trafficking is possible from Northern Africa and from the Middle East. It also has significant experience in fighting organised crime. Lastly, Germany is the largest market in Europe and situated in the middle of these trafficking routes. [less ▲]

I introduce the book starting by my own personal experience of growing up in a mixed family and being myself in a mixed marriage. I describe the structure of the book by building up my own method: how I chose this topic, who were the people I interviewed, how (interviews, stories, and objects) and why was the single-but-critical instances analysis important. I focus on the richness of the interaction I had with the interviewees. I underlie the phenomenological stories of struggles, trust and vulnerability. The chapters resolve around power relations, expressing affection, in-depth communication, child rearing, conflict resolution strategies, empathy, female identity, future planning, the role of humor, the biggest cultural and linguistic challenges and opportunities. The focus is on the phenomenon captured in single-but-critical instances in participants' stories. I conclude by describing what significance culture has in intimate intercultural relationships. Proportionality increasingly dominates legal imagination. Initially conceived of as a principle that regulates police action, today it is progressively established as an advanced tool of liberal constitutional science. Its spread, accompanied by a global paradigm of constitutional rights, appears to be an irresistible natural development. This thesis was inspired by the intuition that even though courts and lawyers around the world reason more and more in proportionality terms, proportionality can mean very different things in different contexts, even within the same legal system. While the relevant literature has paid little attention to differences in the use of proportionality, identifying the local meanings of proportionality is crucial to making sense of its spread, to assessing its success, and to appraising the possibility of convergence between legal systems. Through an in-depth study and comparison of the use of proportionality by legal actors in France, England and Greece, this work shows that the local meanings of proportionality are not simply deviant applications of a global model. Instead, they reflect the legal cultures in which they evolve, local paths of cultural change and local patterns of Europeanisation. [less ▲]

The contributions to this book examine the two main asymmetries of the Euro Area as they have intensified during the second decade of Economic and Monetary Union (EMU): the first between monetary union (more supranational governance) versus ‘economic’ union (less centralised governance); the second between those Euro Area member states of the so-called ‘core’ and those of the ‘periphery’. EMU stands as one of the European Union’s (EU) flagship integration achievements. Set up in 1999, with the large majority of EU member states at the time, EMU was described as ‘asymmetrical’ even prior to its start. From the outset, it involved asymmetrical integration in monetary and ‘economic’ union. Although a major element of the blueprint that paved the way for the final stage of EMU, the concept of ‘economic’ union was insufficiently developed. The second decade of the single currency gave rise to a second asymmetry, namely one between those Euro Area member states of the ‘core’ and those of the ‘periphery’. The ten contributions to this volume speak to one or both of these asymmetries, covering the major political, political economy and policy dimensions of EMU and the ongoing debates about necessary policy and institutional reforms to overcome these asymmetries and bolster Euro Area stability. The suggestion to “align international taxation with value creation” first emerged in the context of the OECD BEPS Project aimed at tackling aggressive tax planning strategies resulting in base erosion and profit shifting. The concept of “value creation” was then further relied on in the broader discussion that followed about the impact of digitalization on the global economy generally and the fair allocation of taxes between countries in this new environment. Although the idea – or the guiding principle – that profits should be taxed where economic activities occur and where value is expected to be created initially received a relatively large support, it rapidly became clear (at least to academics) that there would be no obvious answer to the question “where is value being created?” in a manner that would be relevant for (international) tax purposes, inter alia in view of the different models of value creation within corporate entities. Based on 9 thematic reports (offering an interdisciplinary discussion of the concept of value creation mostly from an international perspective) and on 23 national reports (focusing on the meaning of value creation in domestic tax law), this book seeks to contribute to the discussion on whether the concept of value creation is viable, both theoretically and in practice, as a criterion for the allocation of taxing rights under a modernized international tax framework. “You never knew. That was his power.” These words, which picture Keyser Söze in The Usual Suspects (1995), also describe a specific mode of action typical of evil protagonists in popular culture of the 20th and 21st centuries, namely their non-appearance. One can indeed distinguish several types of evil in popular culture: on the one hand, the representatives of the “other” in the sense of a political enemy (the stereotypical character of the Nazi, the Communist, the Arab terrorist, etc.); on the other hand, the figure of the faceless, disguised, not (stereotypically) apparent evil. The secret organization that James Bond fights against in several films is significantly named “Specter”. Similarly, Lord Voldemort remains faceless and ghostlike in the Harry Potter series. These figures do not represent the “other” as a clearly identifiable political antagonist, but an “other other” whose unknowability and namelessness are an essential part to his or her power and (non-)identity. The “bad guys” can always be interpreted as reflections of a political order: by not adhering to the moral, social, and political rules of the community, they reflect on the contingency of these rules and may also try to enforce alternative models of coexistence through violence. It would therefore be interesting to ask to what extent the faceless figure of evil represents a political model without being clearly identified to a political or ideological “other”? In the context of media diversity in popular culture in the 20th and 21st centuries, the portrayal of faceless figures of evil produces an equally wide variety of aesthetic manifestations. The question of the representations of evil thus necessarily exists at the interface between politics and poetics. This issue of Cultural Express wants to examine this interface in popular and youth literature, fantasy, science-fiction, horror, crime fiction, movies, TV series, songs, comics, graphic novels, video games, etc. [less ▲]

