L’arrêt opère un revirement de jurisprudence en jugeant que, lorsqu’il n’est pas compétent au fond, le juge français a une compétence limitée pour ordonner des mesures d’instructions sur le fondement de l’article 35 du Règlement (UE) n° 1215/2012 (Bruxelles Ibis), même lorsqu’elles doivent s’exécuter sur le territoire français. Concernant des mesures visant à obtenir la communication de documents en possession des parties adverses, elles doivent avoir pour objet de prémunir la partie demanderesse contre un risque de dépérissement d’éléments de preuve dont la conservation pouvait commander la solution du litige. Le juge français ne peut ordonner une mesure visant seulement à établir des faits, ou à déterminer les chances de succès d’une action au fond. [less ▲]

The European Union has worked at making cross-border enforcement more effective for more than 50 years. The process initially focused on the circulation of foreign judgments rendered in civil and commercial matters within the European Communities and the European Free Trade Association. At the turn of the century, as the European Union received a broader competence in the field, the EU lawmaker extended the scope of this initial policy to other subject matters, in particular in family law, but also endorsed a new policy of establishing harmonized EU procedures for the purpose of facilitating cross-border recovery of certain categories of claims (uncontested claims and small claims). The purpose of this contribution is to assess these policies and explore whether cross-border enforcement of monetary judgments could be made (even) more effective for creditors. [less ▲]

The aim of this Article is to assess the preferences of parties to Latin American international business transactions when they choose the law governing their contracts. For that purpose, we have conducted an empirical analysis of data that we were able to gather from arbitral institutions active in Latin America, with a focus on years 2011 and 2012. We then offer some reflections on the results and assess whether they can be explained by the territorial approach of choice of law in Latin America, the importance of the United States as a trading partner for Latin American countries and the extent to which Anglo-American lawyers are present on Latin American markets. Despite the exclusion of arbitration from the European law of jurisdiction and judgments (Brussels I bis Regulation, Lugano Convention), the European Court of Justice has ruled in the Van Uden case that the jurisdiction of the courts of the Member or contracting States to grant at least certain interim measures in aid of arbitration is governed by these European instruments. This Article explores the consequences of the application of European law on the power of courts to grant such measures and in particular defines the scope of European law in this respect and the limitations that it establishes on the jurisdiction of the courts of the relevant European states. The aim of this Article is to document and assess the efforts made by international commercial courts to signal the enforce-ability of their judgments abroad. To that effect, three strategies were developed. The first and most obvious one was to enter into agreements providing for the mutual enforcement of judgments of contracting states which could serve the same function as the 1958 New York Convention for arbitral awards. Yet, as the 2005 Hague Convention has a limited scope and the 2019 Hague Convention is not yet in force, alternative strategies were identified. Several international commercial courts are actively pursuing the conclusion of non binding documents with other courts or even law firms suggesting that the judgments of the forum would be enforced by the courts of other states. Finally, one international court has also explored how it could convert its judgments into arbitral awards. [less ▲]

L’ouvrage présente de manière systéma-tique les règles de droit international privé applicables au Grand-Duché du Luxem-bourg. Ce premier volume est consacré à la détermination de la loi applicable et expose la théorie générale du conflit de lois ainsi que les solutions particulières concernant les obligations (contrats, délits, régime gé-néral de l’obligation), les biens (corporels et incorporels) et les sociétés (y compris en cas d’insolvabilité).A l’instar du droit des autres Etats membres, le droit international privé luxembourgeois est dominé par des sources d’origines européenne et internationale. Sa spécificité demeure forte, cependant, car le Luxembourg a ratifié des conven-tions internationales différentes de ses grands voisins francophones et adopté des normes nationales qui s’inspirent de plu-sieurs expériences juridiques étrangères, mais peuvent aussi être originales. Sans négliger la jurisprudence européenne, l’ouvrage tente enfin de rassembler la ju-risprudence des juridictions luxembour-geoises en la matière qui, à nouveau, si elle s’inspire le plus souvent de la jurisprudence française, s’en écarte parfois. Frente al paradigma de que la justicia contractual constituye un bien público, el autor sostiene que se ha generado durante los últimos años un proceso de reivindicación en el cual el arbitraje retorna y viene a reclamar un terreno que le pertenece: la resolución de las controversias comerciales. Las personas han notado las ineficiencias del Poder Judicial y se han dado cuenta de que el arbitraje es una mejor elección. Como muestra de ello, en los contratos comerciales relevantes lo usual es pactar un arbitraje. Hoy en día es difícil hallar un contrato importante que no incorpore una cláusula arbitral. En esa línea resulta curioso que muchas veces se considere al arbitraje como un mecanismo alternativo de resolución de conflictos. Y es que se trata de cualquier cosa menos de un mecanismo alternativo. Para el autor, el arbitraje se ha convertido en el mecanismo natural de resolución de controversias comerciales. Fácticamente es la regla, y como tal no puede ser una alternativa. En el marco de este de proceso de reivindicación espontánea, el autor propone consagrar al arbitraje como la “default jurisdiction” (o jurisdicción por defecto) para todas las controversias de carácter patrimonial. En un mundo como el que vivimos el arbitraje ha llegado, y ha llegado para quedarse. [less ▲]
