L'objectif de cet article est de mettre en évidence les différentes incertitudes que l'on rencontre lorsque l'on tente d'assurer l'application de leurs droits fondamentaux aux utilisateurs de FinTech. La protection des données et plus particulièrement les dispositions du Règlement Général sur la Protection des Données sont utilisées comme exemples dans cet article, afin d'illustrer les difficultés rencontrées. Ici, trois principales interrogations sont abordées: celles concernant les destinataires des dispositions du Règlement Général sur la Protection des Données, celles concernant les différences de traitement prévues par le Règlement Général sur la Protection des Données pour les données personnelles, pseudonymisées et les informations anonymes et enfin celles concernant la qualification des données disponibles sur des blockchains publiques et privées. Finalement cet article met en évidence les conséquences que ces incertitudes peuvent avoir sur la protection des droits fondamentaux des utilisateurs de FinTech ainsi que la nécessité d'assurer la sécurité juridique grâce à des instructions supplémentaires provenant du législateur européen ou grâce à la jurisprudence à venir. The combination of article 47 of the EU Charter of Fundamental Rights and article 19, 1st paragraph of the Treaty on European Union defines and protects the fundamental right to an effective remedy. Those primary law provisions shall be interpreted in the light of article 6 of the European Convention on Human Rights, which traditionally constitutes the most favoured source of inspiration for the Court of Justice of the European Union. The sui generis legal order of the European Union offers and protects a high level of judicial protection, as the Lisbon Treaty establishes a triple guarantee of fundamental rights to be effectively enforced via a complete system of legal remedies and procedures at different levels. More than ever, legal experts having a good command of economics highlight the fact that credit institutions are, per se, transmission channels from banking crises to the real economy. More than necessary, it is vital to reach and maintain the efficiency of the Single supervisory mechanism (SSM), first pillar of the European banking Union. The overall objective of public interest to preserve the financial stability of the euro zone and of the European Union as a whole prompted the legislature to confer wider (the widest?) powers upon competent authorities; nevertheless, these authorities must ensure that supervised banks are guaranteed the right to an effective judicial protection throughout the whole process. Do private interests weaken the general objective of financial stability, or is the SSM a balanced mechanism? [less ▲]

In diesem Beitrag untersuchen wir das Potential dieser Entwicklung anhand von sozialen Klauseln, die einen Arbeitgeber, der mit der Übernahme einer Dienstleistung beauftragt wurde, dazu verpflichten sollen, die vom früheren Dienstleister eingestellten Arbeitskräfte beizubehalten. Wir sind der Ansicht, dass diese Weiterbeschäftigungsklauseln grundsätzlich mit den fundamentalen Grundfreiheiten der EU-Verträge vereinbar sind. [less ▲]

This book publishes the contributions to the University of Luxembourg/UNHCR symposium on the legal protection of people fleeing armed conflict and other situations of violence. Assembling a distinguished group of judges, scholars and practitioners, the event examined the assessment of claims for international protection in such situations under, respectively, Article 1A(2) of the 1951 Refugee Convention, Article 3 of the European Convention on Human Rights and Article 15(c) of the EU Qualification Directive. Although originally it was hoped that the symposium would also mark the publication of the UNHCR’s Guidelines for the Protection of People Fleeing Violence and Conflict Across Borders, this did not prove possible. Indeed, the Guidelines still remain unpublished, a testimony to the sensitivity of the topic. Nonetheless, the papers contained in this volume demonstrate how much ground was covered during the symposium and how many important issues were discussed. [less ▲]

The best validated susceptibility variants for Parkinson's disease are located in the alpha-synuclein (SNCA) and microtubule-associated protein tau (MAPT) genes. Recently, a protective p.N551K-R1398H-K1423K haplotype in the leucine-rich repeat kinase 2 (LRRK2) gene was identified, with p.R1398H appearing to be the most likely functional variant. To date, the consistency of the protective effect of LRRK2 p.R1398H across MAPT and SNCA variant genotypes has not been assessed. To address this, we examined 4 SNCA variants (rs181489, rs356219, rs11931074, and rs2583988), the MAPT H1-haplotype-defining variant rs1052553, and LRRK2 p.R1398H (rs7133914) in Caucasian (n = 10,322) and Asian (n = 2289) series. There was no evidence of an interaction of LRRK2 p.R1398H with MAPT or SNCA variants (all p >/= 0.10); the protective effect of p.R1398H was observed at similar magnitude across MAPT and SNCA genotypes, and the risk effects of MAPT and SNCA variants were observed consistently for LRRK2 p.R1398H genotypes. Our results indicate that the association of LRRK2 p.R1398H with Parkinson's disease is independent of SNCA and MAPT variants, and vice versa, in Caucasian and Asian populations. [less ▲]