Peripheries at the Centre compares the experiences of schooling in Upper Silesia in Poland and Eupen, Sankt Vith, and Malmedy in Belgium — border regions detached from the German Empire after the First World War. The impact of EU law on the Member States depends decisively on the application by national judges of principles and rules elaborated by the EU Court of Justice in response to the preliminary ruling references made by the national judges themselves. Therefore the good functioning of the complex system resulting from the interaction between the EU legal order and the Member States implies a constructive relationship between the Court of Justice and the national judges. With this premise, the volume aims to face the di culties experienced in the ‘dialogue’ between all national courts (on the merits, supreme, constitutional) and the EU Court of Justice. To this purpose the national judges themselves are called to express their opinions: they were requested to illustrate, from their experience, the drawbacks encountered in the communication with the CJEU. Inclusive education has become a leading theme internationally over the past several decades, as it addresses key issues, often controversial, of exclusion/inclusion, learning opportunities, and educational equality and justice. Among international organizations as well as supranational governments, we find an increasing emphasis on recognizing diversity and enabling education for all. This is visible in the Salamanca Declaration (1994), the overall “education-for-all” agenda, the Sustainable Developments Goals (e.g., Education, SDG 4), and the worldwide ratification of the UN Convention on the Rights of People with Disabilities (e.g., Article 24 on Education), which mandates among state parties the establishment of an inclusive education system across levels, from early childhood to lifelong learning. This frame of reference is not only significant in terms of definitions and contents but also in the context of the strengthening of world society. The world societal level is not the same as what occurs in the relations between nation states, as important as such learning in policies and practices may be but extends beyond. This is evident in the definition of “inclusion” that has become significant internationally as a category signifying attempts to guarantee access and participation in different levels of education systems, but one that has contrasting and divergent understandings, implications, and implementation consequences between national and local contexts. The goal of participation that follows normatively and legally from such understandings of inclusion, is recontextualized differently, sometimes even paradoxically, when in fact segregated and separate settings are extended under the banner of inclusion. In Germany, for example, despite inclusion discourse flowing from such international agendas that focus on processes of integration and participation, the structures, cultures, and practices that disadvantage and disable continue to exist or even become strengthened. Even if the myriad dimensions of diversity are increasingly discussed and intersectional approaches become more important, the emphasis on difference of disability or “special educational needs” continues. In educational research, numerous publications have delineated the establishment of inclusive education from diverse perspectives. Over the past decade in particular, this has occurred in relation to the UN CRPD, which also implies a connection to the world society-frame; however, theorization and in-depth empirical analyses are lacking to explain more recent developments on multiple levels. Even for nation-states, few systematic and comparative studies have analyzed the diverse forms of inclusive education in different contexts. The consequence has been a divergence between the national discourses of inclusive education, for example, in the German-speaking countries, that remain focused on special educational needs, and the more global discourse that understands inclusive education in human rights terms and a key developmental process in democracies. Although some recent comparative research projects and dissertations provide insights into specific country contexts, a more comprehensive publication that collects such research results of international inclusive educational research has been lacking. Furthermore, the opportunity presents itself to extend the dialogue through a world society perspective on inclusion to reflect global inequalities via integrating case studies from the Global South. International and intercultural perspectives enable the investigation of structures, cultures and practices of different countries to the crucial comparison of educational processes. This is especially necessary in the case of inclusive education, whether as a source of inspiration, a reflexive critique of taken-for-grantedness or as a means to identify disparities and social inequalities. Thus, in several dozen chapters, the Handbook Inclusion International presents diverse global, national, and local perspectives on inclusive education. [less ▲]

