This working paper aims to provide a critical assessment of the impact of the economic and financial crisis on the protection of fundamental social rights in the euro area. It is based on a comparative analysis of national and European case law in connection with the macroeconomic adjustment programmes in the euro area Member States receiving financial assistance. The austerity measures have been challenged before the relevant authorities at national and European level within the Council of Europe and the EU, with mixed results. It also examines new issues raised by the introduction of the European Stability Mechanism from the angle of fundamental rights. Finally, the initiative for a European Pillar of Social Rights is placed in the broader context of the multilevel protection of social rights in Europe. Converging approaches are needed. [less ▲]

This interdisciplinary contribution aims to look back at the past and provide some insights from historical sources which may be used today as key comparative tools for the interpretation and analysis of the current situation in the light of the United Kingdom’s future relationship with the European Union. This relationship is a recurring issue in the European integration process, one which has never been satisfactorily resolved. After a short historical overview of British accession to the European Communities, the presentation focuses on the 1975 referendum in order to provide some food for thought ahead of the 2016 referendum on the UK’s EU membership. It argues that, although the 1975 referendum was a product of its time and its circumstances, there is an essential common thread that links the past to the present. The forthcoming referendum is not going to change the ‘British–European pattern’ that has taken shape over the past decades. [less ▲]

L’institution du mécanisme européen de stabilité (MES) pose de nouvelles questions est aussi examinée sous l’angle des droits fondamentaux. Enfin, le lancement du socle européen des droits sociaux au sein de l'Union européenne est analysé dans le contexte d’initiatives favorisant une approche intégrée de la protection de ces droits fondamentaux en Europe.
