[more ▼] The aim of this chapter is to highlight the different issues that one faces when trying to ensure the fundamental right to data protection of blockchain users. The provisions of the General Data Protection Regulation are used as an example of the difficulties. Here, two principal issues are addressed: issues regarding the addressees of the General Data Protection Regulation's provisions and issues regarding the qualification and treatment of data available on permissionless and permissioned blockchains. Finally, this article highlights the consequences that these uncertainties may have on the protection of users’ fundamental rights and the necessity to ensure legal certainty through additional guidance from the European legislator or upcoming case-law. [more ▼] The project is to conduct an interdisciplinary research which follows a theoretical approach motivated by systems theory. This theory observes a dynamic within society which has consequences on sovereignty and which ends up in the development of fragmented legal frameworks. This change is observed through the example of the ecosystem of cryptocurrency developing its own functional rules and the reaction of the criminal justice system (especially through the anti-money laundering legal framework) which is used as means of social control upon the ecosystem. This has consequences not only on the legitimacy and on fundamental principles of criminal law but also on fundamental rights. The goal is to develop an autonomous legal order that would enable to address these issues. [more ▼] The international health emergency caused by the Covid-19 outbreak is unprecedented. The purpose of this article is to compare the legal approaches adopted by France and Italy in order to deal with the epidemiological crisis that threatens the health of citizens as well as the essential principles of the rule of law. The choice of the legal basis for the current emergency measures is analysed after reviewing the regimes that the two European states have put in place over the years to face exceptional situations of a different kind: human-caused emergencies - such as terrorist attacks or wars - as well as natural disasters. Secondly, the article focuses on the implementation of the measures adopted by the organs of the state executive power to combat the spread of the epidemic, with particular regard to the sanctions for violations of confinement measures. As the French and Italian governments play a leading role in the fight against Covid-19 through law, the different types of control exercised vis-à-vis the executive power will also be considered. Finally, the article provides an overview of the possible consequences that the current health crisis could have in the post-Covid-19 era, to conclude that in such an exceptional situation, law must be able to deal with the new challenges posed by the coronavirus without questioning its fundamental principles. [more ▼] L'objectif de cet article est de mettre en évidence les différentes incertitudes que l'on rencontre lorsque l'on tente d'assurer l'application de leurs droits fondamentaux aux utilisateurs de FinTech. La protection des données et plus particulièrement les dispositions du Règlement Général sur la Protection des Données sont utilisées comme exemples dans cet article, afin d'illustrer les difficultés rencontrées. Ici, trois principales interrogations sont abordées: celles concernant les destinataires des dispositions du Règlement Général sur la Protection des Données, celles concernant les différences de traitement prévues par le Règlement Général sur la Protection des Données pour les données personnelles, pseudonymisées et les informations anonymes et enfin celles concernant la qualification des données disponibles sur des blockchains publiques et privées. Finalement cet article met en évidence les conséquences que ces incertitudes peuvent avoir sur la protection des droits fondamentaux des utilisateurs de FinTech ainsi que la nécessité d'assurer la sécurité juridique grâce à des instructions supplémentaires provenant du législateur européen ou grâce à la jurisprudence à venir.