Die Erstellung des nationalen Berichtes zur Situation der Jugend in Luxemburg geht auf den Artikel 15 (1) des Jugendgesetzes vom 4. Juli 2008 zurück, wonach der Minister, zu dessen Zuständigkeitsbereich die Jugendpolitik gehört, der Abgeordnetenkammer alle fünf Jahre einen Bericht vorlegt. Nach dem ersten Bericht im Jahr 2010, der als Gesamtbericht verschiedene Themen behandelte, thematisierte der zweite Bericht im Jahr 2015 die Übergänge vom Jugend- ins Erwachsenenalter. Der thematische Schwerpunkt des vorliegenden dritten Berichtes ist das Wohlbefinden und die Gesundheit von Jugendlichen in Luxemburg. Der Bericht umfasst zwei Teile: eine wissenschaftliche Analyse und Bestandsaufnahme, die von dem Centre for Childhood and Youth Research (CCY) an der Universität Luxemburg erstellt wurde, sowie einen Beitrag des Ministeriums für Bildung, Kinder und Jugend, welche den Kontext erläutert und die zukünftigen Schwerpunkte der luxemburgischen Jugendpolitik reflektiert. Bei der wissenschaftlichen Analyse und Bestandsaufnahme stehen die Jugendlichen und ihre subjektiven Sichtweisen, ihre Bewertungen und Handlungen im Zusammenhang mit ihrem Wohlbefinden und ihrer Gesundheit im Fokus. Der Bericht zeigt auf, (1) wie Jugendliche ihr Wohlbefinden und ihre Gesundheit einschätzen, (2) was Jugendliche für ihr Wohlbefinden und ihre Gesundheit tun oder nicht tun, (3) welche Bedeutung das soziale Umfeld für das Wohlbefinden der Jugendlichen hat, (4) wie Jugendliche die Covid-19-Pandemie und die Maßnahmen wahrnehmen und (5) wie luxemburgische Experten über das Wohlbefinden und die Gesundheit Jugendlicher diskutieren. Die Datengrundlage bilden vor allem die eigens für den Bericht erhobenen Daten aus standardisierten Umfragen und qualitativen Interviews. Um die Veränderung der Situation der Jugendlichen durch die Covid-19-Pandemie zu beschreiben, wurde während der Erarbeitung des Jugendberichtes eine weitere Studie entwickelt und durchgeführt, deren Ergebnisse im Bericht gesondert dargestellt werden. Der Bericht liefert eine umfassende Informationsgrundlage für die zukünftige Ausrichtung und Weiterentwicklung der Jugendpolitik der luxemburgischen Regierung, die in einem nationalen Jugendpakt zusammengefasst wird. Er richtet sich sowohl an Fachleute in den verschiedenen jugendrelevanten Arbeitsfeldern als auch an Studierende und alle Leserinnen und Leser, die an fundierten Informationen zur Jugend in Luxemburg und deren Wohlbefinden und Gesundheit interessiert sind. GERPS is based on an origin-based multistage probability sample using the German population registers as a sampling frame. The second wave yields a net sample of roughly 7,000 persons who recently moved abroad from Germany and persons who returned from Germany after having lived abroad. The study follows a multidestination- country-design and enables the comparative analysis of migrants and nonmigrants, who stayed in the country of origin. GERPS is a panel study with at least four waves during a period of at least 24 months. This documentation presents the methods and data of the second wave. It provides information for researchers and invites them to use the new data infrastructure for their own research. [less ▲]

Qu’est-ce que la philosophie ? Pour Deleuze, il s’agit de la création de concepts qui répondent chacun à un problème précis. Selon la théorie du concept deleuzienne, les concepts philosophiques partagent en plus une certaine forme : une multiplicité de composantes, un volume absolu, des variations intensives, un ordre de voisinage. Or, cette interprétation de l’activité philosophique est à son tour un concept : « le concept de concept. » Comme tout autre, ce concept répond à un problème – « quel est le propre de la philosophie ? » – et il recèle une multiplicité, un volume, des variations, un voisinage. Même si le concept de concept saisit l’essentiel de l’activité philosophique, on pourra alors croire qu’il est d’une portée limitée et voué à être dépassé comme n’importe quel autre concept. Sinon, il encourt le risque d’auto-réfutation : vrai sur le fond mais faux dans la forme. L’étude présente demande sous quelles conditions la théorie du concept deleuzienne peut échapper à ce sort et propose une lecture transcendantale selon laquelle le concept de concept est la condition de l’expérience et du discours philosophiques.
