The first examines whether divergences in national procedural laws and practices constitute obstacles to mutual trust and, in the affirmative, identifies the locus and the scale of such obstacles; it thereby facilitates the identification of the areas in which mutual trust needs to be further enhanced in line with the European Council Conclusions of 26/27 June 2014. In addition, the study addresses possible obstacles to legal certainty when businesses and citizens engage in cross-border litigation. The second strand of the study evaluates whether and to what extent national procedural laws and practices ensure the effective procedural protection of EU consumers. Both strands of the study investigate the legal and the practical situations in the civil procedural laws of the 28 EU Member States. Une étude empirique des données publiées par la Chambre de commerce internationale depuis plus de dix ans et par plusieurs autres institutions arbitrales européenne et asiatiques montrent que les opérateurs du commerce international ne prévoient pratiquement jamais son application dans les contrats internationaux qu’ils concluent. Il semble donc que ces opérateurs ne lui trouvent aucun avantage particulier, voire lui soient hostiles. Ce constat fait naître la question de la vitalité d’une théorie remarquable, mais semble-t-il sans incidence pratique. Its imminence can be easily ascertained by every practitioner even remotely concerned with cross-border work in Europe. However arcane private international law in general might appear to practitioners – the Brussels I Regulation was a well-known and renowned instrument and the Brussels Ibis Regulation will become so as its proper heir. The so called Brussels system has proven its immeasurable and incomparable value for over forty years. The European Court of Justice and the national courts of the Member States have produced an abundance and a treasure of judgments interpreting the Brussels Convention and the Brussels I Regulation.
